Only if it is "must carry OTA" there are several of the broadcast stations/networks (the ones that have started charging the cable companies--ie fox in some larger markets and cbs in some larger markets) this makes those no longer must carry. The rule is that if the OTA station does not charge the cable company then the cable company must carry them unencrypted...once the OTA station/network chooses to start charging they lose the must carry status and can be encrypted.
