Final response should be used and BYE should be avoided because dialog is not yet established. Some UAs do send BYE on retransmitting out. But I have not seen one sending BYE on erroring out before a dialog is established.
However I was wondering as to why would you want to detect and private address in SDP and reject it in your UA!! This SDP may very well come directly from someone in your private network.
