Sorry for the statement "Even the ActiveMQ guys cannot agree" but I
thought that "Paul Fremantle" was an ActiveMQ contributor. 

As you said we need legal council to provide an opinion on the
situation. But from the Qpid/AMQP point of view I am more worry about
NMS confusing people rather than introducing legal issues.
