Torres and Ochoa, who broke into the home to rob it, entered the Morales' bedroom and reportedly awakened the sleeping couple. The intruders then opened fire, killing Morales and Yanez in their bed. The shooting woke Maria's 14-year old daughter Christina who called 9-11 and reported that shots had been fired. Only, according to the 9-11 tape, the 14-year old reported that the shots may have been fired by her step-father. Morales' 11-year old son, Francisco also awoke when the first shot was fired. He witnessed a man in a black T-shirt shoot and kill his father. Christina testified that she peeked out of her bedroom and saw two men. One was wearing a white T-shirt. The other was wearing a black one. The man in the black T-shirt had something in her hand, but Christina admitted that she could not see what it was. After they were arrested a block or so from the Morales home by police responding to the "shots fired" call, Christina identified Ochoa as the man in the black T-shirt and Torres as the man in the white T-shirt. A few minutes before they broke into the Morales home, Ochoa and Torres parked their car at a friend's house. A witness at that location (identified from court transcripts as "Ms. Calderon") told police that one of the men --Torres--took a small handgun from the back trunk of the car and stuck it in his pants. (The description of the gun differed from the weapon which Ochoa used to commit the murders.) Police stopped the pair about a block from the Morales home because, as Oklahoma City police officers Coates and Mullenix testified at the trial, the men were nervous, sweating--and they had blood on their clothes. A search of the suspects produced sufficient evidence that they were the guilty party. Morales' billfold, containing $300 and the dead man's identification, and some of Maria Yanez's jewelry were found on Torres. Positively identified by Christina Yenez, Francisco Morales and Calderon, the pair was subsequently tried in the District Court for Oklahoma County for the double murder. The first trial was held in October, 1995. The trial judge was forced to declare a mistrial when the jury could not reach a verdict Ochoa and Torres were retried in February, 1996. Found guilty of two counts of aggravated murder with malice aforethought and one count of first degree burglary in March of that year, both men were sentenced to death. Ochoa appealed his conviction to the Oklahoma Court of Criminal Appeals in 1998 arguing that when he was arrested he was not competent to stand trial; that his attorney was not competent; that he did not have an unbiased jury and that. for several reasons enumerated in the petition, he was denied due process. On June 30, 1998 the Appeals Court ruled that Ochoa received a fair trial and the death sentence was upheld. Exhausting his own State post-conviction remedies, Torres filed a writ of habeas corpus pursuant to 28 USC § 2254 asserting 26 violations of his constitutional rights. His petition demanded that Michael Mullin, the warden of the Oklahoma State Penitentiary release him from custody. His petition was denied. Torres appealed to the U.S. District Court for the Western District of Oklahoma. Once again, his petition was denied. On January 23, 2003 Torres lawyers, Mark and Lanita Hendricksen of E; Reno, Oklahoma appealed to the U.S. 10th Circuit Court of Appeals. After reviewing the case, the federal appeals court denied Torres's motion. The Hendricksens sought assistance from the Mexican government. At that time there were 52 Mexican citizens under death sentences for in eight States. Mexican president Vicente Fox appealed to the Bush Administration which, of course, was powerless to intrude in State jurisdictional issues. In 1992 Texas governor Rick Perry (who was serving out the balance of George W. Bush's gubernatorial term) ignored appeals from Fox to spare the life of death row inmate Javier Suarez Medino. Constantly living a life where you want a group of people to be beholden to you, is not healthy. It is just another way to keep the racial war alive in this country. There is not a single slave alive today. Nor a single white slave owner. Yet we are constantly reminded of what we as whites, owe blacks. Why is it ok for reverse discrimination just because it happened to someone else? Why should whites just suck up whatever racial slurs we are given, or whatever discriminatory actions are made against us, simply because "well blacks had to deal with it for years"? What is this type of mentality teaching our children and future generations? So, if I was an overweight kid that grew up being taunted mercilessly for being a fat kid; then it would be ok if I turned around and did the same thing to a new generation of fat kids? How is that any better? What is that accomplishing other than a vicious circle of hatred? Repeatedly splitting this country by race and racial issues is only fueling a potential future war within our borders, once again. Unless we all put a stop to it. As for the panel discussion, I have to say that Astin is turning into a very articulate and passionate newcomer on the celebrity political scene. Some of this may be attributed to his mother, Patty, who led the Screen Actors Guild through troubled times and won a lot of respect from her peers. Fourth, according to a front-page New York Times article, another Democratic presidential contender, Gen. Wesley Clark, sent out an endorsement letter written by the actress Madonna. To the average liberal Democrat in America, none of these actions is worthy of note, let alone of censure. To the liberal Democrat, public cursing (or, in the case of Madonna, publishing a book of oneself in pornographic poses or open-mouthed kissing another woman on national television) is of no consequence. Indeed, they consider a person who does care about such things to be an uptight individual who wants to inflict his uptightedness on everyone else the liberals' very definition of a conservative. To the rest of America, however, when a man who runs for president deliberately uses the F-word in an interview with a national magazine, it is cause for concern. Nearly all non-liberals and even some liberals would regard such a person as one who has a different understanding of what preserves our civilization. I do not believe for a moment that Sen. Kerry wishes to destroy this civilization's rules of order. But I do believe that many well-intentioned Democrats and liberals such as Sen. Kerry do not understand what makes our civilization great (the most significant example being the preservation of the Judeo-Christian value system). I also believe he used the F-word thinking it would impress the largely liberal and hip young readers of Rolling Stone. In other words, Sen. Kerry believes he can appeal to many liberals by coming off as one who has overthrown some of the disciplines of our society. That also explains the moveon.org evening of obscenities. "We're liberals and Democrats; unlike Republicans and conservatives, we are liberated from Western society's hang-ups in speech, in sex, in marriage, in the arts, in dress and elsewhere." It needs to be understood that it is not the use of an expletive per se that demands censure, let alone disqualifies a person from public office. If it did, only the mute would qualify for office. Moreover, when judiciously used, expletives can help a person let off steam in private and can be legitimately used in eliciting laughs in some humor. The issue here is the public use of expletives. If John Kerry curses on occasion in the company of his staff or his wife, that is not the public's concern. But if he uses the F-word in public in an interview, that is the public's concern. Many people do not understand this public-private distinction. That is why some callers to my radio show objected that I had never criticized President Bush's use of the word "a--hole" to describe a New York Times reporter. I explained that the president used the word only in a private remark to Dick Cheney when he assumed there was no microphone present. The difference between using an expletive when you think no one can hear you and when you want the world to hear you should be obvious to everyone. "Since my name is Mike Rowe, I thought it would be funny to add 'soft' to the end of it," said Rowe, a 17-year-old computer user and Grade 12 student in Victoria, British Columbia. Microsoft and its attorneys have demanded that he give up his domain name, the Vancouver Province newspaper reported Sunday. Rowe registered the name in August. In November, he received a letter from Microsoft's Canadian lawyers, Smart Biggar, informing him he was committing copyright infringement. He was advised to transfer the name to the Redmond, Wash.-based corporation. "I didn't think they would get all their high-priced lawyers to come after me," Rowe said. He wrote back asking to be compensated for giving up his name. Microsoft's lawyers offered him $10 in U.S. funds. Then he asked for $10,000. On Thursday, he received a 25-page letter accusing him of trying to force Microsoft into giving him a large settlement. "I never even thought of getting anything out of them," he said, adding that he only asked for the $10,000 because he was "sort of mad at them for only offering 10 bucks." He said family and friends are backing him and a lawyer has offered to advise him for free. He's also keeping his sense of humor. "It's not their name. It's my name. I just think it's kind of funny that they'd go after a 17-year-old," Rowe said. The results of the latest evaluation by the U.S. Department of Energy's National Engineering and Environmental Laboratory in Idaho were announced Sunday by the Danish Army Operational Command. The results mirrored findings late last week by a U.S.-led Iraq Survey Group, which was dispatched to the site in Basra last week after the British and Danish tests indicated the shells contained a form of mustard gas. The Danish troops initially found 36 shells, exposed by rain, in the ground outside a village near Qurnah on Friday. They were leaking a liquid deemed suspicious, since mortars usually contained solid explosives. "This was a stash. They were stacked and ordered and wrapped in plastic," Danish spokesman, Capt. Kim Vibe Michelsen told the Associated Press. Michelsen said the 120mm shells "don't look like any known" mortars in the Iraqi arsenal. Villagers in Qurnah told the Danish troops that they had found about 400 or more shells some years ago and threw them in the Tigris River. The area was the scene of intense fighting during the Iran-Iraq war. The villagers told the Danes that one 1984 battle fought there lasted seven days. When local residents retuned to Qurnah after the battle, all their cattle were dead and the area was littered with human bodies, Michelsen said he was told. None of the dead bore gunshot wounds, but all were bleeding from the mouth and nose - symptoms consistent with the use of mustard gas. Some villagers also complained they were of coughing blood for some time afterwards, and local livestock continued to get sick and bleed from the mouth. "This is a clear indication of chemical weapons use," Michelsen told the AP. The Danish Army Operational Command said it would try to determine the nature of the liquid that was in the Iraqi shells, why it tested positive for mustard gas and whether there was any link to past chemical weapons use in the area. If I had an employee that I became involved with, it might be tough in some situations to keep professional and personal interactions separate. I might try on some things to keep them separate. According to the lawsuit filed on their behalf by the Utah Civil Rights Liberties Foundation, the Cooks and Bronson share "sincere and deeply held religious beliefs" in polygamy as it was practiced in the early decades of the Mormon Church. Acting on those beliefs, the three of them went on Dec. 22 to the Salt Lake County Clerk's Office, where Mr. Cook and Ms. Bronson applied for a marriage license. But since Cook acknowledged that he was already married -- his wife was right there with him -- the license was refused. "The law makes it very clear that they can't be married to more than one person," the county clerk told the Salt Lake Tribune. "We're here issuing licenses according to the law." That law is written right into Utah's constitution, which declares: "Polygamous or plural marriages are forever prohibited." And that, the plaintiffs argue, deprives them of their religious freedom and privacy rights under the Constitution. It's an open-and-shut case, of course. They haven't got a prayer. Or have they? Last June, in Lawrence v. Texas, the US Supreme Court overturned a Texas anti-sodomy law on the grounds that the Constitution protects "an autonomy of self that includes freedom of . . . certain intimate conduct." Five months later, guided in part by Lawrence, the Supreme Judicial Court of Massachusetts ruled that the age-old ban on same-sex marriage was "incompatible with the constitutional principles of respect for individual autonomy." The essence of civil marriage, said the SJC in Goodridge v. Dept. of Public Health, is simply "the exclusive and permanent commitment of the married partners to one another." Well, if that, constitutionally speaking, is what makes a marriage -- the intimate union of permanently committed partners -- why shouldn't the trio in Utah be allowed to marry? On what principled ground can they be denied the protections and benefits of matrimony? To be sure, Utah isn't Massachusetts and federal court isn't the SJC. But logic is logic. If judges in one jurisdiction can decide that the right to marry includes the right to change the very definition of marriage, judges in another jurisdiction can do the same thing. Some advocates argue that it is insulting to compare a homosexual person's wish for a same-sex spouse with a polygamist's wish for multiple spouses. "Gay people are not asking for the right to marry anyone," writes Andrew Sullivan, a leading champion of same-sex marriage. "We're asking for the right to marry someone. Would-be polygamists already have a legal option: to marry a single other person." But of course gay people have always had exactly the same option. They are free to marry someone of the opposite sex, and throughout history, countless homosexuals have done exactly that. Nevertheless, Sullivan claims, for gays and lesbians, opposite-sex marriage "is no meaningful option at all." Isn't that exactly what the Utah plaintiffs would say about binary marriage? According to a "doctrinal overview" they filed with the court, so-called fundamentalist Mormons regard plural marriage as "a doctrine revealed by God, obedience to which is necessary for their desired eternal exaltation." A freakish notion? Until very recently, that is what the vast majority of Americans thought about same-sex marriage, too. The implication of Lawrence and Goodridge is that the only people entitled to decide whether an intimate relationship is meaningful enough to deserve legal protection are the parties to that relationship themselves. If other courts follow suit, the damage inflicted on marriage as we know it -- indeed, on the social order as we know it -- will be considerable.
