No, the proposed law has nothing to do with whether people could claim damages 
or not for breaches of copyright.

But if Satan Inc. stole my pictures and claimed they had looked diligently but 
fruitlessly for the owner, I would have to prove that they hadn't, which would 
be rather difficult. 

But what tends to happen is that neither party wants to enrich the lawyers if 
they can avoid it, so they settle out of court. In a case like this, if I could 
show that I was the rightful owner I suspect that Satan Inc. would pay for the 
use they'd made of the pictures, and I would accept, as I imagine most 
photographers would. Trying to get some sort of punitive damages would be in 
nobody's interest but the lawyers'.

Northern Mockingbird. They are mimics, adept at singing the songs of
other birds, as well as car alarms and such. And unlike most
songbirds, they'll do it all night long.

PESO One that nearly got away

Hi Team,

Following is one of the lost images that I recovered from my memory
card last week. Fortuantely the 200+ images that failed to copy were
not written over even though I had used and formatted (in-camera) the
card twice before I discovered the error.

I carried my K-5 but used the K-01 exclusively - I and came out of the 
woods much less muddy than usual since I did not not have to get down to 
put by eye to finder. Unless I manage to get out tomorrow (unlikely) 
this will be my only wildflower venture for this spring.

C.R.I.S. charged me $230.00 a year ago to replace the motor in my DA* 50-135. 
Time was immaterial as I dropped it off on my two month trip around the west. 
They shipped it to me once I returned. They did not have the camera, it was in 
use.

Yes. It would establish in the UK what is already policy in the US.
But in this image-searchable-Internet age it's more difficult than
ever to prove that something is an orphan work: Removing the metadata
and watermark from one image isn't enough — you'd have to remove it
from every copy of the image everywhere on the web (even the original
photographer's web site).

Yesterday we got 6 inches of very wet snow. In my yard it collapsed the 
roof on my gazebo, uprooted a 40 yr old evergreen and broke a large branch 
which fell on the neighbor's fence. Plus breaking several limbs on other 
trees and my lilac bush. Other than that it was a fine Spring day with a 
high of 39. This AM it is lightly snowing again.


So it is in defiance of winter that I post these Spring photos taken in 
the days before the storm. I used several lenses and a couple of cameras 
here. One or two of the "daffy" pix may have been taken with my OLY - 
purists may avert their eyes. Join me in my efforts to start Spring. DIE 
WINTER DIE!

I carried my K-5 but used the K-01 exclusively - I and came out of the 
woods much less muddy than usual since I did not not have to get down to 
put by eye to finder. Unless I manage to get out tomorrow (unlikely) 
this will be my only wildflower venture for this spring.

nice job putting that together, and you are quite a narcissus collector

i would like to know what varieties 058 and 085 are, though i'm sure i could 
find something in a reference; i have only three varieties myself, 'minnow', 
'jetfire', and a white/yellow variety from before i bought the house in '99


with the contrasty exposures, i like the dark, simple backgrounds best, though 
i think a softer exposure might also benefit the character of daffodils


last year in early April i visited the New York Botanical Garden in the Bronx 
where there were probably over a hundred varieties of narcissus in bloom - 
quite a display, and a good chance to look for desirable varieties

I think I´m too old to have seen all the Sesame street episodes, but we had 
another strange series about two guys repairing things. In one of the the 
episodes the repair men saw a windows behaving strange (jumping up and down), 
and the assistant asked if the window had to be repaired. His boss answered: 
"No, I think it is home alone". Strange how associations work :-)

The part I always seem to forget is that you have to have the aperture
set at one end of the range or the other before attaching/detaching.

Earlier this AM I had the best chance to date at a Red-winged blackbird. Never 
completely pleased, I wish the black feathers had picked up a bit more shine in 
their reflections.
I took three quick frames (AF-C). This was the first with the second and third 
progressively less detailed.
The tiny bit of catch-light in the eye was my good fortune.

I could not afford the heat or taxes. The Smeltzer mansion was owned by 
the sole heir of one of the city's founding fathers and the owner of the 
1st gypsum mine in the area. All of her money was left to a trust to 
maintain the house. It is used for small gatherings. My niece was was 
the 1st to have her wedding & reception in the home. By the way Ann 
Smeltzer loved the bluebells and the caretakers let them go wild & will 
not mow them while in bloom.

So it is in defiance of winter that I post these Spring photos taken in the
days before the storm. I used several lenses and a couple of cameras here.
One or two of the "daffy" pix may have been taken with my OLY - purists may
avert their eyes. Join me in my efforts to start Spring. DIE WINTER DIE!

If the adaptor/lens combo is not mounted and or stuck on a camera, it
should be possible to remove the adaptor from the rear of the lens - but
it may only be possible to do this by destroying the adaptor.

The key is finding where the 'sticking point' is. If you can borrow or
acquire another adaptor, then it should be possible to look at the
mating surface, along with the rear of a different lens and compare
possible surface topography that would indicate where the problem lays,
and what to do about it.

If you're not 'engineer minded' then perhaps get an engineer to have a
look at the above objects - he/she will be able to figure it all out and
yes - it may well be that a carefully placed Dremel cut or cuts could be
the answer.

Surely that's not a serious question? The answer is that you put them
all in a zip file and upload them all at once. I do several thousand
per registration. It's simple, easy and costs 35 bucks.


You do have to separate out the published images from the unpublished ones.

Thanks!  I was making an Amazon order, anyway, so I got the daisy sight
there plus this.  This one seems to get better reviews than the adapter
on B&H, and it's in stock.  Your assistance was much appreciated (I had

They don't have to "settle" with you. Under the law, all they have to do
is stop using your photo ... IF YOU CAN PROVE IT'S YOURS.

They don't have to compensate you. They just have to find a new sucker
to steal from.

quite an enlightening exercise. Who would want a law like this? Somebody
must do, otherwise we wouldn't be getting it, so what do they stand to
gain?

So if, say, an unscrupulous international picture agency simply starting
trawling and downloading photos and making money from them, and you as a
photographer happened to find out about it, what can you do? The burden
of proof is on you to show that they have not undertaken an adequate
search for the copyright holder. Chances are they would just settle with
you for whatever they earned from the pictures, and refrain from using
them again. The only thing that might prevent said megacorp would
possibly be the threat of a class action suit from a large group of
photographers.

copyrighted work with full information imbedded, upload to face book,
download it again and it's laundered. The only protected works are

UPDATE: Unfortunately, photographer’s representative requested to remove 
the pictures. Luckily, you can find them in the archives of New York’s 
Museum of Modern art, Fraenkel Gallery or do a Google search. The Brown 
Sisters by Nicholas Nixon book is also available on Amazon.


I struggled with it for quite a while trying to figure out what malware 
site I was going to have to unblock in NoScript to get it to play before 
noticing the fine print.

Thanks Mark. The flower was taken at a local nursery/greenhouse and I
didn't note the species, but I think it is some kind of Zinnia. (More
knowledgeable flower people, feel free to correct me).

I'm learning that one really needs to apply a bit of strategy to
shooting birds outdoors on sunny days. The best shots are with the sun
coming over your shoulder, fully lighting your subject. Thus, if
taking a birding walk in the woods in the early morning it would be
best to choose a path from East to West and in the late afternoon the
opposite. These Cardinal shots, unfortunately, are side lit and work
OK if the cardinal was facing the sun, but not so well when his head
was in shadow. I dislike fill flash outdoors (think it looks
unnatural) but that would be one obvious solution.

I limit my picture uploads to social media site for this very reason,
there is no excuse for them stripping the author/copyright metadata as
its data usage is miniscule compared with the smallest usable image

Oh yeah, and if you do watch “It Might get Loud”, make sure to queue
up the extras and outtakes, too, that’s where some of the best music

Summary: It probably isn’t that bad for photographers; but
social-media sites should stop stripping Exif, at least the
attribution fields.
