Yes, see, I don't wholly disagree with flag:type=cultural, as that is "also" true. What seems to happen (quite often with First Nations' issues) is that OSM attempts to "shoehorn" things (admin_level values, flag:type values...) into a "one or the other" or "one and done" singular value, and, well, it simply isn't that easy.
