The official response is, "ASK FOR PERMISSION."
Or the more verbose version, since I see this as something thats going to clock my
inbox, here is a quote from a response from Anthony Valtera:

AV: No. Not currently. If a product is in development right now that uses the monsters
in question and that company does not contact us for permission then when that product
goes out it will need to be recalled.
Q. Well WotC allow re-prints of those books that center around those monsters, like

AV: Yes. Those products will be given permission. In future re-prints they will carry
a "used by permission" notice.

In all cases, existing products, products in development, print and e-book products,
WotC is requesting that you contact them for special permission to use the Monsters
that have been removed.
To save yourself, and WotC time -- I suggest that you make sure you include everything
you think relevent to the requesting of permission before you kick a message to them,
including but not limited to Your name, email, phone #, name of company, type of
product (print or electronic), short description {1-3 sentences} discussing how
extensive your use those monsters is, and of course a list of which monsters your
using.
For Example:

Product: Gaming Herald
Usage: Will be publishing an article discussing the finalization of the SRD, and
removal of monsters.
Which monsters: Beholder, Yuan-ti
Then I'd personally kick that to Andy the Intern { [EMAIL PROTECTED] } or
Anthony Valtera { [EMAIL PROTECTED] } but only after I've made sure I've
briefly including everything I think is nessary.
You don't want to waste their time, or annoy them with silly questions like "Ya, I
like use a beholder as a distraction in like one of my pdf modules, it's only
meantioned in one place, can I like have permission to use it?" -- I assume the answer
here, esp since it's a PDF, and because its only meantioned once and is not a pivitol
plot element that they would just ask you to remove it -- so save yourself, and their
time, and just remove it.
It's simple, it's straight forward, who gives a $#%$#% for the reason, but it's the
simple truth. We all agreed to abide by their Gentlemans agreement, no its time to
deal with it.
