I believe the public access in Wisconsin is at the high water mark at
any time.  If his parking lot has ever flooded, it would be considered
public too.  I worked for two summers, while in college, for a cranberry
grower in central Wisconsin that was upset because they would not arrest
fishermen coming to one of his flowages across public land.  He wanted
to claim the flowage as private but once it became navigable, it became
public.  You may want to have your TU club or another group check on the
"claim".
