The FCC's authority over common carriers is clear. Their authority over ISPs is not. The DC Circuit's May ruling overturning the Comcast Order gives a pretty clear picture of the FCC's authority. Had the FCC actually wanted to make a new set of rules that could withstand judicial scrutiny, they were told how. They were also told exactly what would not be approved. Guess which path they took in yesterday's order...
