If he wasn't even charged then it could have been that the DA didn't have
enough evidence against him, or that his case load was heavy and the family
of the deceased didn't make enough noise or have enough pull to force the
issue.

There is virtually nothing other than political pressure that can force a DA
or ADA to press charges.  It's all discretion and who knows whom.

robbed (doesnt matter what was going on)
the intruder was in his house, he shot him in the
back, as he was runing out the door.
