Which law did he cite? S1648? The Murkowski bill was not passed, but

That isn't affected; S877 only overrides state laws that are specific
to e-mail. The problem is that unless you are a large provider a law
suit for theft by conversion, theft of service or trespass to chattel
will cost you more than the damages you recover.

This was supposed to be a private reply to Rick. I know there are people on
this list with some employment challenges, and please don't think this was
smart-ass comment meant to offend anyone. It was a sincere response.

My comment was genuine and I'm looking forward to enjoying life in Northern

Too late.   They already accomplished what they wanted to - even if

It *was* a wacko bill that has become wacko law. Affectionately known as
the U Can Spam Act, which gutted anti-spam laws of the various states
(of the USofA).

Off to the ophthalmologists for rest of morning, but it's just 'spam to  
harvest'. If they were legit, they'd subscribe and post 'til their hearts  
content. Good stuff, bad stuff, retroreflactulance...They bad news is these  
lists 
are traded like bubble gum cards for profit and more spamListserv has  some 
smarts in this respect but until the filters and spam blockers kick in it's  
just duck and run

This list, to me, is a source of problem/idea interaction, not a means
to plug one's business or drum up new clients (with some exceptions for
certain list members that contribute much more than they advertise).

I would suspect they got the addresses from the membership list.
I do not have the luxury of attending these outside meetings so the only
thing I really have in common with the vast majority of everyone else

Partnering with???!! I get *lots* of unsolicited email from IBM for 
product announcements, seminars, webcasts, etc. The ones I find most 
offensive are the product advertisements thinly disguised as white 
papers. Who do they think they're fooling? Or, a better question might 
be, who *are* they fooling?

and it did *not* legalize it.

Which, according to an American lawyer I know, is bogus.
The law was never passed (as of a year ago).

While you and I agree it is SPAM, the U CAN SPAM act was passed into law
-- perhaps it is not the bill our friend has quoted, but never-the-less
it was passed into law. 

After that happened, I quit battling SPAM and just basically deleted it.
The U CAN SPAM act basically says that if you do not commit fraud with
your subject line.opt out directions Then you too can SPAM in
the USofA.

This overroad the various states' anti-spam statutes.

So much for trespass to chattel (or whatever that legal doctine was).

I told them:
I would not contract with any organization that culls email addresses from 
just anywhere. I do add them to my list and warn colleagues of the shameful 
practice of harvesting they employ.

Wavemind replied:
I will honor your request and remove your contact from my list. 

As an FYI, by law this email is not spam.

Under Bills.1618 Title III passed by the 105th U.S. Congress this mail
cannot be considered Spam as long as we include contact information and a
remove link for removal from our mailing list.

I now see not only do you practice harvesting email addresses but have poor 
judgement as well. I never stated it was spam, I said I would tell my 
colleagues that your firm is not one I would do business with because of the 
scummy way you collect and bombard email addresses with what I consider 
[EMAIL PROTECTED] I do not need legislators telling me what [EMAIL PROTECTED] 
is. You sent it.

You guys have way too much time on your hands. If WaveMind's spam 
managed to get past our SpamBlocker, I probably deleted their 
solicitation without a second thought. After reading this thread I'm 
asking myself, Which is more aggravating? Having to delete WaveMind's 
solicitation with a single key stroke? Or wading through 50+ posts on 
IBM-Main complaining about it?

Seeing as I am in Hong Kong, he needs to check the section of this country's
legislation that discusses address harvesting and sending more than 100
emails in 24 hours.

Ron, I tend to share that opinion. Junk mail is still junk, even with 
that unsubscribe crap. That last little tag just verifies that the 
address is good and a valid target for more crap. I always tell folks 
that the unsubscribe tag will cause more spam, not less; just ignore 
it. Here in the US, we're stuck with a know nothing, spend everything 
Congress. If ignorance is bliss, those people should be in seventh heaven!
