Correct. However, the Supreme Court has made the differentiation of who
the
 constitution applies to. The Insular case basically produced the concept of
 "The flag can precede the constitution". That the US flag, representative
of
 possession, could precede the application of constitutional rights to the
group
 who may be living there.

  Guam has no congressional representation. They are not allowed to vote for
 president. Yet, they are citizens.
