I think you're now talking about a case (LJN AF5100, NJ 2003/505) about the broadcast data of the Dutch public television (which programs are being broadcasted when). Because this is data that must be created and kept by the broadcaster anyway, the cost of getting the data is not an investment in the database, but only the cost of preparing the data so it can be put into the database. As the judge writes: Daarbij komt dat de Omroepen, waarvan de primaire taak is om landelijk radio‑ en televisieuitzendingen te verzorgen, deze taak niet kunnen vervullen zonder programmagegevens te verzamelen en programmalijsten op te stellen, waarbij, nu het tegendeel niet aannemelijk is geworden, moet worden aangenomen dat met het enkele opstellen van programmalijsten geen (afzonderlijke) substantiële investeringen in tijd, geld of anderszins zijn gemoeid.
