I most certainly do not want to turn this into an ethical discussion that veers 
away from the intent of the list-serv; however, I feel beholden to let you know 
that an item does not need to state that it is copyrighted in order for it to 
be and the argument that you made about the perpetuation of Edna's memory via 
her work is not a valid legal statement. 

I would strongly recommend that if anybody is indeed going to pursue obtaining 
a complete copy of this work, and one that Cheri has pointed out is very badly 
translated, you do so off of a PUBLIC venue.

I just checked my copy which I bought directly from Edna. There is nothing 
indicating that it was copyrighted. Although ethical issues about distributing 
unauthorized versions are valid, there is another point of view: mass producing 
Edna's massive project will perpetuate her memory, at least until a better 
translation becomes available, especially among all those non-Portuguese 
reading researchers of Micaelense genealogy.

Book 4 of Saudades Da Terra was translated by Edna Phillips kern and published 
in 2001. I purchased a copy from her and had this email and address for her in 
the cover of the book nerka...@aol.com , 12760 Perris Blvd A-8, Moreno Valley, 
CA 92553-2339. I think I paid around $35. 



I am not sure if any CD copies are authorized as the book was published in 
paper cover. I would be careful of distributing any burned copies of a CD. I 
think translating this would be considered a intellectual work and thus 
protected under copyright laws. Even if not how would you feel if someone took 
the genealogy work you did and distributed it freely?

Yes, one that I know of, but the only way to get a copy is a used copy. I can't 
remember her name, but she translated Livro Quarto of Das Saudades da Terra by 
Gaspar Frutuoso. It's about the leading families in the early days of the 
Azores. Mostly Sao Miguel and Santa Maria...little on the other islands. 
Frutuoso, I believed died in the late 1500's. I know several people on the list 
have the book. I gave my copy to the Family History Library in Oakland.
