Goa villagers go to court against DLF, builder says all above board Indian Express - Jan 23rd Over the last month, Vera Varghese, 65, has had brushes with a leopard and a python close to her hillside home in Goa’s Alto Dabolim village. She says she has never had such experiences before in the 10 years that she has lived here, and she doesn’t think it is coincidental. Varghese and many others in the village blame the frequent leopard sightings in recent months on a massive real estate project promoted by DLF Ltd. “This project is stripping what was once dense jungle. We have been asking the wildlife warden to set up traps for leopards seen in the village over the last two months,” Varghese said. Protests by villagers have prompted local authorities to ask DLF to stop hill-cutting operations until an inspection is completed. Local people, along with the environmental action group Goa Foundation, have challenged the project before the Goa Bench of the Bombay High Court. They have accused DLF of illegally cutting the hill, and have alleged that land-conversion norms were violated to grant crucial permissions for the project. The first hearing of the petition took place this month. DLF says its project — River Valley Project on a hill slope overlooking the Zuari river — is completely legal, and due care is being taken to ensure there is no damage to the local environment. Ravi Rajan, the company’s Vice-President (Operations), said any slope would require a certain amount of cutting in order to construct on it, but “this would be offset by building retaining walls which will make the hill stronger”. DLF’s Web site says the project is “fully approved”, “with all permissions and licenses obtained”. Land acquisition fuelling Goa’s real estate boom has been controversial, but this project is the first example of a major project by a national builder running into trouble. The project, aimed at non-local buyers looking for a second home in Goa, is coming up on a 7.7 hectare plot less than 2 km from the international airport. It promises 580 sprawling holiday apartments priced between Rs 21 lakh and Rs 51 lakh, in a community equipped with clubs, gyms, restaurants, swimming pools and a shuttle service to the beach. A Forest Department report says the hill on which the project is coming up has an average slope of 30 degrees. Under Town and Country Planning (TCP) norms, a hill that slopes steeper than 14 degrees cannot be cut, because it may lead to soil erosion and an imbalance in the water table. “We have recently given verbal instructions to the developer to halt the hill-cutting until our committee carries out a physical site inspection to verify the slope,” Chief Town Planner Ahmad Morad told The Indian Express. Suspension of Loutolim Sarpanch demanded HERALD REPORTER MARGAO, JAN 22 A member of the Loutolim Village Level Committee, Franky Monteiro has demanded the immediate suspension of the village Sarpanch by the authorities and seizure of panchayat records by the police pending further investigations on the fake RP 2021 submitted to the Town and Country Planning Department. Monteiro further demanded stringent action against the village panchayat secretary for being a mute spectator and being a party to the illegalities. In a statement, Monteiro said the villagers and members of the Village Level Committee and amused and disturbed with the varied statements of the Sarpanch and secretary and are now looking forward to further action being initiated by the police in the matter, adding the people will then know who are the actual people behind this regional plan scam and their motives. From corrupt, greedy and dodgy Panchayat members from Carmona to Chicalim to Cansaulim, to the Town and Country Planning Department which is on a merry course to approve these mega-projects and construction projects, to of course the biggest goons, thugs and thieves that masquerade as our Goan Politicians and MLAS, while selling Goans and our Goan Villages to further their vested interests and that of their patrons namely the Builders there seems to be no end in sight. While everyone gets their share of the loot - from the corrupt Panchayat and TCP to of course our MLAS, the builders are breaking all rules and destroying our Goan villages overnight, causing irreparable and irrevrsible damage to the Goan landscape, destroying our Goan villages and the environment and changing the social demographics of our Goan villages. Interestingly when the Panchayat is questioned they try and intimidate 80 plus year old villagers and their own villagers using the muscle power and harrassment tactics. The Panchayat then glibly uses the excuse that it is the Town and Country Planning Department that has approved these projects conveniently washing their hands off. There is an urgent need for more Goans to stand up and fight this evil nexus and expose them for what they are. Don't we Goans have a duty and obligation to protect our Goan villages before it's too late? Big builders mould pliant panchayats - This article below is from the Herald's Editorial January 15th. The Rahejas, even though now divided into groups, are still among Mumbai’s biggest builders. Along with political clout,they have formidable money power. Little wonder that the Carmona Panchayat has fallen over itself in its desperate hurry to give the builders permission to sub-divide the land they own in the village – which they originally bought to set up hundreds of apartments – into what they say is going to be bungalow plots. That the panchayat issued its NOC just days after the Town and Country Planning (TCP) Department issued a provisional NOC to the real estate developer, shows just how eager the Panchas are to please the builders. This great fondness for the Rahejas is nothing new. Even earlier, when the builders wanted to put up hundreds of apartments and completely alter the demographics of the village, the panchayat was completely in step with them. It was the people of the village that opposed the project. Many villagers opposing the project even started getting notices from the panchayat about their own ‘illegal constructions’! But it is perhaps unfair to tar the entire panchayat with the same brush. For, the meeting that gave the approval to the Rahejas was attended by six members, chaired by Sarpanch Estaquio D’Costa. Panch Orlando da Silva, who has been opposing the Raheja project for a very long time, was conspicuous by his absence. He sought leave of absence and put up a note strongly opposing the project on grounds that it is against the wishes of the people. But what is at stake here is not just the wishes of the people. The point is not even that the project may not turn out to be what it purports; so-called ‘bungalow plots’ can quickly be converted into ‘multi-storeyed building plots’. The point is that the project is under a cloud. The panchayat has approved it when an inquiry instituted by the Deputy Director of Panchayat is still pending. Most important, how can such a huge project come up on a road that has a width of just over 3 metres, where two vehicle;es would find it difficult to pass each other side by side? However, Sarpanch D’Costa appears to have measured this road as a five-metre road, which means the panchayat has added the berms to the width of the road, and then stretched it a bit more. He says that while granting the approval, the Panchayat has ensured that the “existing five-metre road” will remain “as it is”, and not a single compound wall or structure will be demolished. The plan drawn up by the Rahejas shows the approach road as 10 metres! A large housing project of this type needs a wide road. At very least it must be six metres wide, so that two vehicles can operate side by side. However, says the Sarpanch, the panchayat has in the past approved plans for private bungalows even where the road is less than five metres wide. This may be true, but how many of those were individual houses and how many were large complexes like this one? Shouldn’t the two have different requirements? The TCP’s provisional NOC, granted last week, says the panchayat should look into “other requirements”. Obviously, the panghayat has overlooked this little stipulation in its tearing hurry

Mega projects getting back door entry: GBA HERALD REPORTER PANJIM, JAN 7 The Goa Bachao Abhiyan (GBA) and Save our Slopes (SOS) have asked the government to stop permissions being granted to bring mega projects through the back door, warning that an agitation would have to be launched to fight the land sharks and the political system. GBA convenor Dr Sabina Martins told a press conference here that the GBA has received information that several projects are obtaining permissions for constructions by misrepresenting facts. Where a six metre road is necessary at the time of approval, the Town and Country Planning has given no objection certificates (NOCs) for projects where only three to four metre wide roads exist, she said. The authorities have granted NOCs willfully after knowing the illegalities, GBA said pointing out that illegal projects have been slated to come up at Cansaulim and Carmona. The GBA has strongly condemned the fraudulent manner in which projects are illegally permitted and has demanded that the government permit construction as per the recommendations of the Gram Sabha, village planning committees/panchayats where such recommendations involved greater restrictions on constructions and development than those envisaged in the Draft RP 2021. This must be strictly followed till such time as the final RP 2021 is notified, the organization said. GBA has also reiterated that the government immediately announce a time limit on amendment to the relevant laws to ensure conformity to the 73rd and 74th Amendment of the Constitution. The eco sensitive areas defined in the Draft Regional Plan, GBA said, should be applicable to all areas, as was agreed by the Task Force on RP 2021 headed by the chief minister who is also the TCP minister. For this, ODP (Outline Development Plan) areas should be part of the Regional Plan, it demanded Martins said no permission for construction in ecosensitive zones should be given irrespective of the status in the Outline Development Plans. No permissions should also be granted even to projects under 16/16A, GBA said. GBA also reiterated its opposition to Section 16/ 16A where projects are allowed without public scrutiny. Martins and SOS leader Audhut Naik said that there is a continuous attempt to destroy the open spaces and public gardens in the name of development. GBA supports the initiative taken by the citizens of Ponda to protect the green lung of the town, Martins said demanding that all gardens and public spaces in Goa be maintained by the government. The villagers have come out strongly against the move and have expressed their resolve to take on the authorities over the issue. The provisional NOC in question was issued on December 22, 2009, by the TCP, even as the director of panchayat, vide letter dated December 12, 2009, directed the block development officer (BDO) to conduct an inquiry into the various irregularities pointed out by the villagers. “This is unacceptable. We will challenge the NOC in the high court,” Orlando de Souza, a panchayat member leading the agitation against mega projects in the village, told TOI. It may be recalled that Raheja builders had applied for the subdivision of their 88,000 sq m plot into smaller ones to the Carmona panchayat, which, in turn, had forwarded the application to the TCP for approval. The issue generated considerable heat in the last gram sabha with villagers demanding that the panchayat “recall” the file from the TCP on grounds of “grave misrepresentation of facts”. Villagers had alleged that the Rahejas had shown an access road of 10m width in the submission drawings, while it was the contention of the villagers that the width of the existing roads was less than 3.5 m and therefore, the plan should not be approved by the authorities. The villagers had demanded that a joint site inspection by the TCP and the panchayat be conducted to verify the actual width of the access road shown in the plan.

All the roads would be leading to the Chapel of Our Lady of Remedios on the Mount in Cuelim. The Mount of Cuelim and the beautiful chapel is dedicated to Remedios Saibinnim (Our Lady of Remedies) and the spectacular view that you get of Goa on all sides with the Sea and the greenery is something to be treasured and one of the most beautiful spots in Goa. Unfortunately once you are on top you also see the destruction of Goa that continues unabated on all sides - the never ending industrial estates in Verna meandering all the way to Loutolim, Zuari Agro Chemicals belonging to Birlas and the slums that have mushroomed and proliferated all around, Meta-Strips and other such monstrosities belching out pollutants and damaging our environment, hotels, mega-projects and gated communities that the builders seek to push through by breaking every rule in the book wiping off our Goan neighbourhoods and causing the destruction of our beautiful Goan villages and our Goan way of life that our parents, grand-parents and ancestors so loving nurtured and cultivated for countless generations. As you mentioned in your posting yesterday this year the King from Cansaulim would be the son of the MLA Mauvin Goudinho who is a grand-son of the village. I’m sure there will a whole lot of his partners in crime - our so-called Goan MLAs and their coteries making a bee-line to Cansaulim and the Cuelim mount. There beaming and with their mouths watering like a pack of greedy wolves and hyenas will be these corrupt politicians and their chamchas and greedy, corrupt band of thieves, thugs cohorts in the Panchayats, Town and Country Planning Department and other Government posts who have destroyed so much of Goa in such a short time. What a shame that the greed of a bunch of corrupt and vile politicians and their chamchas in just one generation have sought to sell and destroy Goa and Goans down to our ruin and destruction, that was so lovingly created and preserved for centuries. Hopefully the trek up the Mount of Remedios Saibinnim (Our Lady of Remedies) in Cuelim will touch the hearts of all true Goans who will stand up to preserve and protect Goa and our environment and put a stop to the greed of certain people who are all set to destroy instead of preserving and protecting our beautiful Goa. Is there no Ombudsman or an Independent Committee against Corruption to question and investigate these blatant misuse of powers and expose the gross injustice and corryuption that is destroying our Goan villages? Can the Right to Information Act be used to call upon our Ministers and other officials in Government positions to declare the assets and income that they are amassing and the source of their ill-gotten revenue? ** *Anxious Moments at Loutolim over fake RP submission* *Signature was forged, says sarpanch * MARGAO, JAN 3 The Loutolim gram sabha meeting witnessed some anxious moments after members drew attention of the chair that a fake Regional Plan was submitted to the Town and Country Planning office which had no approval from the Panchayat body. What added to the confusion and mystery was the fact that the Sarpanch Jose C Fernandes publicly admitted that his signature on the application made to the TCP office has been forged. In this connection, the gram sabha members demanded that the Panchayat body register a FIR with the police, and the Sarpanch replied that he would initiate legal action after he seeks all details on the plan from the TCP office. The question regarding the fake RP plan submitted to the TCP was raised by Blaze Britto, who sought to know whether the Panchayat had submitted the plan in question, which is totally in contrary with the plan approved by the village level Committee. Suspecting the hand of the shipyard and dockyard lobby behind effecting changes to the RP, gram sabha member Franky Monteiro said the villagers would lodge an FIR even if the panchayat goes slow on the demands of the people. He said the fake plan submitted in the TCP office has proposals which would benefit the shipyard and dockyard lobbies as agricultural zones have been changed in the plan to benefit these lobbies. Meanwhile, the gram sabha meeting demanded to know from the Sarpanch the status of collection of trade taxes from all industrial units in Loutolim jurisdiction of Verna Industrial Estate following the decision of last gram sabha meeting. The Sarpanch assured that he would seek sketch plans from the industrial units before initiating any action. The members also demanded to know the steps taken for de-notification of Verna Industrial Estate being declared notified area to bring back the jurisdiction and control to village panchayats following the decision of the last gram sabha meeting.

When I was the convenor of the Goa Bachao Abhiyan (GBA), a Congress-NCP government was put in place by the voters of Goa and not by us. We had three options before us with regard to RP2021. The first option was to get onto the Task Force when invited, and ensure that the GBA agenda with regard to the environment and sensible planning was incorporated into RP2021, along with our fellow members Edgar, Charles, Dean, Raul, Datta and Blaise. That we succeeded in doing this was an important mission for us. Its implementation on the ground remains the responsibility of the Government of Goa and Chief Minister Digambar Kamat, who has since reneged on his promises and failed to fulfill them. The second option was to either join the opposition parties to oppose this corrupt and venal government – which was impossible, considering the GBA statute dictated that we could not go political. The third option was to get onto the Internet from the comfortable climes of our homes, create a hate campaign against Muslims, outsiders, and foreigners in Goa, and even bay for their blood (incidentally, an act against the very Constitution we quote so often and swear to defend). The third option was preferred by Rajan and Soter. We took the first option and, perhaps, got cheated in the bargain in spite of trying our best. This is only to set the record straight. Bab Clinton, Thanks for doing a great job for the wild animals this Christmas. Obviously your attempts last Christmas did pay off and none of our Goan villages have put any animals in their crib displays this Christmas. So keep up the good work. Alas the only wild life we see nowadays in Goa are these very displays like the python that was put on display last year in the crib in Cansaulim. The fact is that leave alone snakes, it is difficult to come across any frogs left in Goa, as the only jungles flourishing here are the concrete jungles that are sprouting and expanding at a rapid pace. Now that you do not have to save any wild animals on display this Christmas, how about then putting up a hotline number for protecting the Goan environment and our flora and fauna so that our wild animals and Goans can live together in peace and harmony as they have always done over the centuries for generations? Now isn't that a difficult one Bab Clinton, as we have some even more dangerous species as you are well aware of - many serpents of the human variety, as well as wolves in sheep's clothing in Goa starting with our corrupt, vile and dangerous politicans and their coterie of hyenas and vultures be it in the TCP, Panchayats, Police, and even your Forest Department; and the so called mining magnates, developers and builders who are ready to destroy our Goan villages, forests, hills, coastal areas, lakes, ponds, fields, khazan lands, orchard lands, wells - all for the sole purpose of quenching their insatiable greed. As usual the wonderful pictures of these cribs in Cansaulim that you've posted, built lovingly by the villagers keeping in mind the local beauty that Cansaulim, Arossim and Cuelim offers is something that we have grown to enjoy during the Christmas season. We wait for the pictures that you've promised from Velcao and the adjoining villages. With plans by a local builder in the neighbourhood who has close ties to the MLA from the Constituency, soon you will see gated communities with palaces and swimming pools built for the Chopras and other money bags throughout Cansaulim, Arrossim and Cuelim. There are plans to come up with such projects not only in the orchards where these cribs have been consructed and the fields but even on the hill slopes. Soon we will be waiting for the pictures that you Joebab have to offer on the Feast of the Three Kings which is celebrated by all at the Our Lady of Remedios Chapel, on the picturesque mount in Cuelim on the 6th of January. Since you are in the vicinity can you please do a quick visit to the Cuelim Mount. Apparently the villagers of Cansaulim who are attending the Novena masses at the Our Lady of Remedios chapel Cuelim were shocked at the rampant destruction of the hill using heavy machinery without any hill cutting permission being obtained. If you could capture the damage that has been done in this regard all Goans would be shocked to see how the political clout and machinery is being used to damage and destroy this sylvan and verdant mount. Also forward a picture to the Save our Slopes group so that they can step in and stop the damage. You know this area well and will understand the damage that is being done. Soon these very forces with stake their claims to construct even on the Mount! All this is being done under the excuse of development and beautification - this is not only wrong and immoral but damaging to the ecology of one of the most beautiful spots in Goa. [Goanet] Mega projects
Freddy and Carmen and others who have been high-lighting the harmful effects of the anti-Goan Mega-Projects, Mining, SEZs that are being sought to be forced on Goans all raise very valid points and have the interest of Goa at heart. Carmen mentions about the recent agitation where the SC and ST groups rallied together to voice their opinions - what a great show of solidarity and courage. While the fact of the matter is that a large part of our Goan population may not be internet savvy or be able to write to the newspapers to question what the Government, politicians with their nexus of Builders-TCP and Panchayat stooges have that should not stop us from having our voices heard. We've seen how all Goans rallied together to oppose the Regional Plan. The work is not over. All of us who want to do something for our beloved Goa should not give up hope but stand up and have our voices heard.. We have to join together to fight for Goa. Our struggle for Goa is because we as Goans are the ones who should be deciding what we want for ourselves, our villages and for Goa. There are many organizations whether it’s Xhetkarancho Ekvott, Save our Slopes, GBA, or Sebastian Rodrigues’ GAKUVED and MAAND that are giving a voice to Goans. [Goanet] Mega project in Cansaulim
The elected panchs of Cansaulim have given the go ahead to the Builders to proceed with their mega project ( ground + 4 with swimming pools and the works for a gated community ) near the Cosme Damiao chapel and behind the Cansaulim Sports ground. It seems that a Mr. Diniz from the Town Country Planning department fraudulently approved and sent the plans back to the Village Panchayat for their approval. This despite the fact that the villagers had raised at least 10 technical flaws in the plans and explained why the plans should not be approved. They had requested that the NOC not be awarded because of numerous reasons including fradulent representation of the facts in the submitted plans. One of the ruling party members who had earlier stated that she would not defect, crossed the floor and supported the Opposition's resolution despite the Sarpanch declaring that there was no sanad in the file for converting the orchard land into a settlement zone. The VP has now allowed the builder to produce the sanad before commencing the work. Our villages are being destroyed because of the vested interests of some members of the Village panchayat, builders and politicians who are busy lining their pockets at the expense of the villagers.This is the story of all our villages thanks to our corrupt politicians and their supporters in the Town Country Planning Department and the Vilage Panchayats. We need to rally by the citizens who are resisting these projects and give them our support so that Goa's villages are not destroyed because of the greed of a few. The Council for Social Justice and Peace and the Xettkarancho Ekvott is asking the villagers of Cansaulim as well as other Goans to step in and support them in resisting these anti-Goa projects. Write in to suggest your support and ideas in opposing these mega projects - we need the support of Goans everywhere to make their voices heard and help lobby to stop what is happening to Goa.
