John, Sorry to hear about your ordeal. We weld panels on but do not finish bodywork or paint, we are a metal shop. The thing that struck me is the best quality work for the lowest price thing. Anytime it says lowest price that usually means short cuts. He took the short cuts but still charged you the high price. A great job for a fair price is how I like to put it. I far from agree with this Ron guy but I understand how hard it is to bid a job when you can't always see all the damage. Everyone wants a price so I tell them it is an estimate only and, this is the key, I call them if we find anything unexpected and let them come and see it before we fix it and never ever spend the customers money unless he okays it first. To paint your car without fixing the inner wheelwells etc is beyond my comprehension. Maybe I missed this but why did you go so far away to get the work done? Just curious. Not that you don't already know this but even if you were happy with the job nine grand is a little steep. You should always give the customer the benefit of the doubt, I have often knocked some off the price if it came to more than I thought it should have. Making a little less and having a happy customer is way better than making more from an unhappy customer as I suspect Ron is about to find out. Just my 02 cents. I've only had the occasion to put a lien on one item (a car in fact) in my lifetime. The client refused to pay the bill for agreed to work at an agreed price. After giving him sufficient time to raise the money, I put a lien on the car. He WAS forced to sell the car or give it up. I could sell the car (which I eventually did) for what was owed (the lien amount) and if it sold for more than that amount, he would get the rest. As it turned out, the car worth (read "sellable") about what he owed against it. I got my money and he lost his car. Unfortunate but better him than me. I think your problem might be construed as a matter of perception. You say shoddy work, he says not. Unless there's an arbitrator to decide, since no description of the quality was given, it would be up to the arbitrator to determine if you got what you paid for. In my case, I had parts receipts, shop receipts and a fair labor cost (hours and rates by the accepted rate manual at the time) so I had proof (if you will) of what was expected and what was done. I had a small deal once with a deal similar to the above terms, and the lawyer was young. He gave me very close to my 30% even after expenses. He could have taken far more, but since the settlement was only a few thousand dollars he ate much of the costs in his fee to make me happy. The way I found this guy was to talk to the lawyer I wanted. He did not want the case, but knew of this guy who might. Try the same thing, or maybe there is a local legal school or Bar exam school that might have listings of new lawyers ready for a slam dunk case. Small claims court is not enough money, and a lawyer for a real court case could cost more than any damages that might ever be actually collected, which would just result in more time and money out the window. John, Until now I've been quiet on this matter, but i think its kind of too easy money for Ron (If you go over to his shop he will be without his pants because he did laugh them of thinking about how he cheated you). I dont know how much you earn or how solid your economy is overall, but I know for sure that I'm really far of coming even close to $ 9000 a month so I'll be willing to spend that time to get at least something out of him. You say that you maybe wont get anything more than a lien on his house, but if he ever sells it he'll have to pay your $$$ before buying a new one, and he will have problems getting a loan (Now I speak of how it is in Norway). sounds good but lets not lower ourselves to this man's standards (yet). john needs to make his decision on how he wasn't to handle this. in my youth i worked for a friend in a body shop and i do to this day have several friends who own shops or are body / paint men. would i have any of them do work on my chevelle? no ! ; i think not. even those with nice shops cannot seem to understand how to bid collector car work. A lawyer could end up costing more than I would win in court (if anything). Then I would be stuck with a bill, and I'd never collect from Ron anyway. I could put a lien on his house, but I couldn’t force him to sell it. As far as any acts of violence are concerned, I'm sure that would give him an opportunity to have me arrested for beating up a poor defenseless old man. I have nothing to gain from that. I haven’t threatened to sue him or even asked him to fix anything on the car. I just want a date that I can have my sway bar picked up. Thanks for the offer Tom. Hopefully I'll get mine back.
