As I understand it, this would only be a problem if Rossi was aware of the
advantages of enrichment at the time he wrote that letter. You have to
present the best implementation (or "best mode" or whatever it is called in
patent jargon) at the time of the application or re-application. If you
discover an improvement later, you are allowed to file an amendment. I
gather that often happens.

The advantages of enrichment are described in the Piantelli patent, so maybe
Rossi cannot claim them. I guess he is obligated to mention them if that is
the best implementation. I don't know enough about patents to judge.
