The authors I'm workign with are using CAD-based map format, so its not even an image. 
Of course
they can include any text OGC notes in the map itself (CAD format is incredibly 
flexible) - but to
read them will require installed viewer of this format. Then all sort of interesting 
questions
starts to arise. Like is the map clearly identified as OGC if it contains the note 
stating such, but
to read the note user needs a viewer which may not be avaiable for his computer (Mac) 
or OS (Linux)
system? Separate text file on the other hand is readable without special software by 
all computers
and OS. Therefore in my opinion author who contributes anything in binary formats to 
OGC has to
1) include description file with OGC header and binary copyright info.
2) Make a statement that each description file full text is in fact copyright notice 
for binary it
describes.

Therefore if someone removes description files from distribution he automaticlay 
violates OGL 6. So
in my opinion with such setup separate folder idea would work rather nicely.
