The D20 System is not now and has never been open. Wizards has proposed
opening it and are working toward a goal of opening it. I believe the odds
are slightly positive that it will eventually be opened. But it has not yet
happened. As of the last time I looked, the D20 SRD was still a draft and
not yet released under the OGL.
