Adding onto Brad's point -- 38 GHz falls under "owned" spectrum (stuff that's 
been auctioned)

Part 101, which is the FCC Rules pertaining to point-to-point microwave 
backhauls, covers primarily 6, 11, 18 & 23 GHz
