You know, at the risk of sounding like an ass, there is a simple solution to this "tricky moral problem." Stop reading people's friggin' email. It's a matter of respect. If there's a problem with a particular employee, and legitimate and verifiable reasons exist to investigate that person's actions, then fine - look through their email as part of an investigation. Just don't do it randomly and without reason. Have probable cause before you start snooping around. All this talk about who "owns" the systems and the data that gets transferred through it is just a fascist smoke-screen. Show your employees some respect, and they'll be better employees than those governed by fear.
