This is were you are confusing things: while it is true that the OSMF is not authorised in general to act as your agent, it has no bearing on the matter at hand. The use of OSM data by a third party is based on a license that they received from the OSMF (because you have permitted the OSMF to (re-)license any rights you might have in your contributions). -You- do not have any agreement of any kind with that third party, nor have you licensed your material to them. This is why OSM licensing is really totally absolutely in every aspect completely different from how WP is licensed.
