JUSTIFICATION: OFFSETTING POLITICAL EXPEDIENCY

The impeachment process is an inquiry. It is the process directed at former President Clinton for lying about a matter that Democrats offered was personal, only a matter of sex, and the outcome of the politics of personal destruction. The impeachment process is initiated in the House of Representatives, which serves as an investigation of wrongdoing. The Senate must conduct a trial examining legal ramifications that can result in removal from office.

Curiously, the justification for both an impeachment and its use are found in virtually the same place in the United States Constitution: Article II [powers of the President], Section 3 [State of the Union Message], and Section 4 [removal from office]. The Congress unconstitutionally conveyed to President George W. Bush, the authority of war-making powers, thereby violating Article I [powers of Congress], Section 8, paragraph 10 [the power to declare war].

Presidents in the past have maneuvered to obtain this concession from Congress, justifying it as necessary for the political expediency of a quick response to a national emergency or attack. Such political expediency is nevertheless unlawful and unconstitutional, subverting the intent of our republics spirit of a separation of powers, specifically as it relates to the control of the Nations military might. The Congress, by having abdicated its war-making powers in the absence of an attack upon our Nation, gave President Bush dictatorial powers during peacetime.

Simply avoiding entangling alliances can obviate such expediency. It can be avoided to even a greater extent by deploying our military only when attacked. This eliminates the need for our maintaining standing armies in other nations and their staggering related costs, as well as the need for foreign treaties and their intrigue.

But President George Bush did maneuver for such power in his State of the Union address. And part of that address alleged that Iraq was trying to obtain uranium from Niger in order to construct a nuclear weapon. How many other nations, including our own, are currently engaged in this activity? This is no justification for war. 

Along with an absence of weapons of mass destruction, the falsification of intent citing the need for a regime change, and now the falsification of a report on uranium procurement, President George Bush appears to have lied outright to the American people in his State of the Union speech. He falsely cited a clear and present danger to America. He implied that Iraq was involved in the 9-11 terrorist attack upon our nation, yet to date, no such evidence has been presented.

In their headline article of July 12th in the New York Times entitled, C.I.A. Chief Takes Blame in Assertion on Iraqi Uranium, David E. Sanger and James Risen launch their piece stating: The director of central intelligence, George J. Tenet, accepted responsibility yesterday for letting President Bush use information that turned out to be unsubstantiated in his State of the Union address, accusing Iraq of trying to acquire uranium from Africa to make nuclear weapons.

The article continues: Mr. Tenet issued a statement last night after both the president and his national security adviser placed blame on the C.I.A., which they said had reviewed the now discredited accusation and had approved its inclusion in the speech. 

For days, the White House has tried to quiet a political storm over the discredited intelligence, which was among many examples cited in Mr. Bush's speech to justify the need for confronting Iraq to force the dismantlement of Saddam Hussein's arms programs.

It is clear, and hoped for as well, that the upcoming report from Republican Thomas Keans 9-11 investigation committee, which has been reputedly hampered by both funding as well as information delays from the White House, that the incompetence of intelligence gathering, a process that had it been handled properly could possibly have prevented much if not all of the devastation of 9-11, will point blame at both the CIA and the FBI relative to that terrorist act. Yet Mr. Bush has consistently stood by FBI directors Mueller and Freeh, and CIA director Tenet.

Now Mr. Tenet is accepting responsibility. What does that mean? Is that the same responsibility former Attorney General Janet Reno accepted for the Waco massacre? What was her punishment? What will Tenets be?

The article quotes Bush as saying;  I gave a speech to the nation that was cleared by the intelligence services. In contract law, the question of reliability as concerns the warranty made by one party to a contract focuses both on whether the other party relied upon a statement made, and whether or not the relying party could reasonably be expected to have had a right to rely upon that representation of fact. Could Bush be reasonably expected to rely upon his own intelligence

The Columbus Free Press is launching its own Office of Total Counter-Information Awareness. In the last few months, weve accumulated enough information to warrant the impeachment of President George Bush. 

First, lets recall Bushs strange relationship with that bizarre little company in Lansing, Michigan, known as Bioport. The company, despite failing various FDA inspections and being accused of bad record-keeping, holds the only federal contract for producing the anthrax vaccine. Bush has rewarded Bioport with favors such as ongoing military protection, and within weeks of 9/11 granted them a contract that tripled the price per vaccine. Now, add into the mix that the Strangelovian CIA-connected Battelle and Britains top secret Porten Down labs are partners with Bioport. 

Owners and investors in Bioport include former Chairman of Joint Chiefs of Staff William Crowe and Fuad El-Hibri. Public records and foreign press reports have linked El-Hibri to the selling of anthrax to Saudi Arabia after the Pentagon refused to. Hes also a business associated of the bin Laden family. A real Congressional investigation of Bushs relationships with the bin Laden family, El-Hibri and the related drug bank BCCI would easily lead to the Presidents impeachment. 

Second, the Presidents utter contempt for U.S. citizens was displayed in his appointments of three criminals: the pompous pipe-puffing Admiral John Poindexter, Elliott Abrams of Iran-Contra infamy and wanted war criminal, Henry Kissinger. 

Poindexter, who now runs the Office of Total Information Awareness, is busily keeping files on every U.S. citizen. Well, put this in your file on Poindexter. He supervised the illegal arms for hostage sale to Iran that violated the Arms Export Control Act; he sanctioned the funneling of profits from that illegal sale into the Nicaraguan Contras, a group more famous for its drug-running than fighting the Sandinistas; he lied about his activities and destroyed evidence during the Congressional investigation; and a federal jury found him guilty of lying and obstructing justice, but the fix was apparently in and two conservative federal appeals judges overturned his convictions. 

After lying to Congress about the Iran-Contra scandal and being convicted on two counts, Abrams was pardoned by Bush, Sr. Now thanks to Bush, Jr., he is the top Middle East advisor on the National Security Council. 

And what can we say about Kissinger? From the secret bombings of Cambodia to the overthrow of Chiles democracy, there is perhaps no figure more hated in the world than the good doctor. This did not stop Junior from appointing him to cover up the real causes of 9/11. Fortunately, Special K was forced to resign when he refused to disclose his clients from his private consulting firm, Kissinger and Associates. We would have stood a better chance of getting to the truth of 9/11 had we dug up the bones of Earl Warren and created another bogus Warren Commission. 

Meanwhile, the forces of Big Oil surrounding Bush are hell-bent on stealing the Iraqi peoples petroleum and somehow they seem able to convince the U.S. people that the Baby Jesus himself put that oil in Iraq for us to pilfer in the name of God and country. 

Despite the Bush Jr.s administrations best efforts to hide the crucial role of Bush, Sr. in arming Iraq with biochemical weapons in the 1980s  including Secretary of State Colin Powells bullying the UN into allowing him to remove 8,000 key pages of Iraqs 12,000-page dossier on weapons  the story continues to break. 

Finally, Bushs foreign policy contains the rabid elements of inbred elitist ignorance. A week before Christmas, Human Rights Watch reported that the U.S. military violated international law in Afghanistan by indiscriminately dropping cluster bombs in civilian areas. That same week, the Bush administration announced a new strategy of covert actions and pre-emptive strikes, including nukes, against any country that dares attack U.S. troops now stationed in at least 148 nations throughout the world. The President announced his new version of Star Wars, Jr. guaranteeing huge profits for the U.S. military-industrial complex and insuring we will continue to be the nation with the greatest stockpile of weapons of mass destruction. 

For these and other reasons too numerous to reveal, the President must be impeached.

High Crimes and Misdemeanors

After painful consideration, I have decided it is time to bring out my Impeach the President placard, dust it off and display it yet again. It has been an oft-used sign, first waved during the LBJ regime and utilized for every president since. Now it is time to confront this latest in our long line of executive branch losers. 

I do not take my impeachment stand lightly and only after I am certain that the President is guilty of treason, bribery or other high crimes or misdemeanors as mentioned in Article 2, Section IV. I wait for egregious acts that can only be seen as invidious to our Constitution, the pissing all over that which he had solemnly sworn to uphold. 

I attempt a two-year wait before considering the impeachment step, to give each President time to develop wisdom, to learn from mistakes and become a thoughtful leader. I am such an optimistic idealist. I try to wait, but I usually fail as each President, upon entering office, begins a headlong retreat from the Constitution’s sagacity and probity and begins treating it as a sworn enemy. Only Carter and Reagan made the two year mark which must mean I wasn’t paying attention then. Nixon was Nixon, a blot upon our history; Ford barely had two years and started by pardoning Tricky Dick; George the First crossed the line with his invasion of Panama and with Clinton, I waved my placard before his inauguration since I sensed he was a total sleazebag. 

There are many reasons to call for George’s impeachment, but one particular stands out as so disreputable that I cannot wait for his second anniversary. 

When, at a gathering of Fliberals (‘Frisco liberals), I announced my call for impeachment, the Flibs agreed and excitedly gathered round me as if I had finally become one of them. When I asked them what were their grounds for impeachment, they had to think (which takes time for a Fliberal, if they can do it at all) until a Flib finally said, "Dubya stole the election." A second chimed in with, "Illegal actions in foreign affairs." "He’s stifling dissent"and "He’s incredibly stupid" were other responses. 

With little examination it became clear that their charges would not measure up to those cited by the Constitution, but then again Flibs have little interest in our Constitution. 

How long did the Samuel J. Tilden Democrats whine about their loss after 1876? Eight years at least and many, I am convinced, never ceased complaining. If I didn’t so enjoy Fliberal whining (which they do so well), it could be grim times ahead. Their nonstop whine that Bush stole the election — Gore not only won the popular vote, but would have won Florida, and the electoral vote too, if the biased and politicized Supreme Court hadn’t entered the fray. I have always found it odd that Fliberals proudly claim as their own all those Floridians too stupid to punch a hole in paper. 

Whine, whine, whine. Yes, Gore did win more votes than Bush but since he did not gain a majority of the ballots cast, he had no clear claim to victory at all. If Fliberals ever took the time to read the Constitution of the United States (and of Florida), they would realize how a disputed or muddled Presidential election was to be settled — by vote of the lower house of the legislature, in which Republicans held a slim but clear majority. Bush would have been selected. No theft. 

As to overstepping Constitutional limitations abroad and at home, George 2 has, but this is now routine for our Imperial Presidents, including Bill Clinton. If Fliberals wouldn’t impeach Bill on these grounds, how can they now impeach Bush? 

Our Emperor Presidents must be free to kill and maim, bomb and threaten, arrest and jail anyone, anywhere, at any time, and any who dare to disagree or dissent must be distrusted. 

Once again G-2 has launched us into undeclared and therefore unconstitutional warfare. He had the civility to ask our supine and corrupt Congress for a blank check to cover any and all future actions, ever, but this is not what the Founders envisioned. 

Time to bring out my Impeach Congress sign too. 

Our Imperial Presidency has become so accepted that raising a cry for impeachment for overstepping Constitutional limits is met with bewilderment. "America’s not an empire," people of all political stripes inform me. End of discussion. And with Congress in cahoots, how could such an impeachment succeed? 

I would not call our President stupid, as it is such a vague and pejorative word. I prefer to think of him as positively obtuse and mentally phlegmatic — nearer the mark while showing a touch of respect for the once noble office he occupies. 

Yet, even if all agreed as to his stupidity, could it be construed as a high crime or misdemeanor? Couldn’t being dense be viewed as a necessity in a truly representative government?

A former member of Congress launched a campaign to impeach the five
conservative Supreme Court justices who voted to stop the presidential ballot
recount in Florida last year -- but admits it's a long shot.

Charles Porter, an 82-year-old attorney in Eugene, said the Supreme Court
ruling was so clearly influenced by politics that under the Constitution
there may be grounds to impeach the justices for bias.

The 5-4 decision in December resulted in George W. Bush being named
president-elect and his opponent Al Gore conceding the election.

"They did wrong, they voted politically to stop the election," Porter said.

"A lot of people out there think this would be a terrible precedent for the
United States if the court could ... vote for political reasons," he said.

At issue is a clause in the Constitution calling on judges to show "good
behavior," Porter said. While this is not defined in the founding document,
the American Bar Association says judges should avoid bias or even the
"appearance of impropriety."

"We say they tarnished the integrity of the U.S. Supreme Court," Porter said.

Porter wrote a resolution seeking the removal of justices William Rehnquist,
Antonin Scalia, Clarence Thomas, Sandra Day O'Connor and Anthony Kennedy.

"A lot of people think the Supreme Court is all powerful. Well, they are if
they're handing down decisions. But not if they're violating the
Constitution," he said.

Porter found some support over the weekend within the state Democratic Party.

The chairman of the party's Executive Committee, Jim Edmunson, agreed
Saturday to sponsor the proposal for a vote at the party's central committee
meeting on July 22. If it passes, the state party could recommend other
states pass similar resolutions.

"The idea is to draw attention to the problem," Edmunson said. "We're
treating this as something with legal merit. Whether it's politically
feasible is another question."

Congress, which must initiate the articles of impeachment, is now controlled
by a majority of Republicans.

More than 600 law professors around the country have signed a petition
decrying the Supreme Court decision, and some have asked the Senate to
refrain from ratifying any appointments to the court while President Bush is
in office.

About 14 law professors in Oregon have signed on, according to Steve Bender,
a law professor at University of Oregon.

Porter served two terms in Congress beginning in 1957. He later used his
practice in Eugene to litigate over a 30-year period for the removal of a
cross from public land in the city.

Burton's Statements About Criminal Referrals Not Likely To Come
to Pass Under Even a Bush Administration, Since Family Has Shown
No Desire To Challenge Clintons and Others On Ethics and Legal
Issues

(Washington, DC) If only it were true that once this Clinton-Gore
Administration is over, the Republican Congress -- assuming it
wins reelection, and that is a big "if " in the House of
Representatives -- would make criminal referrals in the Chinagate
scandal to new leadership at the U.S. Department of Justice.
Indeed, Judicial Watch, which sparked the scandal with its case
against the Clinton-Gore Commerce Department and the testimony of
John Huang in October, 1996, has a vested interest, on behalf of
the American people, in seeing to it that justice is done.
Unfortunately, the statements of Chairman Dan Burton of the House
Government Reform Committee on yesterday's morning talk shows
were likely just more political posturing during an election
season. This is true for a number of reasons.

First, assuming George W. Bush wins the Presidency, a great
assumption given the toss-up nature of the race, his history,
both in this race and as Governor of Texas, has been to show
little to no interest in pursuing government ethics and
corruption issues through legal proceedings. Indeed, his stump
speech is limited in this regard to putting his hand on the Bible
and only promising that he won't do what Clinton did. If Mr. Bush
lives by the scripture, his promise is unnecessary.

Second, the Bush family has never shown an inclination in "going
for the jugular," as perhaps they view themselves as part of the
Establishment. Indeed, it was George Bush, Sr. who, over the last
several years, has written letters in support of President
Clinton -- most recently urging that his Secret Service detail
not be interrogated over the Lewinsky scandal. Jeb Bush, who is
Governor of Florida, could have his Attorney General investigate
the illegal Clinton-Gore Chinagate money laundering which took
place among Democrat fundraisers in South Florida, but he has
never, and will never, do so. Indeed, both Bush brothers have
been virtually silent on the illegal raid of the Miami relatives
‘and neighbors' quarter of Little Havana. The Bush family is
trained to not create controversy, as this could rock the apple
cart and cause counter- investigations of their alleged
picadillos.

The Republicans have the power to take action now, rather than
promising false criminal referrals in the future. They compose
the majority in Congress, and they have always had the power to
commence impeachment proceedings against Reno and her deputies
for their obvious obstruction of justice. That the Republicans
choose not to do so, and would rather make empty future promises,
speaks to their electioneering and pandering to conservatives,
libertarians, and others who are upset by their continuing
impotence. "Actions speak louder than words, particularly after
four years of doing virtually nothing but holding hearings for
public consumption during election periods. Until the American
people see impeachment proceedings for Janet Reno and her aides,
the Republicans should simply stop making false promises intended
only to deceive their supporters," stated Judicial Watch Chairman

holding hearings on Thursday (10/28) to discuss H.R. 2655, the
Separation of Powers Restoration Act, sponsored by Rep. Ron Paul
(R-TX).  The House Rules committee already held an original jurisdiction
hearing Wednesday morning discussing the impact of Clinton=92s executive
orders on the legislative process

probably the most serious and ongoing scandals of the Clinton White
House.  Many crimes that have been uncovered are well-documented by
several authors and independent investigators, but some are not
well-known by the American public.

For example, in 1995 and 1996 at the invitation of Bill Clinton, Ng
Lapseng, an Asian gangster who runs brothels in Macau, visited the White
House 12 times and dished out over $300,000 in cash to help Clinton=92s
re-election.  Thai mobster Ted Sioeng, who kidnaps Asian women for Mr.
Lapseng=92s brothels, has also funneled illegal cash to Clinton.  Arms
dealers Li Ka-Shing, Henry Fok and Wang Jun (members of Asian organized
crime,=93the Triad=94), and heroin dealer Robert Kwok, all have had =93busin=

ties to the White House via the late Commerce Secretary Ron Brown and by

What this has achieved is that it now allows all those rightwing loonies to follow
Clinton around the country, screaming "Impeach the Rapist." Something a year of
Monica Lewinsky failed to achieve.

They can take your car if you appear to be Driving Under the Influence. You may be
proven innocent--but that won't get you your car back.

You can be accused of raping someone two decades ago. You may be proven
innocent--but that won't get you your reputation back.

That's the kind of country we've become. I'm writing for them to get Clinton for the
murder of Jon Benet Ramsey.

Interesting, isn't it, that not one member of Congress has come forward to
call for the impeachment of William Jefferson Clinton for moral turpitude
in light of the accusations of Juanita Broaddrick?

So, let the chorus begin here: It's way past time to throw this bum out of
office. He's a disgrace to his office. He's a detriment to his country. And
he's an embarrassment to the human race.

I believe Juanita. And, I would dare say, 95 percent of Americans in their
heart of hearts do as well. There's just no reason not to find her
credible. In a he-said-she-said contest, Clinton's got to lose. He's played
all his cards. He's denied the undeniable one-too-many times.

It's time to recall the arguments against impeachment and conviction the
last time around.

"It's about consensual sex," we heard over and over again ad nauseum. Well,
folks, this isn't. This is about force, about coercion, about violence,
about rape.

"It doesn't rise to the level of a high crime or misdemeanor," we heard
repeated on every talking head show night after night, week after week.
Well, how about rape? Does that rise to the level of a high crime or
misdemeanor, Barney Frank?

It's time to put on trial those clowns who stood by their man despite
overwhelming evidence of perjury and obstruction of justice. What are they
going to say about Juanita Broaddrick? That the statute of limitations has
run out? What's a little rape between friends? I'd love to hear the
rationalizations this time.

But, of course, there's no sign we will ever hear any explanations from
Clinton's chorus in Congress or from the commander-in-cheat himself.
There's only one thing that can force them to defend the indefensible -- a
spontaneous uprising by the American people. They've got to say it loud and
say it clear: We've had enough. It's time for abuser-in-chief to go.

I don't care about "political realities." I don't care that it may be
impossible to get 67 votes in the Senate if this guy murdered a saint on
live television. I don't care that another impeachment case would be a
distraction.

Let me tell you about realpolitick. The Congress of the United States and
the court of public opinion are the only avenues left for justice -- for
Juanita Broaddrick and for the rest of America.

America cannot tolerate a rapist in the White House. And Bill Clinton is
not denying Juanita Broaddrick's charges. He won't even acknowledge them.
He sends his lawyers out to make parsed denials. He's betting that
Americans have so lost their moral bearings that they won't demand
accountability.

If feminists and the religious right can't get together on this one, they
will never agree on anything again. If this doesn't bridge the gender gap,
it's unbridgeable. If Clinton gets away with this one, add another felony
to the list of offenses -- perjury, abuse of power and now rape -- that
have been effectively decriminalized by Clinton's blind partisan
supporters.

There is no middle ground on this one. If you believe Juanita Broaddrick,
then you have to act to remove Clinton. Rape cannot be tolerated. We cannot
be apathetic about sexual predators in high office.

On the other hand, for those true believers who continue to stand by their
man, why are you not demanding that Clinton explain himself, tell where he
was at the time of the alleged attack, present his alibis, clear the air?

When was the last time you heard of a man accused of rape issuing a "no
comment"? Put yourself in that position: If you were unjustly accused of
such a heinous crime, how would you react? Would you casually dismiss
questions when the entire country is talking about it? Does that sound
logical?

Remember how Clinton reacted so angrily and publicly about the far less
serious charge of adultery with Monica Lewinsky.

"I did not have sexual relations with that woman, Miss Lewinsky," he
exhorted emphatically. Of course, it was a lie. But he behaved in a
reasonable way for a man pretending to be falsely accused. Let's at least
demand to see another show, another lie. We deserve that much.

Or maybe we don't. Maybe America is getting just what it deserves in Bill
Clinton. Maybe he's our curse, our judgment, for not being able to
determine the difference between right and wrong.
