Usually: going to the board should be a measure of last resort. And the board usually respects the judgements of trademarks. So I wouldn't expect that to help.
The main difference is probably, that there isn't a well established software vendor called jackdaw. After all, It's not about translations, it's about trademarks. Let's not escalate this too soon.
