Well I guess it should be all-right for Red5 to stream H.264 / AAC content as far as it doesn't use some proprietary code from the codec library, i don't know about the USA, but here in the EU the software patents were not introduced, which means if you find your way of how to do stuff, it's your right to do it as far as you use your own code or GPL like code.
