One of the problems here that I see is that Tom is responsible for Ebays fee
that is biased on the final winning bid.
I think you need to contact Ebays Safe Harbor and explain the situation, and ask for
a retraction of the fees.
Claim the auction as invalad, and re-list. The only down side to this is that as a
seller I believe you are only allowed to do this a certain number of times
before you penalized and I don't know what that involves.
