Therefore the international laws governing genocide and other war crimes
extends to US military personnel only so far as a US court chooses to
enforce the laws.

This is exactly what the ICC was meant to combat. 
Impunity.

The US is in no way saying the law against genocide doesn't apply to us.

We are saying that no other institution can take jurisdiction over the
US in matters of deployed US military personnel. Individual soldiers are
held by US military code, and cannot be held by any international group.
