You are — I'm sorry to say — definitely wrong. At least here in Germany
(and most other countries in Europe have the very simmilar laws for
that) it doesn't count how _long_ the sample is. It just counts if it is
recognizable as being the sample from someone else. If I say "Hello" in
a sample it is definitely shorter than 5 seconds. But as long as you can
identify me, it is not OK to use it without permission...

Sampling is a mine-field. Not only here in Germany.
