If the decision of a zoning, planning board, etc. is capricious 
and/or arbitrary it will be overturned even for a secular entity.

Well a Frankenstein has been created. Because the genie out of the 
bottle is just what municipalities fear. It is difficult to regulate 
or force a relgious organization to abide by the rules. Thus, because 
they are freer to flout the rules - threatening that you are 
interfering with their relgious freedom - municipalities figure it is 
better to try to just keep them from starting up the operation in the 
first place.

How about the abuse of religious organizations is exemption from 
taxation for portions of their property not used for religious 
purposes? Why couldn't portions of the property used by JSM to sell 
items be taxed?
