If they are found guilty of a capital offense, they should receive life in prison. If they are found to be guilty of a lessor crime, they should sever time in prison. If they are found to be innocent of any crime, return them to the point from where they were taken. This shouldn't overwhelm the criminal justice system; because, it is my understanding there are only about 500 prisoners being held in Guantanamo.
The prisoners being held at Guantanamo are no more danger than many prisoner being held on death row today, and to think of them as some kind of especially dangerous Supermen requiring handling under special laws is the real danger. I say this should all be handled in the traditional American way, (eg Constitutionally), including the issue of immigration. The USA has been headed in a dangerous direction ever since 9/11. If this continues, America will wake up in a generation, or two generation at most, from now in a completely different world. It will be a world that knows nothing of Democracy or Constitutional guarantees to privacy, freedom, and due process. The American way that we knew just a few six or seven years ago will be gone forever, unless we change direction back to the foundations upon which the USA was built.
