Well, I see what you're saying here, but then the question remains, "when is it 
acceptable to voice your frustration?"  In other words, at what point is it ok 
to say something?  Was the acceptable level of 'bite' not achieved in this case 
to prompt the response?

I think Dan did a good job in breaking it down personally.  He didn't come 
straight out and say, "He bit my sh*t!", but rather drew a clear picture on how 
it came about. 

I don't wanna sit here and say that "you gotta have put tracks out to fully 
understand", but there is a certain aspect of that present that'll take too 
much time/effort to share right now.

While reading Dan's letter, I can totally see SWinxter jocking Dan & Co at the 
parties, similar to how Humpty Vision would jock the turntables when Allen and 
I would be playin' in LA during the old Plug Research days...hoping to catch a 
glimpse of the record label that was spinning.  I purposely blocked his view 
and suggested he go and do his homework.

There's gotta be some level of respect paid.  The way I see it, if you have to 
think about it twice, then give the props that are due.  Dan's gripes are 
justified, and whether or not it's 'standard practice' to do what Jinx did has 
no bearing on the validity of Dan's argument.

Also, it's pretty weak to attack Dan for not putting out enough records.  That 
too has nothing to do with this discussion.

It doesn't seem like Wink did anythign that isn't standard practive in
this music.

This also isn't the first time I've heard bitching about Dan Bell's style
getting ripped off (though it is admittedly the first time Ive heard it
directly from Dan)- but I think the point I'm trying to make is that Dan
quite apparantly has sour grapes with Wink. He also certainly has sour
grapes with Plus 8. That's a lot of sour grapes for someone who's only put
out a few records and none for a very long time.

Imagine this- what if Chuck Berry sent out an e-mail bitching that Keith
richards stole his riffs. Duh!

Yeah, another well-informed posting.  What if Keith Richards *did* rip off 
Chuck Berry?  (Or more to the point, what if the Stones and a lot of other 
groups ripped off Willie Dixon -- a point that Dixon won in his lawsuit.)

The cheap personal attack on Dan Bell ("sour grapes"? "immature"??) 
doesn't address the real issue here at all.

What this all actually reminds me of, in fact, is the infamous String of 
Puppies case.  This happened when former-art-student-turned-mutual-fund-
salesman-turned-kitsch-but-highly-popular-with-the-monied-set artist 
Jeff Koons (yes, the one who was married to "La Cicciolina" for a while) 
recreated as sculptures a cutesy tourist postcard picture taken by 
photographer Art Rogers of some puppies.  Koons then sold his products for 
hundreds of thousands of dollars -- let's not even get into the "greater
fool" theory of how the art world works here -- without paying Rogers for 
use of his copyrighted work.  (Are you with me so far, Josh?)  

Now of course this was a pretty far reach, copying a two-dimensional 
image into a three-dimensional form (even better, Koons himself wasn't the
creator of the sculptures, he had a workshop in Italy do all the actual
work).  But the court's conclusion in the case was very firm: copying 
is infringing even in a different medium if it does not involve 
"sufficient changes so that the works at issue undercut substantial 
similarity."

I am not a lawyer (of course), but it seems to me the issue between Dan
Bell and Josh Wink isn't "sampling" but instead a different legal 
doctrine called "derivative work."  If Wink's record has a similarity of 
*expression* -- then it may be infringing.  Thus, changing the vocal
sample from "control" to "freak" (hah) may well not change that
fundamental similarity if other elements are "substantially similar."
One legal commentator says:

  What is protected [under our copyright laws] is the original or 
  unique way that an author expresses his ideas, concepts, 
  principles or processes. In looking at the two works of art to 
  determine whether they are substantially similar, focus must be 
  on the similarity of expression of an idea or a fact, not on the 
  similarity of the ideas or concepts themselves. Durham Indus. v. 
  Tomy Corp. 630 F.2d 905 (2d Cir. 1980). It is not, therefore, the 
  idea of a couple with eight small puppies seated on a bench which 
  is protected, but rather Roger's expression of this idea — as 
  caught in placement, in the particular light, and in the 
  expressions of the subjects — that gives the photograph its 
  charming and unique character, that is to say, makes it original 
  and copyrightable.

The explanation that attorney Fergus provides is much lengthier than 
this (fair use) excerpt indicates, and very helpful in fleshing out a 
lot of the legal wrinkles, so check it out if you're interested.

I see Dan's letter as a more appropriate response to Wink than the threat 
of a lawsuit.  The resemblance of the Bell and Wink tracks is so close 
that numerous observers in addition to Dan have noted the similarity.  
Since Josh Wink is obviously familiar with Dan's work, even to the point 
of deriving the name of his track in a clearly derivative way from another 
of Dan's records, there is more going on here than a mere accident or 
coincidence.  And I think Dan is completely right to squawk about it.

Not that the folks in NYC need a reminder, but I'll second the Function
endorsement. He was very tight opening for Suburban Knight last Spring @
Limelight. All sorts of Detroit and harder European techno in the mix.
Definitely towards the top of the heap of east-coast techno Djs.

there, or links to DB stuff should be there.  I havn't seen a new Direct
Beat record in a Loong time.  I think newest DB record worth having is

in future weeks.  The system is really great,  it wasn't too crowded and the

Well as I've said before I think it's that white label that was released
around this time last year.  It had 2 different mixes both featuring jazzy
piano
riffs - it has a sticker on it saying 'Derrick May Strings Of Life
2001' (dunno if that is the one TP was playing or not).  The only other
semi-recent mixes I know of are the one Tarantella and Redanka did
(surprisingly not too bad;) which was never released afaik,  an Ashley
Beedle remix http://www.dancetracks.com/audio/31992.ram and that awful Plank
15 one with the King Unique remix of Jaguar on the flip.

But Dan has a point it could easily be Salsa Life - which mixes nicely with
that white label btw - due to Maarten's characterization of the track as
being 'Latin-like'.

their web site forum concerning Josh. Someone at Ovum threatened them with a
defamation of character suit due to a not so nice post about Josh on their
forum. They were asked to remove the post from their site. This character
also told the forum admin that they are going to sue Dan Bell for defamation
as well.I wish this was a joke

Same here, took about a week for them to get to the UK, plus they threw in a 
mystery promo of Phases001 which was pretty cool, as well as the famous 
Metroplex party flier.

Though I have to admit there was a time when they didn't answer my emails or 
order enquiries at all, but I was really impresed with thier level of 
communication and service this time round.

I'm not really surprised by any of this. My legal backgrund is (thankfully!)
a distant memory now, so I'm not up on the latest case law, but I do know
that you need to tread carefully with this kind of thing.
That's kind if what I was getting at yesterday. IMO, Dan Bell has a strong
case to sue for copyright infringement over the "Superfreak" track and
that's what he should have done. I can understand that he feels bitter about
a sequence of events with Josh Wink and feels that he's been ripped of in
the past, but the fact is that comparisons of other tracks like "Don't
laugh" with "Losing Control" simply would not stand up in court.
What's happening now is that other people are putting themselves in a
compromising postion, legally, by hosting potentially defamatory comments
and copyrighted material on their severs in an attempy to support Dan, and
it sounds like Ovum are getting ready to strike the first (legal) blow. I
just really think he's gone about this the wrong way...

lol i've got this...the whole thing lame covers. Matt i'm surprised you

back to the thread: winks track is a remix in my eyes. for the people who
don't see this i think some of
the confusion as to whether it is similar or not is down to audiogalaxy
having the wrong track up as dbx's phreak, and a few of dan's tracks
having phreak in the name (acid phreak, beatphreak etc)

wink should do what his conscience tells him.

that said if you sell 500,000 copies of something it appears you also have
money to burn on lawyers :)

The Internet is still a very grey area for issues of libel and the like. I 
remember a case against that was bought against Yahoo for comments posted on a 
newsgroup on a site that was hosted on thier servers. It wasn't the owner of 
the newsgroup itself that was held responsible, but Yahoo for hosting the site. 
Its much the same as a newspaper that might publish something considered 
libelous by a party, it would be the newspaper in court, not the individual 
writer. With this in mind Submerge are probably safe unless they host thier own 
website, though thier hosts may request they remove the comments if things were 
taken further. 

Personally I agree that Dan Bell may have gone about things in the wrong 
manner, but I guess this depends on what communication Bell may have had with 
Ovum prior to posting his letter. Certainly I think he should have contacted 
them first regarding this. Though his story does paint a rather a rather 
annoying figure of Wink as some kind of long term obbsessive musical stalker, 
so I guess is Dan has felt this way for some time its understandable that he 
would think enough is enough. It is a worry though that Wink seems to be more 
on the ball with the legal side of things. Interesting to see where this goes, 
though having listened to the 2 tracks that Dennis posted I have to admit I've 
heard more blatent rip offs in my time, derivative as Wink's track may be.

Shame things have to come to this.

"The Original Artists", where The Original Artists was a band made up,
apparently, of a bunch of winos with the shakes.  Aside from the obvious

[313] Bell v Winx - Submerge board

I gotta say some of the comments made on the Submerge board are pretty weak and 
ill thought out. I didn't say anything until I'd heard both tracks and even 
then I have to say I didn't feel the track was similar enough to really have a 
huge rant about. But for people to start publicly calling Winx a wan**er and 
shouting death to wanx and similar slogans seemingly without having even heard 
his track, or at least with no reference or comment towards it, is pretty lame. 
I should think Submerge would be fairly happy to remove posts like these from 
thier board anyway.

incorrectly labelled as Phreak on the 'net. Wink's track is very similar to

Yep, people who are comparing the 2 tracks posted earlier are only getting half 
the story.  This is important for list members who don't own these DBX 
12-inches to accurately make up your own mind for yourself.  The origial DBX 
track "Phreak" has the same bleep line as the Wink track, and repeats the vocal 
word 'phreak' over and over on 1 bar lines, just like the Wink track.  Can 
anyone post a few bars or a snippet of the REAL DBX track 'phreak' so others 
can hear?  RealAudio or whatever...  I think it's on the original B-side of 
Losing Control 12" on Peacefrog, and also was on Accelerate at some point too.  
The one worth the word said over and over...

It's just important people hear the correct dbx track here to compare so 
everyone can make up their own mind, that's all I'm saying.

I've finally had a chance to listen to all 3 tracks now. I honestly don't
see what the noise is about. Angel Alanis, Stewart Walker, and probably
dozens of other artists have done tracks that are similar to Dan's tracks.
Matter of fact, both Angel Alanis and Stewart Walker's have tracks that are
much closer to Dan's music that this new Josh Wink track. Why is this such a
big deal? Everyone is "inspired" by another artists work at some point in
time, why are you guys making such a fuss over this one instance?

Almost all purpose makers sample todd terry.. just listen verry carefully,
and they are there.. the toms !

Todd terry would need a good typewriter if he would write letters to
everyone that sampled his beats...


Erm, most of the purpose maker tracks have a 727 in there You 
can't sue because of some Toms, There is still legal sampling guys. 
Taking a small snif of a track doesn't turn you into a bastard. I 
still have not heard Winks track but if he did the same thing as with 
that French Kiss remake then that's stepping a line.

and "innovative" releases. It'd be easy, wouldn't it? I'd make a track that
was a pretty straight copy of "Rhythm" from Minimal Nation - sampling George
Clinton as well, but programming the main melody line on a Nord Lead and
maybe sticking some 909 rimshots in as well, then wait for the dollars to
roll in while suing everyone who mentions the name "Robert Hood" on a
message board. Life would be good!

I don't believe quite 'get it'.  

There is a clear distinction between "Inspiration" and straight "Bites", and 
when you factor in the compensation that you mentioned, it makes it that much 
worse.

I don't think it's amazingly unrealistic to reduce it to that, yeah - that's
what it always comes down to, every time an artist or label has got pissed
about someone making cash out of sampled work. Basically, by most people's
moral codes, the guy who does the work deserves the reward. In this case Dan
Bell is seen as the guy who's done the work, but Josh Wink is going to get
the reward - not just cash, but props, and strengthening of his reputation
as a "master producer" in the mainstream dance music industry. This is seen
as unfair, and hence people get pissed. At the end of the day, money does
matter - it pays the bills. I'm sure many of us would like to see Dan Bell
get a cut of whatever revenues Josh's track brings in. Maybe this moral take
on things is wrong, and the guy who does the work *shouldn't* get the reward
- maybe the guy who's able to pull off the cheeky exploit and benefit from
the work should be seen as ultimately the smartest and most canny guy, and
therefore the guy who deserves the cash. That's what Adam Smith would
presumably say...

I think that poster looks pretty cheesy - maybe that's cuz I'm an
artist, I used to draw robots mixing when I was 16 like that.  The only

Hmm, I am not too impressed with the line up.  There are definately some
great artists on the roster, but I keep seeing a repetitive Detroit
super hero collective.  I wish that I could see more people like Claude
Young, Jeff Mills, Dj Hell, Aphex Twin doing all his polygon
window/caustic window stuff, something like that closing out a night. 
It's a pretty boring line up for me, I've seen almost everyone on there,
and could see them again any day.  I like the fact Chaos made the line
up, they're a crazy live act.  There are some good artists I'll be happy
to see though, don't get me wrong.

with looping bacardi videos and airplanes flying banners etc etc again? 
given mitsubishi is running that retarded car commercial with the girl 
getting her rave-on in the car 50 times a day, i was half expecting to see 
them take ford's place...

the biggest disappointment to me is that there doesnt seem to be much live 
stuff this year. they said in that detroit news article that they wanted to 
keep people dancing all day this time, i guess they assume dj's are better 
at this...personally i just think daylight keeps people from dancing as 
much...and i really like checking out live stuff during the day, nice 
atmosphere and mood, to me..

oh well..still pumped!

A Number of Names closing it out on the main stage tho!! nice!! that is a

maybe some of the live performances just arent noted. i assume black eyed
