Believe me, there is code that made it into OpenSolaris without a SCA has been 
signed.

In any case, the German Copyright law is very obvious that you either need to 
be payed or the code most be OSS.

For the code in question Sun did not pay, so they need to keep it OSS and as 
they don't have a related SCA, they cannot change the license.
