It depends on the phone. Nokia N95 attempts to hide the GPS info from other
apps making it dependant on Nokia's own map service. That's probably good
for business
but crap for developers. It will no doubt be hacked, but there may be
license issues.

We've had some success making apps for the HTC 3300 using .NET

To answer your questions,
        1. Yes - the GPS dosn't rely on GSM/GPRS connection. You could cache
data on the phone until a
        connection was possible, or upload via USB, depending on the
application.
        2. Yes - see 1.
        3. Yes - as long as the phone is not actually off, (i.e. it's in
sleep mode with the display
        off saving battery) it can be receiving GPS and sending via network,
even be turned on by an 
      SMS in the background.

Windows mobile may not be the greatest phone platform, but if you're used to
Windows development,
it's by far the easiest platform for making custom applications.

#3 is not a requirement, just a question. I'm wondering how to access this
info for an art project with a big brother theme.
