That may be part of the tradeoff of the "lifestream" model that the Android Market uses. On the plus side (for users), they get all updates for free for as long as the developer publishes the app. On the minus side, if the developer pulls publication of the app, you may lose access. In a sense, it's a subscription delivery model without a subscription pricing model.
