I couldn't get the URL to work, but the story quoted did not mention speed, drinking, insanity or any other such condition.
I see these solar garden lights on an almost daily basis as there is an anchorage of unmanned boats on my way from the dinghy dock I use and Bandersnatch. While they are better than nothing at all they do not come remotely close to meeting legal requirements. Some are better than others, but the best of them are very dim; much, much, dimmer than required by COLREGS. While they are helpful in a known anchorage in a Manatee Zone (slow zone), such a light is not adequate for a single boat anchored by itself. Bear in mind the COLREGS were written by seamen entirely for the protection of seamen. That would be us. We don't "pays you money and takes your chances". The rules of the road are not only to protect ourselves, they are to protect other people. The jet ski is not different than the fishing skiffs that go by me heading home every night. The inadequately marked sailboat was wrong. Proper anchor lights are precisely to prevent this sort of unnecessary tragedy. The judge was right.
