So transfer the ownership of the domain and use the hosting you have purchased for another enterprise of your own. Why should your outlay for the hosting be covered by the sale of this domain? Ironic that hosting is on godaddy as cake fan problematic on those servers. The domain is of little value really, the hosting is of no value. As cake foundation could host it on existing servers. Hi phpMagpie, The $200 is not for the domain registration, but because I have paid the hosting in advance, which is valid until 2013 and can be kept by anyone interested in the domain. I cannot get a refund for this so I at least would like to get this part back. The auction is because I got into GoDaddy Auctions for free as a bundle with another purchase. I re-researched and feel fair, nominative use is valid in this case. Nominative fair use is established when: - The product cannot be readily identified without using the trademark; - Only so much of the trademark is used as is necessary for the identification; and - No sponsorship or endorsement of the trademark owner is suggested by the use. Sandy, I am not sure where you checked on this being "fair use" but I an guarantee it does not fall under fair use. You have the option of removing it yourself, or as I said, I can have a take down notice sent. The Cake Software Foundation, Inc protects its trademarks and copyrights it owns and does so to protect our community of users. If an organization does not protect their trademarks, they run a chance of forfeiting them. I have been through this process a few times since the foundation was formed. -- Larry E. If not, alot of similar websites would also have to be shutdown (Google "photoshop tutorials", "excel tutorials" or similar to see a great list of websites that use trademarks legally in the same fashion). I investigated beforehand and this is fair use of a trademark. I'm not trying to impersonate or cause confusion among CakePHP users by making a CakePHP tutorial site... the word CakePHP is used nominatively. If this were true, then many sites that contain trademarked names would have to be closed, for example: photoshoptutorials.ws/ www.photoshopstar.com/ www.officetutorials.com/ excelhelp.org/ www.excelforum.com/ and tons more.
