Dear mahendra, I read your reply today only. Although I know that maybe it is too late to comment on this thread, yet I feel compelled to present my humble views. As we all know, courts work on the basis of legal provisions, and, it is those legal provisions that we are trying to provide through this PWD Act, so that no single disabled person has to face and suffer on account of an unjustified court decision. It is a well known fact that today especially in dispute cases involving husband and wife, most legal provisions are in the favor of women. As a journalist, I know about a large number of cases where disabled husbands were not able to get justice even from courts in spite of good advocating and sufficient proofs in their favor. I spoke to a number of legal experts, including judges, who were so convinced by my points that they went on to admit that in the absence of proper and sufficient legal provisions and guidelines, in such particular cases they have to favor the ladies although in 90 percent cases, it is the lady who is at fault. For example, in one instance, the sighted wife tried to give poison to her visually challenged husband and fled away with the jewelery and cash. In two other instances, the sighted wives even indulged in adultry with some other fellows and even gave birth to their illegitimate children. I can quote a large number of cases where visually challenged faithful husbands unnecessarily had to undergo a long struggle to get justice, and, in most cases, failed to get justice even from courts in spite of being innocent. All this happened because there is no law in favor of the disabled husbands, while there are plenty of laws favoring the ladies, which the laweres can misuse very easily. I suppose you have been living out of India for quite some time, and hence are not quite familiar with the present sinario in India especially in this regard. Hello friends, as we all know that for the last few days the whole nation including some gallant Access Indian friends has been participating in the National Mass movement against corruption headed by none other than the 78 years old Vettern Gandhian Reformer, Anna Hazare. Although I was not amongst the 500 brave visually challnged persons who reached Jantar Mantar under one common flag to lend their undaunted support to Anna the Great, yet I salute them for standing up for the cause of the whole nation, and especially that of the V I persons, who have to undergo double ammount of suffering--firstly for their own limitations and secondly because of the callous attitude of the corrupt Government politicians and officials. That is why we have to struggle so hard to get our right to appointment to the vacancies reserved for us, as well as for other issues regarding accessibility and resergvation. The corrupt politicians tried their level best to weaken the movement. In their vicious efforts they are mysteriously trying even to hamper the mails regarding this great movement. Respected Madam Padmani and all other friends, some time back some members suggested to make the new act solid not only from the employability point of view, but also from the social prospective. For example, some one made a very ralavant suggestion that there should be apropriate harsh punishment for the able-bodied girls, who marry disabled youth, only to desert them later and flee with their jewelery and other valuables. not only that, these crooked girls even file legal cases to grab hefty amounts as life-time maintainance from there disabled husbands, who already have to spend so much extra to arrange for the required assistance that they need in order to lead an honorable and hazzle free life. All that these poor youth are left with is a life time remorse of being cheated so badly. Hence there has to be some legal trap for such social criminals. But, to my disappointment, I have found nothing has been said on this burning topic in the new draft. As a visually challenged person, if I am going in an unsafe direction on the road, and somebody guides me to the right one, I would definitely feel obliged. However, if I am deliberately heading in to a wrong direction, even then if some elderly person corrects me, it is my moral duty to be obliged, because that person is actually favoring me. It is always better to correct ourselves before it is too late and we have to suffer on account of the mistakes which could have been corrected or avoided very easily. Hence there is no reason for me to feel bad thinking that I have been insulted on the road. So Ravi, Mr. Nandio is absolutely right in saying that we should be always ready to accept constructive criticism, especially if it is in the form of an advice from an elderly person. Dear friends, I am sorry that even being a new member, the first thing I am writing after my introduction is not sugar-quoted. Although I have been deeply immpressed by Harish's positive attitude and his grate capabilities as a moderator of this list, but what disturbs me is when some of us try to insite or instigate him. If you don't like some posting, or find it not in accordence with the list guideline, is it necessary that you should keep on harping on it? why can you not understand that that moderator has also gone through that particular mail and he knows what to do about it? why are you always eager to have some friend thrown out of this list over a petty issue? this is the high rtime when all of us have to realize that this list is not the private property of one particular member. Rather it is one big family, where every family member is eaqually important. In every family there is one head, and here that head is Mr. Harish Kotion. Now it is just a matter of simple common sense that every family member has to trust their head, and not try to guide or remind him about his duty. It really sounds irritating when other members try to act on his behalf. What do we want to prove? that we are more capable than the moderator? if it is so, that person should go and start a new list of his own.
