No, they're not. If a school doesn't make the annual improvement dictated by NCLB the parents have the right to demand a transfer to a school of their choice and the district is required to provide transportation. Basically if the school your kid is in can't do the job you, as a parent, can send them to another one on the taxpayers' buck.
