 The Victorian Government is claiming a national
 first with plans to recognise native title through
 mediation rather than via the courts.
 
 The Victorian Attorney-General, Rob Hulls, has
 told the National Native Title Conference in
 Melbourne, the Bracks Government's emphasis
 will be on settlement rather than going through the
 courts. 
 
 He says it is a new approach which puts Victoria
 at the forefront in relation to native title matters. 
 
 "We believe that no one wins from litigation," he
 said.
 
 Mr Hulls says some applications may be resolved
 with a package of benefits including
 apprenticeships and joint ventures.
 
 A draft strategy will be released shortly.
 
 The new approach has been described as
 gratifying and significant by Bryan Keon-Cohen,
 QC, from the Miriambiak Nations, which organised
 the conference.
 
 But he is urging the Victorian Government to also
 consider law reform as part of its native title policy.

 Arabunna Elder, Kevin Buzzacott will be tried for 'failing to
 cease to loiter' tomorrow, Thursday March 16, at the Adelaide
 Magistrates Court.
 
 Time: 9.30am
 
 Where:Adelaide Magistrates Court

   Adelaide, South Australia
 
   Court number  12
 
   The Magistraes Court is situated on the south east
   corner of Victoria Square, next to the Police Station.
 
 
 The court is open to the public.
 
 People will be gathering outside on the sidewalk from 9am.
 
 
 The Story:
 
 Kevin Buzzacott was arrested at Genocide Corner, outside Government
 House, 21 days after setting up camp there and lighting a Ceremonial
 Fire for Peace on Thursday December 16, 1999.
 
 The charge of 'failing to cease to loiter' has been used throughout
 the colonial period of this country to remove and ban Aboriginal People 
 from their own land.
 
 It is also commonly used upon environmental and human rights activists.
 
 This charge is held under the 'Summary Offences Act 1953' of the
Parliament
 of South Australlia and reads:
 
   "order to move or disperse:
 
   18. (1) Where a person is loitering in a public place or a group of
  persons is assembled in a public place and a member of the 
  police force believes or apprehends on reasonable grounds-
 
   (a) that an offence has been, or is about to be, committed by that
person or by one or more of the persons in the group or by another 
in the vicinity; or
 
   (b) that a greach of the peace has occured, is occuring, or is about to 
occur, in the vicinity of that person or group; or
 
   (c) that the movement of pedestrians or vehicular traffic is obstructed,
or is about to be obstructed, by the presence of that person or of 
others in the vicinity; or
 
   (d) that the safety of a person in the vicinity is in danger,
 
 the member of the police force may request that person to stop loitering,
or request
 the persons in that group to disperse, as the case may require.
 
   (2) A person of whom a request is made under section (1) must leave the 
place and the area in the vicinity of the place in which he or she
was
loitering or assembled in the group.
 
 Penalty:  Division 8 fine:$1000 maximum plus $150 expiation fee
   or division 8 imprisonment: 3 months maximum.
 
 
 Kevin Buzzacott has also been on strict Bail Conditions since his arrest:

 Adelaide City Council has rejected an appeal by
 one of its own members to allow an aboriginal
 protest outside Government House to continue.
 
 A lawyer representing the group says he will
 test the council's vote in court, claiming one
 member had a conflict of interest ...
 
 A group of aborigines set up camp a week ago
 on North terrace to protest against uranium
 mining in the State's north.
 
 Council met last night amid concerns that they
 were breaking the law.
 
 When a motion by Michael Harbison that they
 should be able to stay was lost by one vote,
 their lawyer, Len Linden, challenged Councillor
 Richard Hayward from the public gallery.
 
 "I think you should disclose you have shares in
 Western Mining."
 
 "I think your vote is invalid and should be
 disqualified."
 
 "I think the council should rescind the motion
 until you declare your interest in Western
 Mining."
 
 Councillor Hayward admits he's a shareholder,
 but maintains that was irrelevant to this debate.
 
 Earlier, the Lord Mayor, Jane Lomax Smith had
 disqualifed herself on a potential conflict of
 interest involving her partner.
 
 And Councillor Harbison was left disappointed
 that council could not be more accomodating.
 
 "I think we just have to face facts that there are
 many different faces to society."
 
 "Especially at Christmas time, I think we should

 Thursday December 16th marks the AGM of the Westpac Banking Corporation
 (WBC),
 to be held at Darling Harbour, Sydney.  This presents a fine opportunity

 Westpac customers all over Australia to join in the fray and protest the
 
 banks'
 massive and central  involvement in the doomed Jabiluka project.
 
 Consequently, we are requesting that the Brisbane branch  of
 Westpac categorically deny, in writing,  that it is going to support an
 advance
 of any further cash by WBC to the Jabiluka project - specifically, about
 
 $200million.  If you think this is far-fetched, then remember that this
 bank
 has an environmental policy which is supposed to exceed community
 expectations
 and live up to a special UN declaration for banks.  And that the
 Jabiluka-sited
 uranium mining and uranium-processing project has been roundly labelled
 as
 not
 the most environmentally ideal - even by the mining company !
 
 For Brisbaners, be at Westpac at Post Office Square, Queens St, at 12.30
 for
 about 30-45 minutes.  Let us know if you would like to participate in a
 symbolic
 or actual 'account closing' action - we are aiming for at least 20
 people
 participating in this.
 
 It does not matter if the account is only a little one, and you think it
 
 wont
 affect the bank's decision...it will.  That's because the mining
 company's
 own
 shareholders have proved hesitant about the value of the Jabiluka mine,
 by having abstained in droves from casting a vote on the North Ltd
 Boards'
 rejection of an independant review into the project, among other things.
 
 The
 WBC should be encouraged to be conservative and heed this plain warning
 of
 unwise and unethical financial risk.

 White Australia wants a Republic.  White Australia is aiming to vote away
 the legal fiction which is the Sovereignty of the British Crown.  They
will
 replace it with another legal fiction the Sovereignty of the Australian
 Republic.  
 
 From 1788 the first settlers and representatives of the British monarchy
 stole our land and waged war on us.   They were merely trespassers.  No
 reparations, no compensation, no agreement has ever been made to legalise
 the situation. Their claim to ownership by means of the power created by
 the British Crown to own what it chooses is a legal fiction, acknowledged
 only by the  White Australian domestic Courts.  When the High Court of
 Australia gives a judgment upon Aboriginal Ownership the Court must first
 endorse its own status; that is
 its power to pass judgment at all.  In affirming that status the court
has
 to depend on the original Australian fiction; "the British Crown gave us
 ownership and power."  As long as this state of affairs exists,
Aboriginal
 People will continue to be robbed, cheated and left landless.  Whether
the
 Head of State is a Queen or a President, British or Australian.  Worse,
it
 will tell the lie that the issue of Aboriginal Sovereignty has been
 resolved.
 
 For over 200 years the first lie of the Crown's ownership of the
Australian
 Continent left Aboriginal People cheated, robbed and landless and the
 object of systematic attempted genocide and ethnocide. Aboriginal People
 will continue to be left out of the picture, marginalised and even once
 again invisible.  The transfer of a known illegal title to another party
 doesn't make that title legal.  It compounds the crime of theft. The true
 legal position for Aboriginal People on the Australian Continent is
defined
 by the principles of the Western  Sahara case decided by the
International
 Court of Justice and also defined in International Instruments. If we,
the
 Aboriginal People could get our case to the International Court we could
 expect Justice and a complete change in both our  spiritual and material
 positions.
 
 The Australian government thus far, but not forever has prevented our
 access to the International Court. We will attack White Australia in all
 the International, even domestic Courts available to us.  Let us approach
 every International Tribunal possible, showing that White Australia is
 cynically demonstrating its true position; that it can without any
pretense
 of legal fiction simply take our land. 
 
 The Aboriginal Tent Embassy says we will win.

 REPUBLIC  NO  and in 1901.  Will we be

for an organisation called Lulul Mawidha, a media organisation, obviously
it's been translated and she ask's for it to be redistributed.  The law
will mean that the ninth region, where Temuco is, will be the only region
where this law will be applied, Temuco and it's surrounding towns and
communities (the ninth region) is predominantly Mapuche settled.  

The authorities will literally get away with murder..

 Just a week away from the presidential call in La Moneda to "a great
civilian
 treaty" to resolve the Mapuche problem, the Mayor of the 9th Region,
Oscar
 Eltit, required last Wednesday 11th of August, to the Appealing Court of
 Temuco, that the State Security Law be applied to all those responsible
for
 the fires that occured in the region which affected the Forestry
Corporation
 of Mininco in Collipulli and Ercilla.

antidemocratic
 sentiments of the government, but also the intention of the government to
 give a delictual character to the organizations and activities developed
by
 the Mapuche communities, in order to divide the society about the Mapuche
 problem.

how you learn is not simply reliant on how good we are as your teachers. 
how you learn is also dependent on you ability to undress yourself of
non-aboriginal and understand you have an obligation here also.  you cant
just sit back and take knowledge as student, nungas have never had that
luxury. we learn about our stuff from the belly of genocide. most dont
survive to live.
we can be a guide or a marker in that we have still our place of nunga
ness, you need to find that place yourself, because it is the whole planet
we are talking about it is all connected, so you might be 6th generation
here but you are in your place aboriginal somewhere else, and you need to
access it best way you can just like we do we survive genocide to live as
nungas best way we can most dont make it.

 Its quite possible that there are a lot of white folks here on this news
 group as well, who feel it is inappropriatte to repond and wait for you

 people like you to respond Irene.  We know that we have difficulty
 communicating with first people and we have for over 200 years which is
why
 the situation is now how it is.  So those of us here who may be white may
be
 sitting on the side reading listening learning and watching interactions.
 Our ability to learn how it is for you as aboriginals and first people
 depends on how you teach us.  Im here as a learner about first peoples
and
 accept I can never be an aboriginal, I am 6th generation australian and
feel
 I belong to this land as well as you I also accept that you are the
 traditional owners of this land and apologise on behalf of my ancestors
who
 may have been part of the invasion of this land.  I am Australian 2nd
 peoples immigrant to this country in its 6th generation.  I respect my
 country that I know live in and only know.  I know no other culture than
the
 one I have, which is a mix of my English and Irish cultures.  I am an
 Australian Immigrant.  I accept that first people must respond angrily to
 white folks as well for what the ancestors have done to aboriginal
people,
 because of their hurt and pain.  I grew up in the bush spent my life in
 rural outback queensland lived on properties and worked in sheep and
cattle
 as a ringer and stationhand.  Went to Grade 10 only.  I saw and
experienced
 and was involved in many things including fights and shooting roos and
pig
 hunting and mixed with people of all colours in the outback.  I have
worked
 with many aborigianl people in the bush.  I write poems about rural
 queensland. I have experienced sites of where aboriginals were massacred
in
 the early part of this century, I have seen sites where aboriginal people
 have walked and lived and died.  I still do not feel I have the ability
to
 know what you and the first Australian people are feeling.
 
 Perhaps Irene you could tell us of your experinces and help us to
understand
 a bit about  what brings you to be advocating for your people and the
pain
 they have experinced at the hand of white people.
 
 I would love to see if people on here can give some stories about their
 experiences and what brings them to see the plight of our first nation
 people are very real and what we white people on here may learn from
that.
