Yes, 48 or 96 not working means there is a HIGH probability that the
24.576 clock is either not working or the mux that selects between the
two frequencies is not working. 

There have been some SB3 modders that replace the 11.2896 crystal and
take out the 12.288 one, but they do tell you that they are going to do
that. I have not heard of any such thing being done for a Touch. Given
that being able to play 96 is one of the big features of the Touch I
would think it would not be a very popular mod with the Touch. 

Sending it back to whoever modded it is a wise thing to do if you don't
have the right tools to check it out yourself.

Theoretically there could be something wrong in the firmware that could
cause the problem. You could check that by re-downloading the firmware
(NOT just doing a factory reset, but actually downloading the
firmware). But if you've already sent it off, thats hard to do!
