I wouldn't start to panic just yet. The FCC doesn't have a tremendous track record for getting its rules through of late, they have been overruled on appeal in several instances by the RBOC's and I doubt that this one will be any different, especially given the cost involved. However, we really need to recognize the actual driving force behind this before we get too bent out of shape around it. With the advent of voice over IP and many ISP's, cable companies, etc, entering into the local and long distance phone service markets, it was really a matter of time until law enforcement proposed that the same regulations that enable them to place phone taps on normal phone lines, be extended to new technology phone lines. There is absolutely no need for anyone to reinvent the Internet in order to put a tap on your internet account. They can go to an RBOC and get a DSL sniffer attached at the DSLAM to monitor that usage. They can attach a sniffer at the pole or house for cable broadband. Dial-up is even easier. ISP's don't offer encryption now and there is nothing to prevent you from encrypting yourself. And an encrypted VPN connection will pretty much bypass everything that they can put on the line. But I don't think that the point of the rules are to start sniffing regular traffic, it is still easier for them to plant a keystroke logger or other type of backdoor on a system. I figure that these new rules are simply a reaction to VOIP phone service. -- Bryan Phinney
