Very.

- Refund clause is an integral part of the license.
- MS passes on the responsibility that it entails to OEMs.
- OEMs ignore the clause, hence the license.
- Now, how can it be binding on consumers alone?

Either consumer gets a refund or s/he has "bought" the right to ignore
(you accept but ignore) the EULA as well. hehe.
