You are — I'm sorry to say — definitely wrong. At least here in Germany
(and most other countries in Europe have the very simmilar laws for

a sample it is definitely shorter than 5 seconds. But as long as you can
identify me, it is not OK to use it without permission...
Sampling is a mine-field. Not only here in Germany.
I'm hoping that there are more sites out there than just this one, but it seems to have a
large library of allegedly free instrument samples. One description of
a sample I found said this:
Recorded in a long hallway with two AKG C4000Bs as
overheads and sm57s on everything else. No fake reverb!
Some of the samples have no description, so it's really up to the site
and the uploaders to verify that they're able to be freely-licensed.
The site states that it's a collection of Creative Commons licensed
sounds, and most if not all of the individual samples say they're
licensed under the Creative
Commons Sampling Plus 1.0 license.
Perhaps to play it safe the existing LMMS samples could be replaced
with those from this site, linking back to the site for the licensing
information? Several of the samples sound pretty damn good, so it might
be win-win all around.
