In my experience, very little leeway is given to a dog that attacks another dog, no matter the circumstances of said attack, i.e leashed, in its own backyard, etc.

I would do everything i cold to settle this issue out of court, and as amicably as possible. A vet bill for emergency surgery could reach into the thousands of dollars, which could be tough to swallow (though half of that bill could be a bit more reasonable). The alternative worse case scenario could be the destruction of your pet, which to me would be impossible to swallow.

Just something to consider.

I think I'm taking a very pessimistic approach to this but...

In court, I'd worry that sending a gesture of kindness may be seen as a
guilty conscience.  If the vet bill goes very high and you aren't paying...
it likely that you'll end up on court.
