[Videolib] Looking for Travels with a Tangerine
Hi All, I'm looking for Travels with a Tangerine by Tim Mackintosh-Smith. According to WorldCat only two libraries have it and it's a DVD-R so I'm not optimistic, but I figured I'd toss it out to the collective. Actually the can do this IF they were making all sales DIRECTLY from their web site or office. An owner can set up whatever rules they want and enforce it by contract. However I believe Zipporah does sell on Amazon and other sites. Also in order to make a tiered pricing system work, it would have to include a check out function that clearly detailed the rights and uses and had a I agree to these terms button. That would be an enforceable contract. A few years ago I purchased several DVDs from Zipporah. I explained that my public library would not screen the DVDs and did not need PPR, and they agreed to sell them to us at individual-use rates. They also agreed to amend their purchase agreement form so my library could lend the DVDs via interlibrary loan according to our usual policies. If the title is sold exclusively via a distributor or filmmaker web site, a distributor can do whatever it wants in the way of charging more for institutional use across the board. The requirement that an institution pay higher prices, regardless of the nature of use is a contractual matter, not a copyright issue. The big bugaboo that has been hashed out endless on videolib is the practice of some distributors of claiming that PPRs are mandatory for any/all institutions...they're not! The ONLY way a distributor can effectively sell even directly on Amazon is if they have very specific wording and the I agree button at check out. Legally nothing prevents you from buying a copy as an individual and putting in the library for standard legal use. Obviously distributors have a right not to process your order if they object to an institution buying it, but until they put in some kind of specific contractual wording making buyers agree to certain terms, people can go around this. Kim you are correct that this is the only Wiseman film on Amazon. I was a bit surprised since he has always been very protective of his work. I suggest his people check out Ibid.dom. It has some of his films up illegally and cheap. Anthony- You're overthinking it. It was an effective way to get away from having hundreds of PN1997s. We can tweak it anyway we want to. Hitchcock is in British films, but could just as easily been classed with American. Same for whether or not to place Bunuel in Spanish or French. Billy Wilder is considered an American (i.e. Hollywood) director, so his films are within American. And if it was a problem having Brokeback mixed in with a handful of Asian films, we'd have found a way to reclass it to land within American films. Here's the deal, Laura Zipporah (and many others) are not charging high prices because you're showing stuff in the classroom--they're charging these prices primarily (exclusively) because they're selling to institutions and they feel those are the prices the market will bear, including, in Zipporah's case, sales to individuals.
