The Victorian Attorney-General, Rob Hulls, has told the National Native Title Conference in Melbourne, the Bracks Government's emphasis will be on settlement rather than going through the courts. He says it is a new approach which puts Victoria at the forefront in relation to native title matters. "We believe that no one wins from litigation," he said. Mr Hulls says some applications may be resolved with a package of benefits including apprenticeships and joint ventures. A draft strategy will be released shortly. The new approach has been described as gratifying and significant by Bryan Keon-Cohen, QC, from the Miriambiak Nations, which organised the conference. The Story: Kevin Buzzacott was arrested at Genocide Corner, outside Government House, 21 days after setting up camp there and lighting a Ceremonial Fire for Peace on Thursday December 16, 1999. The charge of 'failing to cease to loiter' has been used throughout the colonial period of this country to remove and ban Aboriginal People from their own land. It is also commonly used upon environmental and human rights activists. This charge is held under the 'Summary Offences Act 1953' of the Parliament of South Australlia and reads: "order to move or disperse: 18. (1) Where a person is loitering in a public place or a group of persons is assembled in a public place and a member of the police force believes or apprehends on reasonable grounds- (a) that an offence has been, or is about to be, committed by that person or by one or more of the persons in the group or by another in the vicinity; or (b) that a greach of the peace has occured, is occuring, or is about to occur, in the vicinity of that person or group; or (c) that the movement of pedestrians or vehicular traffic is obstructed, or is about to be obstructed, by the presence of that person or of others in the vicinity; or (d) that the safety of a person in the vicinity is in danger, the member of the police force may request that person to stop loitering, or request the persons in that group to disperse, as the case may require. (2) A person of whom a request is made under section (1) must leave the place and the area in the vicinity of the place in which he or she was loitering or assembled in the group. Penalty: Division 8 fine:$1000 maximum plus $150 expiation fee or division 8 imprisonment: 3 months maximum. Worse, it will tell the lie that the issue of Aboriginal Sovereignty has been resolved. For over 200 years the first lie of the Crown's ownership of the Australian Continent left Aboriginal People cheated, robbed and landless and the object of systematic attempted genocide and ethnocide. Aboriginal People will continue to be left out of the picture, marginalised and even once again invisible. The transfer of a known illegal title to another party doesn't make that title legal. It compounds the crime of theft. The true legal position for Aboriginal People on the Australian Continent is defined by the principles of the Western Sahara case decided by the International Court of Justice and also defined in International Instruments. If we, the Aboriginal People could get our case to the International Court we could expect Justice and a complete change in both our spiritual and material positions. The Australian government thus far, but not forever has prevented our access to the International Court. We will attack White Australia in all the International, even domestic Courts available to us. Let us approach every International Tribunal possible, showing that White Australia is cynically demonstrating its true position; that it can without any pretense of legal fiction simply take our land. I accept that first people must respond angrily to white folks as well for what the ancestors have done to aboriginal people, because of their hurt and pain. I grew up in the bush spent my life in rural outback queensland lived on properties and worked in sheep and cattle as a ringer and stationhand. Went to Grade 10 only. I saw and experienced and was involved in many things including fights and shooting roos and pig hunting and mixed with people of all colours in the outback. I have worked with many aborigianl people in the bush. I write poems about rural queensland. I have experienced sites of where aboriginals were massacred in the early part of this century, I have seen sites where aboriginal people have walked and lived and died. I still do not feel I have the ability to know what you and the first Australian people are feeling. Perhaps Irene you could tell us of your experinces and help us to understand a bit about what brings you to be advocating for your people and the pain they have experinced at the hand of white people. I would love to see if people on here can give some stories about their experiences and what brings them to see the plight of our first nation people are very real and what we white people on here may learn from that.
