Alright, I see that in Europe there might not be a grace period as there is elsewhere. Kinda bizarre. The patents I have are in the US.
But, anyways that's a pretty irrelevant detail. He could just disclose it all in the patent as you said. Anyways, as for being rejected, all patents (at least patents in the US) are initially rejected. That's why you follow up with more information to convince the examiner that your patent is valid. By your logic, the patent that Rossi has applied for is dead, kaput, and can't be fixed. I am not familiar with European patent laws, but I'm betting that Rossi can probably disclose more information in his claims / prove the eCat works to get it accepted.
