Well, it's a bit contradictory.

On the main page for D20 it says "The D20 System Reference Document
(D20SRD) is an Open Game. It is presented to the public using the
terms of the Open Gaming License."

Then in the overview of the of the D20SRD, it says

"This material is copyright 2000 Wizards of the Coast, Inc. Permission
to copy, modify and distribute this document is granted solely through
the use of the Open Gaming License, Version 1.0.

This document provides an interface to the basic rules and materials
needed to create content compatible with the best-selling tabletop RPG
system in the world. "

On the other hand, it says "THIS MATERIAL HAS NOT BEEN RELEASED USING
THE OPEN GAMING LICENSE"

At any rate, if it's not open, then what about the various d20
products that are already out? Are they all illegal? Has any publisher
of a d20 product received a warning?
