  Bangalore: Three versions of Windows Vista confront buyers. That is not to 
say that PC owners — at last count there were about 50 million of them in India,
9 out of 10 being users of an earlier Windows version — know quite what to do 
now.
  This is partly because Microsoft, while asking us to say `wow!' at all the 
new features, has been rather coy with practical details — like who must 
upgrade,
who would be better off upgrading — and how much it is all going to cost.
  Launch event
  The main launch event in Mumbai was replete with Bollywood `masala' — but 
scant on earthy details such as how much each of the confusingly plentiful 
`avatars'
of Vista will set us back in rupees.
  Here's some help: There are three consumer versions of Vista that one can buy 
off the shelf — and a fourth called Starter Edition that is special to India:
It will be only be sold pre-installed on entry-level PCs marketed here.
  The three `shrink wrapped' versions range from the Home Basic, for those who 
browse the Net, write letters and e-mails — and do little else with their PC.
If your PC has multimedia attachments that allow you to watch movies, play 
music and play graphics-rich games, the Home Premium version is for you (It
corresponds roughly to what was called Windows XP Media Centre Edition).
  For those who want to mix business and pleasure — the full suite of office 
functionality as well as infotainment features — there is Windows Vista 
Ultimate.
But, you still need to separately install the latest version of the 
productivity suite, Microsoft Office 2007, to get most of the common business 
features.
  Basic hardware
  Microsoft says the basic hardware required is a modern chip (that is 800 MHz 
or faster); 512 MB of memory, 20 GB of hard disk and a graphics processor with
what is called DirectX 9. This might just work for the Starter edition — but 
except allowing you to search both your desktop and the Internet with a click
or two, it will miss out on most the features that take Vista beyond the old XP.
  Our take: If so, why bother to upgrade? For the Premium and Ultimate 
versions, Microsoft recommends 1 GB of memory and a graphics card with at least 
128
MB of its own memory. It also suggests at least 40 GB of hard disk. All three 
versions will take up about 15 GB of your disk space. After trying out the
evaluation editions, we think users will need at least 2 GB of RAM to (as a 
famous petrol slogan of yesteryear went) ``fill up and feel the difference.''
  The difference is mainly the much-touted Aero effect where 3D combined with a 
translucent `glass' effect has all your pages and open applications seeming
to stand up in a see-through file on the screen. All versions boast of 
extremely user-friendly `parental controls' to monitor kids' surfing — and 
enhanced
security features against junk mail (spam) and malicious mail — but it is too 
early to say how effective they are. And be warned: you still need to install
a third party anti-virus software — unless you like to live dangerously.
  Key question
  Now the key question: Which Vista will work on your present PC? Microsoft has 
created a special download called Vista Upgrade Adviser at
www.windowsvista.com,
which examines your hardware and software and recommends what will work best 
for you. When I tried it on my AMD Athlon XP 2400-based PC currently running
Windows XP, it suggested I could go in for Home Premium but it warned that my 
Xerox laser printer and Nero software for a Samsung Combo CD-DVD drive might
not work. It has no issues with my HP deskjet printer.
  Common peripherals
  This is likely to happen with a lot of common peripherals. Our feedback is 
that the problem will bug many users for at least 6-8 months more since there
are hardly any accessories or PC devices that include a Vista driver today.
  So finally: Who should upgrade? If you are currently running a version older 
that XP — like Win 98 — then you have no choice since you are stuck with a
`dead' version: You might as well change to one of the new Vista versions. If 
you are buying a new PC or laptop, it is good to insist on getting a Vista
flavour pre installed. This will probably be cheaper than buying one separately 
since the shop shelf cost is likely to be Rs. 6000 to Rs. 10,000 at least
(this is our market perception; Microsoft is not saying). If you are a Windows 
XP user you might like to change to Vista — if you st have the undoubtedly
strong safety and search features. Or you might like to `wait and watch' till

  The Bose Quiet Comfort headphones — whose third iteration in seven years has 
just been launched in India — was co-developed by Amar G. Bose, the founder

  When he was still Professor of Electrical Engineering at the Massachusetts 
Institute of Technology (MIT), Dr. Bose was inspired to exploit the technology
of `noise cancelling' — that is analysing the surrounding noise and 
neutralising it by creating an `equal and opposite' noise — when he found it 
difficult
to listen to his music player in aircraft.
  The first award-winning Bose headphones, which fought noise with noise, were 
made for civilian and military pilots in 1989. Two years later, Dr. Bose 
launched
the first consumer version of QuietComfort — for lay users who sometimes needed 
to shut out the annoying noises of everyday life. Even while driving ambient
sounds especially the bass notes to almost zero, the phones also provided 
superior audio quality when coupled with good music players.
  The latest QuietComfort 3 headphones that The Hindu was enabled to try out 
provide a better fit than earlier versions which tended to be rather heavy on
the head.
  The `active' noise cancelling has been improved by developments on the 
micro-chip that sits inside and the `passive' noise cancelling has been beefed

in-ear headphones (Rs. 5,000) seem like a lot of money to listen to your MP3

  Dr. Bose has just been named for the Distinguished Service Citation 2007 by 
the (U.S) Automobile Hall of Fame — for a generation of audio systems for cars.

  The transformation in telecommunications has accomplished what our socialist 
policies couldn't — empower the less fortunate.

  No contradiction: Living in several centuries simultaneously.
  ONE of my favourite photographs was from the last Kumbh Mela. It showed a 
sadhu right out of central casting — naked body, long matted hair and beard, 
ash-smeared
forehead and all — chatting away on a mobile phone. The contrast says so much 
about the land of paradoxes that is today's India — a country that, as I
wrote many years ago, manages to live in several centuries at the same time.
  Paradoxical images
  There are other photographs I have seen over the years that illustrate the 
same phenomenon — labourers carrying TV sets on their heads, a bullock-cart 
transporting
rocket parts, a motorcar overtaking an elephant, and so on. But there's 
something particularly special about the sadhu and his cell phone. Because it is
in communications that the transformation of India in recent years has been 
most dramatic. Last month, for the first time, seven million Indians subscribed
to new mobile phones. That's a world record. In September 2006, India overtook 
China for the first time in the number of new telephone subscribers per
month. We're still way behind China in the total number of cell phone users 
(just over 140 million against their 450 million), but each month the gap is
narrowing. By 2010, the government tells us, we'll have 500 million Indian 
telephone users. China will probably still be ahead, but on a per capita basis
there will be little to choose between us.
  Astonishing change
  Now, to anyone who grew up in pre-liberalisation India, that's astonishing. 
Bureaucratic statism committed a long list of sins against the Indian people,
but communications was high up on the list; the woeful state of India's 
telephones right up to the 1990s, with only eight million connections and a 
further
20 million on waiting lists, would have been a joke if it wasn't also a tragedy 
— and a man-made one at that. We had possibly the worst telephone penetration
rates in the world. The government's indifferent attitude to the need to 
improve India's communications infrastructure was epitomised by Prime Minister
Indira Gandhi's Communications Minister, C.M. Stephen, who declared in 
Parliament, in response to questions decrying the rampant telephone breakdowns 
in
the country, that telephones were a luxury, not a right, and that any Indian 
who was not satisfied with his telephone service could return his phone —
since there was an eight-year waiting list of people seeking this supposedly 
inadequate product.
  Mr. Stephen's statement captured perfectly everything that was wrong about 
the government's attitude. It was ignorant (he clearly had no idea of the 
colossal
socio-economic losses caused by poor communications), wrong-headed (he saw a 
practical problem only as an opportunity to score a political point), 
unconstructive
(responding to complaints by seeking a solution apparently did not occur to 
him), self-righteous (the socialist cant about telephones being a luxury, not
a right), complacent (taking pride in a waiting-list the existence of which 
should have been a source of shame, since it pointed to the poor performance
of his own Ministry in putting up telephone lines and manufacturing equipment), 
unresponsive (feeling no obligation to provide a service in return for
the patience, and the fees, of the country's telephone subscribers) and 
insulting (asking long-suffering telephone subscribers to return their 
instruments
instead of doing anything about their complaints). It was altogether typical of 
an approach to governance in the economic arena which assumed that the
government knew what was good for the country, felt no obligation to prove it 
by actual performance and didn't, in any case, care what anyone else thought.
  Great leveller
  So the cell phone revolution in India is exciting not only as a sign of 
India's economic transformation into a 21st century success story, but as a 
symptom
of something far more important, a change in the attitude of our ruling 
classes. The government is marginal to this success story, since we don't need
it to lay telephone lines across the country any more, and the private sector 
telecom companies develop their own connectivity. Perhaps the key contribution
of the government has lain in getting out of the way — in cutting license fees 
and streamlining tariffs, easing the overly complex regulations and restrictions
that discouraged investors from coming in to the Indian market, and allowing 
foreign firms to own up to 74 per cent of their Indian subsidiary companies.
The Telecom Regulatory Authority of India (TRAI) has also been a model of its 
kind, a regulatory agency that saw its role as facilitating the growth of
the business it was regulating, rather than stifling it with rules and

past 12 yrs.
We have developed two modules for teaching basic computer
skills. One, is executed 6 hours a day for three months, six days a
week  the other for 2 hours per day for five months, six days a week.
So why should you have 6-8 months? Further, we developed multiple
tests during these modules. Tests, as you are aware, are crucial for
assimilation of knowlege. Further, our criteria is - a working
knowlege of English, typing speed of 25 words per minute  have passed
std 6. We have easily handled students with a rural background  most
students had been motivated enough to brush aside the difficulties of
hearing an american accent while they could barely speak the language.
The course content includes office management skills. The results have
been very encouraging.
Your prerequisites are tougher  the course longer. Would you
like to review these requirements ? Could you also please send your
postal address?

  i am facing serious problems in recieving mails the problems are listed bellow
  1. irregular mails--many times old mails appears on the top and new mails go 
to the bottom.
  2. mails missing--many times i am not receiving the mails posted on 
accessindia.
  my own mails which i posted does not find place.
  3. many times the orginal mails does not appear but the replys to the orginal 
mails are recieved.

This step by step guide will show you how to perform different tasks in
the Nero - Burning ROM software. It is not an in depth training guide
on all aspects of Nero, however it should be enough of a guide to allow
you to do the things you need to do.
This guide will cover the following areas
* Difference between CDR and CDRW disks - If you are confused
about the different types of Compact Disks out there, read this section.
* Copy all types of CD's - If you want to make a copy of an audio

or wav files from the internet and you want to put them on an audio CD,

What's the difference between CDR and CDRW disks
CDR or CD recordable disks are disks that you can only write too once.
These types of disks are the best if you want to make copies of other
disks or create audio CD's that will be playable on a normal audio CD
player. They are also the cheaper of the two types of CD's.
CDRW or CD Rewritable disks are disks you can write to up to one
thousand times. These types of disks are good for backing up files on
your hard disk or transferring a lot of files from one pc to another.
CDRW disks are the more expensive of the two types.
So if you want to backup files from your hard disk, you are better to
get CDRW disks. It is better to use CDR disks for other purposes as
they are readable on non-computer devices.
When shopping for disks, you get what you pay for. Cheaper disks are
usually less reliable than the more expensive disks. You'll also notice
disks that say 74 minute or 80 minute. The 80 minute CDR disks can hold
more data and/or audio than a 74 minute disk.
How to Make Copies of CD's
If you would like to make a copy of a CD you have, it doesn't matter if
its an audio CD or a CD with software or documents. you copy all disks
in the same way.
1. Start Nero - Burning rom. Your screen reader should announce
New Compilation dialogue.
2. Press SHIFT+TAB until you hear CD-ROM (ISO), 1 of 11.
3. Press the down arrow until you hear CD Copy.
4. Press SHIFT+TAB and you should hear Burn tab.
5. Press the left arrow until you hear Copy Options tab.
6. Press TAB until you hear Drive with source CD.
NOTE: Some people have both a CD-ROM and a CD writer drive in their
computer, having both a reader and a writer drive makes it faster and
easier to copy disks. Unfortunately those of you that are using laptops
will most likely only have one drive. This isn't a real problem, just
makes copying CD's a bit slower.
If you only have the CD writer in your computer, the Drive with source
CD box will only have the one selection. If you have both a CD-ROM and
a CD writer, using the up and down arrows will allow you to select the
drive that contains the disk with the files you want to copy from.
7. Use the up and down arrows to select the drive that contains the
CD you want to copy from.
8. Press the TAB key until you hear Copy button.
9. Now you need to put the CD that you want to copy in the CD-ROM
drive and the blank CD in the CD writer drive. If you only have one
drive, put the CD you want to copy in, Nero will prompt you at the point
at which you need to put the blank disk in the CD writer.
10. Press the SPACEBAR to begin the copy process.
NOTE: If you are using Jaws for windows, its suggested that you change
the screen echo to None while the CD is being copied as JFW will
continually speak the percentage values appearing on screen. To change
the screen echo setting in JFW, hold the JAWSKEY down and press S twice.
JFW should say none.
Don't worry about knowing when the copy is finished as Nero will play a
sound to indicate the copy is finished.
11. Once the copy is complete, you will hear Nero make a noise. TAB
until you hear Done button and press ENTER. Nero should then eject
the CD from the writer drive.
Note: If you changed the screen echo to None in the previous step,
you'll want to press JAWSKEY+S until it says Highlighted.
Congratulations, you've just copied a CD!
Creating Your Own Custom Audio CD's
Creating your own audio CD's from scratch is a bit more involved than
copying a CD. This section will give some step by step instructions on
how to create an audio CD from sound files stored on your hard disk.
This section does not cover where to get these files or on how to
download them.
1. Place a blank CDR disk in your CD writer.
2. Start Nero - Burning rom. Your screen reader should announce
New Compilation dialogue.
3. Press SHIFT+TAB

 meethodology of the article is very cleaar we should
 not always think that condition in our country is
 great. because girls do not know about sexuality. in
 delhi, according to survey, 95 % visually challenged
 girls are unaware about usage of contraceptic or
 sexuality and the method of sexual exploitation. I
 have data of three states. with all the fascilities if
 Delhi Visually Challenged girls are in this condition,

 believe that this issue should not be brought on
 accessindia, because, first, in a way, this is also
 concerned with accessibility rights. When you are
 aware about some situation, then only you can protect
 yourself and your friends from this kind of situation.
 Secondly, it is concerned with law and government

 like to ask, can only the evolution of technology give
 us all the accessibility rights? should we be
 satisfied only with career discussions? Does not this
 kind of issue also come under government policy?
 It is very unfortunate that while discussing about
 this kind of issue, people have very insensitive
 atitude and somebody has called it love crime. For one
 minute, I agree with this respected person. But, if
 somebody is in love and that person is physically and
 emotionally exploited in an institution, is
 institution not responsible for it? Or is it also love
 crime? Secondly, in institutions for visually
 challenged girls, girls and boys are segregated very
 carefully. So there is less chance of falling in love.
 Those who have suggested about not bringing up this
 kind of issue in media, they should remember that,
 with possitivity, it is necessary to accept negativity
 also. Besides, I would like to tell that we cannot
 cover up this kind of issue in the fear that this will
 be problem for visually challenged girls, because
 crime of such institution will never come inlight if
 media is not involved.
 I totally agree that this could be problem for
 visually challenged girls in education, marriage and
 so on. But there is possitive aspect of it also. Girls
 will be told about sexuality and they will then be
 able to empower themselves like sighted girls to face
 the world.
 The real problem is that visually challenged girls
 generally do not think that they could be sexually
 harassed, because many of them, as I have already
 said, do not know about sexuality, and here lies the
 key difference between the harassment of sighted girls
 and that of the visually challenged girls.

I was working for Indian Group of Hotels as Community co-ordinator. I had sent 
my bio-data to the placement cell of I.C.A.I. and that is how I got this
break.



How have you adjusted to your work environment and how have your colleagues 
responded.



It has been comfortable to adjust to work environment as I am quite versatile 
on computers. Moreover my work to a large extent is on those applications
that extensively support screen reading software.



My colleagues respond very sensibly. There is no discrimination of any sort. 
Now they know when I need assistance and come forward to give the same. The
work atmosphere is very comfortable and friendly.



Becoming a C.A. is a tough task even for sighted people. As a blind person what 
motivated you to take up this subject and how did you manage?



That is what many told me when I thought of taking up C.A. as a career. But let 
me tell you, determination and commitment can help you achieve those milestones
which seem difficult otherwise.



I lost vision in my right eye by the time I completed my graduation. I faced 
few interviews where my candidature was not considered because of my vision
problem. I realised that I should have a better education to get a decent and 
dignified job. At this juncture I came to know about Chartered Accountancy.
By this time I had learnt to pursue my studies on my own. I thought if I can 
pursue B.Com on my own then why not C.A.?



Of course, pursuing the course was not easy. It would be difficult for me to 
read for long time. I had to read keeping the book close to my eyes. Commuting
was also quite difficult. For a moment my spirits would be shattered. But I 
would realise that this is not the way to tackle a problem. I will have to
find out ways and means of solving this. I would read for sometime and then 
close my eyes and try to recollect whatever I would have studied. This way
I was not wasting my time and was also giving rest to my eyes, which I needed 
the most. As far as commuting was concerned, I would prefer to walk short
distances, as catching the public transport was difficult. For long distances, 
invariably I would take the public transport. It was quite risky but I had
to take the calculated risk.



After I lost vision in my left eye too, I had to look for means to continue my 
studies and clear my examinations. But the important hurdle was to accept
that I am visually challenged. This did take some time as I would relate myself 
with my friends who either had a good job or were happily married. I realised
that I should come out of this trauma. Sahaja Yoga meditation came to my 
rescue. The meditation gave the overall balance which I needed the most. I 
realised
that I should accept the situation and go ahead, instead of brooding. I came to 
know about the screen reading software and learnt how to use computers.
My urge to pursue the course was rekindled. I got all the materials converted 
to soft copy and started studying. For few subjects I took the assistance
of volunteers. I also had to learn how to communicate with the scribe, as I was 
availing scribe facility for the first time.



What are the special assistive tools you use for help at work? Especially when 
tackling numbers.



As I have already mentioned, I extensively use computers with screen reading 
software. My assignment does not include going through any written documents.
By using Excel and other M.S. Office applications, I am able to manage my job 
quite comfortably.



How did you develop your eye problem?



I was prescribed penicillin tablets for common cold. This was given without 
test dosage and resulted in an allergic reaction which in medical terminology
is known as Steven Johnson Syndrome. My vision started deteriorating 
gradually. This was coupled with growth of eye lashes inside the

 In 2002 ILS a law college in Pune filed a public interest litigation 
 against the Maharashtra Government for implementation of the PWD Act. this 
 Petition is numbered as 70 of 2002. In pursuance of this Petition we got 
 Low floor buses etc. This is an all inclusive Petition.
 Subsequently the National Federation of the Blind, Maharshtra Unit filed 
 Petition No. 129 of 2003 for identification of jobs for the blind etc.
 Both these Petitions have been heard together so there are concurrent 
 orders in both these matters.
 I will now explain what has been happening on the issue of jobs for the 
 visually impaired.
 Over the last 3 years various departments of the Maharshtra Government 
 have been identifying jobs for the disabled.There are about 17 such lists 
 and there matching Government Resolutions. While identifying the jobs and 
 creating these lists an additional category was created namedPartially 
 Sighted within the broad category of visually impaired. So what started 
 happening was that the departments started identifying jobs for the 
 totally blind, low vision, partially sighted. Obviously more jobs were 
 available for the Partially sighted as compared to those for the blind.
 However after looking at nearly all those 17 lists I find that about 17 
 jobs have been identified for the blind. This is nearly the same as those 
 in the Central list. Therefore for the limited issue and for the time 
 being I am going to say the identification process is OK. I will come back 
 to this issue later.
 However the creating of a 3rd category in the 1% for the visually impaired 
 is a problem.
 Now for the next step the Maharashtra Government did not fill up these 
 jobs so the Court hadd to intervene. On 7 September 2006 Court ordered 
 stay of all other recruitments until the disabled backlog was completed 
 and the process should be completed in 3 months. The Petitions are still 
 alive and the matters keep coming up on Board for hearing. The government 
 started issuing advertisements for walk in interviews and for written 
 applications. Now it has come as a big shock that most of the posts being 
 advertised are for the partially sighted and not for the blind or the low 
 visioned.
 The problem is that the advertisements are more or less in line with the 
 jobs identified over the years so the advertisements are really not bad in 
 law in most cases.
 Some totally blind friends approached me and I have filed an intervention 
 application in Petition No. 129 of 2003challenging some of the 
 advertisements which are not in line with the identified jobs and also 
 challenged the creation of Partially Sighted category.
 the matter was on board yesterday however it did not reach but we 
 mentioned it at 3 pm but the Court said we can remedy any wrong being 
 done, come back after the vacations. So here we are.
 Now we will either have to file a fresh affidavit stating that the 
 appointments have to be stopped or the totally blind should be interviewed 
 also. There is a Minutes of meeting dated 26 September which states that 
 people suffering from a higher degree of disability should be preferred- 
 this might help if the totally blind are allowed to give the interviews.
 So the next 2 weeks will be spent in collecting data of discrimination 
 etc.
 I will not go into further detail at this stage. I will copy the order of 
 7 September 2006 in Petition no. 70 of 2006 in another mail. If you want 
 the other orders you will have to go on to the nic site or soon to the 
 iway site.

I saw this device. It is essentially a bar code reader. The concept is that
every page of the book would have a bar-code on one of the corners which
would have complete text of the page coded in this bar-code. Size of this
bar-code is about one CM by one CM. there is a small bar code scanner.
By a
press of a button, the bar code reader scanns the bar code and starts
reading the text coded in that bar-code. In Koria they are having some
publications with such bar codes. It would read only the books that have
such bar codes. 

The cost of this too is quite prohabitive right now.

diwakar should be voted just because he is blind.
  he is really a tallented boy. there is nothing wrong in supporting him.
  however it is also true that blind people get less opportunities to show 
their tallent. 
  whenever such situation comes we must encourage them instead of making it a 
conterversial issue.

about 17 visually impaired persons are going to appear
to the probationary class 1 and class2 examinations
to be held on 10th of september 2006.
this is the first time in the history of  Karnataka
that the visually challenged are taking this kind of examination in such a 
large number.

  denial of promotion on the grounds of disability is really unjust and 
unconstitutional.
  I am also facing the same problem.
  I have put up twenty years of service as a lecturer in a Government 
P.U.College my siniority has been over looked merely because i am a visually 
impaired 
  The other lecturers who are junior to me have been promoted.
  there is no response from the government to my representations.
  if this is the fait, it is very difficult for the visually challenged to come 
up in their carier.
  it seems the respective governments have not taken congnisense of the persons 
with disability act.

Disability is a matter of perception, says Martina Navratilova. If you can
do just one thing well, you're needed by someone. Tragically, however, the

disabled often face inequity.



One such instance comes to light through a recent verdict of the Madras High
Court in J. John Wincent vs The Commissioner of Central Excise, The Chief
Commissioner

of Excise (Cadre Controlling Authority), The Chairman, Central Board of
Excise and Customs and The Registrar, Central Administrative Tribunal.



John had joined the services of the Department as a Lower Division Clerk in
May 1990. Thereafter, he was promoted as Upper Division Clerk in the year
1995.



Consequent to the re-designation of the post in the year 2002, he is holding
the post of Tax Assistant, reads the text of the judgment dated April 27.



John, by virtue of his experience, made a representation to the Department
to consider him for promotion to the post of Inspector of Central Excise and

Customs. However, the respondents did not consider the representation of
the petitioner and he was informed that, being a physically challenged
person,

he would not be able to do the arduous job of Inspector of Central Excise
and Customs. How unfortunate!



There were more people like John who had been refused promotion on account
of disability. They had approached the Central Administrative Tribunal,
which

issued directions to the Department to consider the applications of the
physically challenged persons for the post of Inspector of Central Excise
and Customs.



What happened thereafter? The Department called upon John `to undergo
endurance test of cycling and walking.' And `he was found to have performed
the same

successfully.' Yet, in 2004, John was rejected on the ground that he did not
have `the prescribed height'.



He approached the Tribunal for remedy. Disappointingly, it held that there
was no scope for relaxing the standards prescribed in the Recruitment Rules,

and rejected John's application. Aggrieved, he took his case before the High
Court.



Speaking for John, his counsel V. Raghavachari said that the Tribunal had
erred in rejecting the claim of the petitioner to the benefits conferred
under

Section 47(2) of the Persons with Disabilities (Equal Opportunities,
Protection of Rights and Full Participation) Act, 1995 in the matter of
promotion.

Also, at the time of joining the service John's height was 160 cm, as
substantiated by the physical fitness certificate. For the Department, it
was R.

Santhanam who argued, and he reiterated the contentions earlier urged before
the Tribunal.



Equality for disabled



The short but core point for consideration in this writ petition is:
whether the petitioner is entitled to promotion to the post of Inspector of
Central

Excise and Customs in spite of the disability suffered by him during the
course of his employment? observed Justices P. D. Dinakaran and R. Sudhakar
of

the Madras High Court, who heard the case.



All countries today need to apply affirmative action to ensure that the
women and the disabled are equal to all of us, said the court, citing
Nelson Mandela.

Though the Constitution of India does not specifically prescribe
discrimination on the ground of `disability', it does contain
non-discriminatory provisions

that guarantee equality and equal opportunities for all citizens as in
Articles 14 and 16, pointed out the court.



The Persons with Disabilities (Equal Opportunities, Protection of Rights
and Full Participation) Act, 1995 treats disability as a civil right rather
than

a health and welfare issue, and recognises the need to integrate persons
with disabilities with the mainstream of society by some normative action.



Section 47 of this Act, which Raghavachari referred to is titled
`Non-discrimination in Government employments'. Sub-section 1 says, No
establishment shall

dispense with, or reduce in rank, an employee who acquires a disability
during his service: Provided that, if an employee, after acquiring
disability is

not suitable for the post he was holding, he could be shifted to some other
post with the same pay scale and
