Yikes. Okay let me be clear: I don't work on Market, I am not responsible for Market, I probably know less about this than you because I haven't read through the documentation. I am just giving my personal opinion. If it conflicts with anything in the TOS, I am wrong.
But personally, I think this has the potential to be a way way better approach to dealing with paid apps than up-front payments, for both users and developers. Hopefully it is all kosher with Market.
