The News Tribune - Tacoma, WA Friday, June 25, 2004 Back to Regular Story Page Troops to keep immunity ROBIN WRIGHT; The Washington Post WASHINGTON - The Bush administration has decided to take the unusual step of bestowing on its own troops and personnel immunity from prosecution by Iraqi courts for killing Iraqis or destroying local property after the occupation ends and sovereignty returns to Iraq, U.S. officials said. The administration plans to accomplish that step - which would bypass the most contentious remaining issue before the transfer of power - by extending an order that has been in place during the year-long occupation of Iraq. Order 17 gives all foreign personnel in the U.S.-led Coalition Provisional Authority immunity from "local criminal, civil and administrative jurisdiction and from any form of arrest or detention other than by persons acting on behalf of their parent states." U.S. governor L. Paul Bremer is expected to extend Order 17 as one of his last acts before shutting down the occupation next week, U.S. officials said. The order is expected to be kept in place for an additional six or seven months, until the first national elections are held. The United States would draw legal authority from both Iraq's Transitional Administrative Law and the recent U.N. resolution recognizing the new government and approving a multinational force. But some U.S. officials and countries in the multinational force still want greater reassurances on immunity, U.S. officials said. Bush's top foreign policy advisers, including Defense Secretary Donald Rumsfeld, Secretary of State Colin Powell and national security adviser Condoleezza Rice, are still debating the scope of immunity to be granted. "The debate is on the extent or parameters of coverage - should it be sweeping, as it is now, or more limited," said a senior U.S. official familiar with discussions, speaking anonymously because of the sensitivity of the issue. In Baghdad, U.S. officials have been engaged all week with interim Prime Minister Iyad Allawi and National Security Adviser Mowaffak Rubaie. Both sides hope to finalize the terms before Bush leaves for the NATO summit in Istanbul at week's end, U.S. and Iraqi officials said. The administration is taking the step in an effort to prevent the new Iraqi government from having to grant a blanket waiver as one of its first acts, which could undermine its credibility just as it assumes power. But U.S. officials said Washington's act could also create the impression that the United States is not turning over full sovereignty - and giving itself special privileges. The administration's move comes at a time when issues of immunity are particularly sensitive, in light of the scandal over the abuse of U.S. detainees in Iraq and Afghanistan. Wednesday at the United Nations, the administration, citing opposition on the Security Council, withdrew a resolution that would have extended immunity for U.S. personnel in U.N.-approved peacekeeping missions from prosecution before the International Criminal Court. In Iraq, U.S. officials are already concerned about the potential fallout after June 30 among key players, from Grand Ayatollah Ali al-Husseini al-Sistani, Iraq's most powerful religious cleric, to militant insurgents. But the Bush foreign policy team concluded that there are few alternatives until elections select a government that will be powerful enough to negotiate a formal treaty, U.S. officials said. The issue of immunity for U.S. troops is among the most contentious in the Islamic world, where it has galvanized public opinion against the United States in the past. A similar grant of immunity to U.S. troops in Iran during the Johnson administration in the 1960s led to the rise of Ayatollah Ruhollah Khomeini, who used the issue to charge that the shah had sold out the Iranian people. Emergency Sex and Other Desperate Measures is co-authored by three veterans of U.N. operations: Kenneth Cain, Heidi Postlewait, and Andrew Thomson. The powerfully written book chiefly describes their individual journeys from their first days with the U.N. to the present. The book is a searingly open and honest account of their lives and the evolution of their views and values as they travel from one foreign mission to the next. The authors, individually and as a group, come to the U.N. full of idealism, believing that they can promote peace, advance democracy and make a difference for large populations of people through the world body's work. Each is committed, dedicated and hard-working. But as their journey continues, each becomes increasingly disenchanted with the U.N. and acutely aware of its failings. They experience firsthand that, in most cases, U.N. efforts to keep the peace or promote democracy fail, either by incompetence or cowardice, and that these failures often result in thousands of deaths. In Rwanda, Thomson is responsible for the forensic investigation of several mass graves. It is more about the breadth of their work - who and what they have done, going how far back that is the focus of this essay. Rest easy, rock dreamteam, as my evidence is largely theoretical. But, rock fans, listen up because this might shock you. I first noticed something was wrong when I sat down to write an interpretive article about The Whos rock opera Tommy in 1998. I attempted to explain, in very real terms what Townsend meant by these lyrics and the albums amazing surreal graphic depictions in paintings. Deep down I realized Townsend could not have accomplished this fantastic compilation without some equally fantastic assistance. What I really realized was they Townsend didnt write it or conceive of it and I was positive about this. It was simple really, Townsend did not appear to be that amazingly bright in other lyrics, nor did his style of music fit Tommy, nor did I feel at his young age did he have the breadth of knowledge, blues, and music arranging to have accomplished this pivotal, masterwork. Initially I wrote this off as an album solely written and arranged by Sonny Boy Williamson, a very well known, touted original Black blues man. I figured he fed Townsend the info and somehow this album was born. Now I think even Williamson, as well versed as he was about the dark side, did not have the knowledge to come up with all of this. My curiosity now peaked. Then it was on to Dylans Blood on the Tracks album, a great departure from his usual balladeer style and instrumentation. And such resonance. It was the lyrics though that got me because they sounded so much like an old Hippie romantic liaison I had adored, his poetry was so much like Dylans lyrics and included lines which sounded like my recent history, having traveled recently to Europe and then to Tangier, Morocco to see him (You See Her Say Hello has a reference to Tangier). How would my lover have run into Dylan? He did have connections to people in the rock business, even high up, at Rolling Stone Magazine in the mid 1970s. Then I began considering a lot of other rock albums of this era. I knew one thing about it all, whomever was involved behind the scenes in these legendary rock musicians work was a powerhouse and absolute masters beyond none at the amplification equipment being used. I also felt confident that I knew what equipment they were using and I believed they were guarding this stuff with their lives because it really does put forth fantastico sound which many Hippie musicians knew about throughout the 60s and 70s. Many of us owned some of this equipment in our apartments, the stuff was so amazing it kept people sane, organized their lives. But this equipment also got vandalized quickly and fast by the 1980s, and many of us learned it was really complex stuff and very difficult to repair that we gave up on it. In the 1980s some newer Japanese electronics firms, like Sanyo, began to produce similar equipment but it was hard to find. It wasnt until recently that I put more of the real story together. Once I began comparing all these fantastic rock albums that literally made these men legends, I began to realize the threads lead to there being a super genius group behind these legends who were probably living double lives and underground. In envisioned them unable to get air and survive, they sold their genius off to all the great super stars one superb album at a time. They picked and chose their groups however and album recording became a science of clandestine work. In order to guard their identities they recorded the albums in unknown places, brought all their own equipment in from the outside and every album was recorded in a new location. Peoples names on the covers were bogus and often star musicians falsely claimed writership and playmanship. The rock dream team really did all the recording workmanship. When they stepped into each new location, they commanded the scene from top to bottom. Even the greatest of legends followed all orders, top to bottom. Everything was organized to a tee, rocks stars simply showed up to lay in vocal tracks and learn the riffs. What really gave this scene away to me was the similarity in style and lyric quality (superb) for a great many classic albums. At first I figured out three or four, but after a few days of considering it all, I began to believe it was dozens of albums made after 1969. It may have gone back as far as the Beatles White Album; included much of the Stones work (Let It Bleed, Sticky Fingers, assorted tracks on many other albums); Youngbloods (Darkness, Darkness); many of Dylans 70s 80s albums (Blood on the Tracks, Desire, Empire Burlesque, Traveling

THAT CARD AGAIN We floated a trial balloon. We sent requests for price quotations on a list of specific drugs to three pharmacies in Central California. The request included questions on State and Federal discounts, and they were put in the US mail. When a week passed with no responses, we followed up with faxes, visits to the pharmacies, and finally we asked these retailers if they were refusing to give price information. This pressure brought limited results. Yes, they did quote the prices on the list of drugs, but no, they did not give out any information at all regarding the discounts. No retailer signed the quotes. Why? We know that drug companies and other card providers can change prices each week on the drugs they supply, even to Medicare cardholders. They can also change the lists of drugs on which discounts are available, but the cardholder is stuck with what he or she bought (except for that very limited time window at the end of the year when changing cards costs another thirty dollars). The setup is plainly unfair. It gives rise to the possibility of the old fraud called bait and switch. In fact, Mark McClellan, head of CMS (Centers for Medicare Medicaid Services) has said that they will monitor transactions to make sure that a consumer does not buy a card after having been assured that the card offers a discount on the particular drug he buys, only to find out later that the offer has been dropped. One retailer told me that he would not know how much the discount would be until he plugged in the customer's card in his computer. (Customer is supposed to buy a card without knowing what the prices or the discount will be?) We wonder just how CMS can possibly monitor the many millions of transactions involved. Yes, a consumer can complain to Medicare, but since the law permits bait and switch will that complaint have any real effect? When we called, the people on the telephone line at Medicare refused to send information either by e-mail or fax. When the consumer cannot get necessary information in writing, how can he file a complaint? They know they can be sued, and so the word probably went out, Don't put anything in writing. If it can be proved that incorrect or misleading information is given either by the retailer or the people at Medicare, a lawsuit could involve everyone in the distribution chain for that particular purchase. Another possible reason for withholding information on discounts could be that the pharmacist does not have it either! Although the people at Medicare assured me that they did not think that this would be a problem, there is also the possibility that some retailers might not be passing that discount on to the customer. It seems that everyone in the business knows that the setup is a raw deal and an invitation to fraud. Congress has passed a law which makes fraud simple, easy, and even legal! It is further proof, if anyone needed proof by now, that our Congress has been bought and paid for by the drug industry. They became cannon fodder and refugees before they ended up in Guantanamo. THEIR REAL PURPOSE WAS TO HELP ISRAEL CREATE A USEFUL MYTH: AL-QAEDA. The Arab mujahideen were rather harmless as recent revelations from Guantanamo have shown. Israeli and Jewish-American intelligence specialists were trusted by the CIA--Israelis being "allies" and experts on the Middle East--to recruit the Arab "mujahideen" to be used by the US against Russia. Israelis disguised as Arab or Pakistani missionaries (tablighis) even ran the recruitment centers. Israelis playing Muslim missionaries (tablighis) were caught in India and Israel rushed to retrieve them. The Arab "mujahideen" themselves were inefficient and almost useless. I have heard from the relatives of many who died in vain in clumsy incidents in Afghanistan. All the Zionists wanted was a story, a myth that would enable them to create another myth: "Al-Qaeda." The Zionists needed this myth as an excuse for their long-term plans for the "war on terror," a war to destabilze the Middle East and pit the world against Muslims. Neither Bin Laden nor the Arab refugees he took care of were of any military significance. The Afghans themselves were the real efficient mujahideen because they knew the territory and the tribal structure. The Afghans actually saw the Arabs as nuisance. At least three murders of a ritual type are already pinned on the semi-professional heavy metal musicians from the Beasts of Satan band and their plumber friend, all now in custody, who police believe to be the leaders of a satanic sect known by the same name. The men, all in their 20s, are accused of stabbing and shooting their victims, then burying them still alive in a lonely wood. But after checking records of other deaths in recent months in the district of Legnano, on the outskirts of Milan, particularly those that occurred when the moon was full or new, police have alighted on two suicide cases that were particularly baffling: two young men, at least one of them close to the alleged Satanists, both of whom worked in the Legnano cemetery and both of whom killed themselves in the past six months. Angelo Lombardo, 28, a guard at the cemetery, was the first to die. On a Sunday afternoon last December he went into the porter's lodge at the cemetery, doused himself in petrol and set himself on fire. Visitors to the cemetery found him still in flames and writhing in agony. He was taken to hospital with 80 per cent burns but died four days later. Then, in May this year, his friend Luca Colombo, 21, a florist at the same cemetery, hanged himself from a tree in his parent's garden. He is known to have been friendly with some members of the sect, and particularly close to Nicola Sapone, the plumber who is thought to be its leader. Before his death, Luca confided in friends and relatives that he was frightened. A local woman who claims to have been his girlfriend for five months told Corriere della Sera newspaper, "For the first three months he was happy, funny and very sweet. Then suddenly he changed. He wasn't himself any more: nervous, bad tempered, always scowling ... Just once he said that one day he would explain [the problem], but that moment never arrived." As more evidence, if so far only circumstantial, of the sect's crimes emerges from the ground, people have begun coming forward to denounce the police for failing to follow up satanic leads from years ago. Pasqualina Antonini, the mother of Chiara Marino, who died from stab wounds and whose remains were discovered earlier this month, has told reporters she gave police a full account of the Satanists she held responsible soon after her daughter's disappearance more than six years ago. Union leaders, who want contracts in 10 major cities to expire in 2006, say that kind of clout - and the threat of a potentially disruptive nationwide walkout in two years - would allow them to substantially drive up wages and benefits for housekeepers, bellboys and banquet servers. Hotel attorney Ken Ballard said the industry, which is pulling out of a three-year slump, was not about to hand over that kind of power. It's very unclear to us what the union's agenda would be, how moderate or reasonable they would be, said Ballard, who represents the Los Angeles Hotel Employers' Council in negotiations. It would be a very difficult situation. New York, Boston and Chicago are already in line. Los Angeles would be the fourth city with a 2006 contract expiration. And in the next three months, contracts in San Francisco and Washington will be open for negotiations. The national strategy was mapped out by John Wilhelm, president of the Hotel Employees and Restaurant Employees International Union, or HERE, and one of five union presidents pushing for fundamental changes in the labor movement. The group advocates a national approach to negotiations. Currently, each union local makes deals separately with hotels in its area, an approach that Wilhelm said no longer made sense after waves of consolidation in the industry. The hotel council contract covers nine major hotels. An additional eight hotels are covered under separate contracts that are likely to follow the council's agreement closely. Together, the 17 union hotels include some of the area's most prestigious, including the Hyatt Regency, Millennium Biltmore and Westin Bonaventure in downtown Los Angeles, the Westin Century Plaza and the Sheraton Universal. They employ about 4,000 union housekeepers, bellhops, banquet servers and others. The Los Angeles contract expired June 1 after several months of extensions. Without a contract, the union could strike or the hotels could lock out union workers. Neither side has ruled out those possibilities, but no plans appear to be imminent. After three months of slow negotiations, the issue of the expiration date came to a head this week. The union is seeking a two-year pact so that it will expire in 2006. On Monday, union leaders said they would put the hotels' latest offer - which provides moderate wage and pension increases under a five-year contract - to a membership vote July 1. They expect members to solidly reject it, sending a message to the hotel council that it will lose the fight on the expiration date. Late Tuesday, the hotels came back with a move of their own: They declared that negotiations had reached an impasse, meaning that talks are over until the union gives in on its 2006 expiration demand. We hope at some point the union sits down and says let's negotiate a contract that does not expire in two years, Ballard said. Until then, we're at impasse. What happens next is unclear. Union negotiators say there is no real impasse because they are still willing to discuss all parts of the contract. Goss (R-Fla.), who served as a CIA case officer for nine years beginning in 1962, has announced he will retire from Congress at the end of the year. After Tenet announced he would leave in July, Goss, 65, told reporters he had not been approached for the job but "would have to consider it seriously if offered." Although administration officials predicted yesterday that winning Senate confirmation for Goss would be little more than a formality, some Democrats disagreed and predicted such hearings would assertively probe both the CIA's performance under Bush and Goss's fitness for the job. Democrats have urged Senate Minority Leader Thomas A. Daschle (D-S.D.) to prepare for an extensive confirmation hearing this fall, according to several Democratic congressional aides. White House officials had said earlier they were contemplating leaving Tenet's top deputy, John McLaughlin, as the acting head of the agency after Tenet leaves July 11. But the White House has been told to expect blistering criticism of the CIA in a report from the Senate Intelligence Committee in the next few weeks, and McLaughlin was intimately involved in many of the decisions and conclusions that will be called into question. Bush aides also said the president wants someone who can play a strong leadership role within the agency and in public. Administration officials said Bush is focusing on Goss as his choice for the job, although White House communications director Dan Bartlett said last night that no final decision has been made. American officials described the document as an internal report by the Iraqi intelligence service detailing efforts to seek cooperation with several Saudi opposition groups, including Mr. bin Laden's organization, before Al Qaeda had become a full-fledged terrorist organization. He was based in Sudan from 1992 to 1996, when that country forced him to leave and he took refuge in Afghanistan. The document states that Iraq agreed to rebroadcast anti-Saudi propaganda, and that a request from Mr. bin Laden to begin joint operations against foreign forces in Saudi Arabia went unanswered. There is no further indication of collaboration. Last week, the independent commission investigating the Sept. 11 attacks addressed the known contacts between Iraq and Al Qaeda, which have been cited by the White House as evidence of a close relationship between the two. The commission concluded that the contacts had not demonstrated a collaborative relationship between Iraq and Al Qaeda. The Bush administration responded that there was considerable evidence of ties. The new document, which appears to have circulated only since April, was provided to The New York Times several weeks ago, before the commission's report was released. Since obtaining the document, The Times has interviewed several military, intelligence and United States government officials in Washington and Baghdad to determine that the government considered it authentic. The Americans confirmed that they had obtained the document from the Iraqi National Congress, as part of a trove that the group gathered after the fall of Saddam Hussein's government last year. The Defense Intelligence Agency paid the Iraqi National Congress for documents and other information until recently, when the group and its leader, Ahmad Chalabi, fell out of favor in Washington. Some of the intelligence provided by the group is now wholly discredited, although officials have called some of the documents it helped to obtain useful. A translation of the new Iraqi document was reviewed by a Pentagon working group in the spring, officials said. It included senior analysts from the military's Joint Staff, the Defense Intelligence Agency and a joint intelligence task force that specialized in counterterrorism issues, they said. The task force concluded that the document appeared authentic, and that it corroborates and expands on previous reporting about contacts between Iraqi intelligence and Mr. bin Laden in Sudan, according to the task force's analysis. It is not known whether some on the task force held dissenting opinions about the document's veracity. At the time of the contacts described in the Iraqi document, Mr. bin Laden was little known beyond the world of national security experts. It is now thought that his associates bombed a hotel in Yemen used by American troops bound for Somalia in 1992. Intelligence officials also believe he played a role in training Somali fighters who battled Army Rangers and Special Operations forces in Mogadishu during the Black Hawk Down battle of 1993. Iraq during that period was struggling with its defeat by American-led forces in the Persian Gulf war of 1991, when American troops used Saudi Arabia as the base for expelling Iraqi invaders from Kuwait. By Naser Kadhem in Fallujah (ICR No. 69, 21-Jun-04) Captain Mohammed al-Issawi, 35, an officer in the Fallujah Protection Army, stood at his checkpoint with a squad of his men and a handful of anti-Coalition mujahedin insurgents. We work together with the mujahedin to provide security, he admitted. And even if they did not work together, he said, we would cooperate to give them the news - in other words information about United States troop movements, foreigners in town, or anything else of interest to the anti-Coalition guerrilla movement. Despite the creation of the Coalition-sponsored Fallujah Protection Army, FPA, de facto control of this predominantly Sunni town is exercised by the mujahedin, dressed in their trademark yishmagh headscarfs and armed with Kalashnikov rifles and rocket-propelled grenade launchers. Not only do they stand guard on the street, either with the FPA or by themselves, they also enforce their own brand of religious puritanism on the town's inhabitants. Posters on the walls of Fallujah homes, shops, mosques, and schools warn that anyone caught drinking alcohol or bringing it into the town will be severely punished. Young people in the town said the rules are enforced by the mujahedin, who say that residents of the town must obey God's decrees since He helped them win the battle with the Americans, Local student Omar Muhammed, 24, said that soon after the end of the month-long siege of the town by US Marines, the fighters arrested a group of young men whom they caught drinking. The next day the mujahedin drove a white pickup truck through the town, so that people could see how they had been arrested, and they beat them during the ride, Muhammed said. Since then, he said, everyone has deserted the place on the Ramadi highway where the young men were caught, formerly a popular place for drinking alcohol. Cafe owners, meanwhile, have been accused of distracting young men from religion. The mujahedin closed my coffeehouse ten days ago, said Salah Sahi, owner of what was once the al-Nour cafe. One day a group of fighters came and asked me to close down permanently, because young men gather in my cafe. I am thinking of changing my trade to selling religious cassettes and CDs. By Farah Stockman, Globe Staff | June 23, 2004 WASHINGTON -- State Department officials yesterday blamed inaccurate data from the CIA, poor proofreading, and an antiquated database for errors in an annual terrorism report released earlier this year that incorrectly claimed that the number of international terrorist attacks had declined to their lowest point in three decades. A revised report issued yesterday by the department shows that the total number of terrorist attacks rose slightly in 2003 and that the number of significant attacks had climbed to the highest it has been in 20 years. We here in the Counterterrorism Office, and I personally, should have caught any errors that marred the [previous report] before we published it, Cofer Black, the department's coordinator for counterterrorism, told reporters yesterday. But I assure you and the American people that the errors in the . . . report were honest mistakes and certainly not deliberate deceptions, as some have speculated. The earlier report, which was released in April, had been used by senior Bush administration officials to show progress in the war on terrorism. Deputy Secretary of State Richard L. Armitage declared in April that the report provided clear evidence that we are prevailing in this fight. But yesterday, Secretary of State Colin L. Powell told reporters that Armitage was speaking on the basis of flawed information. His characterization obviously was based on a report that had errors in it, an apparently irritated Powell told reporters. It is still a war on terror. It is not won; it continues. The new report counts 208 acts of terror last year. But the previous report said the number of attacks had declined to 190, down from 198 in 2002 and 346 in 2001. The 2003 figure would have been the lowest in 34 years and would have reflected a 45 percent drop since 2001, Bush's first year as president. The previous report also inaccurately stated that 307 people died in attacks last year, down from 725 in 2002. In fact, more than double that number, 625, were killed, according to the new report. The revised report said a total of 3,646 people were wounded worldwide in terrorist attacks last year, a sharp increase from the 2,013 wounded in 2002. The previous report put the number of wounded last year at 1,593. Neither report includes the deaths of US soldiers in Iraq, which State Department officials said did not fall under the classification of terrorism. The data in the report were compiled by the Terrorist Threat Information Center, a newly created organization that reports directly to the director of the CIA. The previous report contained major errors, including the omission of the month of December in a chronology of attacks and major terrorist bombings in Turkey and Saudi Arabia. Yesterday, in explaining the various factors that contributed to the errors, Black said, We do rely upon the TTIC and the CIA to provide us accurate information. . . . But we in my office have to do a better job of proofreading what we get. Black insisted that the new report still showed significant progress in the war on terror and that the errors were, in most cases, relatively minor. You know, you can look at this -- and I guess it's like a Rorschach test, you know, you can see what you want, Black said during a news conference. What I'm trying to do is stick with the aspects of counterterrorism. I think this gives an opportunity to make a product, a publication that is increasingly useful to people. Amy Goodman's Not-So-Good Coverage of 9/11 by Mark Robinowitz YELLOW Alert: Risk of Fascism is ELEVATED http://www.oilempire.us/democracynow.html When Amy Goodman was in Eugene, Oregon on May 8, 2004, I asked her why she thought the liberal alternative media have ignored and censored evidence of Bush's complicity in 9/11. She replied that she had no opinion and asked me for my opinion. I replied that I thought it was a combination of fear and foundation funding controlling certain publications (ie. The Nation). She didn't have a direct response to this, but she said that she was reading David Ray Griffin's book The New Pearl Harbor and promised activists in Seattle that she (finally) would invite him on her show. I informed her that Michael Ruppert's book will be published soon, and her response was "good." Unfortunately, her May 27 interview of Griffin was not-so-good -- perhaps one could use the Newspeak term (from the novel "1984") "double plus ungood" to describe her show's hatchet job masquerading as an interview. In the fall of 2002, Ms. Goodman spoke in the same room at the University of Oregon during a previous speaking tour. After her speech (which was very similar to her May 2004 speech), I asked her after the event if she would help investigate the recently disclosed story of how the Air Force, CIA, NORAD and National Reconnaissance Office were conducting "war games" similar to 9/11 during the 9/11 "attacks," which were apparently used to confuse the air defense response. She would not reply, and looked at me in apparent fear. It was a particularly strange response considering she had just spoken eloquently about her tremendous courage in reporting on the massacre in East Timor. (The issue of the 9/11 war games on 9/11 has not ever been mentioned on Democracy Now -- and it is likely that if they were, DN would run the risk of losing their foundation funding, which would force them to lay off much of their staff.) Until May 2004, Democracy Now did not have any guests who dissented from the official story that 9/11 was the result of "incompetence" by the Bush regime, and studiously avoided any discussion of the most basic evidence of official foreknowledge and complicity. This track record was changed with DN's interviews of 9/11 widow Ellen Mariani (who turned down a million-dollar hush-money payment from the federal government in order to file a RICO lawsuit against the Bush regime) and David Ray Griffin, the author of "The New Pearl Harbor." Mrs. Mariani's activism was described by the show's website as a concern about the "intelligence failure" of the Bush regime. While the full truth of 9/11 will probably never be known, it is already proven beyond reasonable doubt that the kindest interpretation is that the Bush regime knew about 9/11 in advance and deliberately let it happen, just like President Roosevelt knew the Japanese were about to attack Pearl Harbor and chose to allow those attacks to occur in order to galvanize a divided nation to support world war. (FDR did not need to give technical assistance to the Japanese to make sure the attacks succeeded - they were able to find Pearl Harbor on their own. However, the top military echelons kept the Army and Navy commanders in Hawaii "out of the loop" of the intercepted / decrypted Japanese communications that revealed that the "surprise attack" was about to take place, thus ensuring that the "Day of Infamy" would be allowed to take place unhindered.) The only "intelligence failure" of 9/11 was among the American public and media that refuse to connect the dots of the evidence of complicity. DN's interview of David Ray Griffin was more disturbing than mischaracterizing Ellen Mariani's quest for truth and justice. Griffin appeared on the show after a several-months-long campaign by the National 9/11 Visibility Project (www.911visibility.org) called "Waking Amy," an internet-based effort to encourage DN to put Griffin on their show. When DN finally scheduled Griffin, he was going to be on the show along with Mariani - which would have been a very powerful interview. However, at the last minute, DN separated the two, and put Griffin on the air a few days later. Griffin was placed on the show along with long-time anti-conspiracist John Foster "Chip" Berlet, whose group Political Research Associates is an alleged left-wing organization that is funded, in part, by the right-wing Ford Foundation. The London-based International Institute for Strategic Studies (IISS) seems to think so. It stopped the press at the end of May 2004 with its annual Strategic Survey, which claimed that, 'Although half of al-Qaeda's 30 senior leaders and perhaps 2,000 rank-and-file members have been killed or captured, a rump leadership is still intact and over 18,000 potential terrorists at large, with recruitment accelerating on account of Iraq' (1). Coming in the same week as US attorney general John Ashcroft's warning that al-Qaeda is 'almost ready to attack the United States' - and that it plans to do so 'hard' - the Institute's claims about an undefeated terror network brought the political and media worlds out in a sweat. '18,000 SET TO ATTACK' declared the UK Daily Mirror, claiming that bin Ladenites are 'waiting for the order to attack targets in Europe and the USA, preferably with weapons of mass destruction' (2). More prestigious publications also ran with the IISS story. 'Still plotting, still recruiting' said The Economist, arguing that the IISS report shows how al-Qaeda has become a 'textbook business-school case of a multinational enterprise restructuring in response to a big competitive challenge' (3). Time magazine reported that 'bin Laden's network today commands some 18,000 men', and said America remains 'vulnerable to al-Qaeda attack' (4). Of course al-Qaeda types might be plotting another attack on America or Europe, which could leave scores dead. And recent events in Saudi Arabia, culminating with the beheading of US civilian Paul Johnson over the weekend, show that there are still individuals who are willing to do grisly things in al-Qaeda's name. But these remain rare and isolated incidents; where is the evidence to suggest that al-Qaeda has thousands more such willing killers and martyrs, ready to take action at a nod and a wink from bin Laden? Even on their own terms, the IISS figures don't add up. The claim that al-Qaeda has 18,000 potential terrorists is not derived from on-the-ground investigation or a serious assessment of the intelligence or newly discovered al-Qaeda documents, but from some rather simple (in both meanings of that word) arithmetic. The IISS worked out that, since 'at least 20,000 jihadists have been trained in [al-Qaeda's] Afghanistan camps since 1996', and that '2,000 rank-and-file members have been killed or captured' since the start of the Afghan war in 2001, then there must be 18,000 al-Qaeda-trained jihadists left, lurking somewhere around the world's hotspots. According to the IISS, this shows that the war in Afghanistan 'offensively hobbled, but defensively benefited, al-Qaeda', forcing it to 'disperse and become even more decentralised, virtual and invisible' (5). This is exactly the same simple arithmetic that the IISS used over a year ago. In last year's Strategic Survey, published on 13 May 2003, the IISS claimed that al-Qaeda remained a 'potent' terrorist network with 'more than 18,000 trained members at large'; it pointed out that 2,000 rank-and-file members had been killed or captured, leaving 'some 18,000 jihadists who had been through al-Qaeda training camps in Afghanistan' (6). Dja vu, anyone? The 2003 Strategic Survey also generated shock headlines, such as 'Terror crackdown has not reduced al-Qaeda threat, warns think tank' in the UK Guardian (7). A cynic

While describing Musharraf as a clearly intelligent, strong, and sophisticated man, the former US president has written: If he chose to pursue a peaceful, progressive path, I thought he had a fair chance to succeed, but I told him I thought terrorism would eventually destroy Pakistan from within if he didn't move against it. According to Clinton, he undertook the trip to Pakistan despite Secret Service warnings of a possible terrorist strike because of the adverse consequences to American interests of going only to India. Clinton has also described as dangerous India's decision to conduct nuclear tests in May 1998 and has stressed that the tests set back my policy of improving Indo-US relations. The last US president to visit India and Pakistan had quite a few things to say about the two South Asian countries. Clinton in his words... On a likely military response against Osama bin Laden in Afghanistan after the Kenyan and Tanzanian bombings: Although we were trying to work with Pakistan to defuse tensions on the Indian subcontinent, and our two nations had been allies during the Cold War, Pakistan supported the Taliban and, by extension, al-Qaeda. The Pakistani intelligence service used some of the same camps that bin Laden and al-Qaeda did to train the Taliban and insurgents who fought in Kashmir. If Pakistan had found out about our planned attacks in advance, it was likely that Pakistani intelligence would warn the Taliban or even al-Qaeda. On the other hand, Deputy Secretary of State Strobe Talbott, who was working to minimise the chances of military conflict on the Indian subcontinent, was afraid that if we didn't tell the Pakistanis, they might assume the flying missiles had been launched at them by India and retaliate, conceivably even with nuclear weapons. We decided to send the vice chairman of the Joint Chiefs of State, General Joe Ralston, to have dinner with the top Pakistani military commander at the time the attacks were scheduled. Ralston would tell him what was happening a few minutes before our missiles invaded Pakistani airspace, too late to alert the Taliban or al-Qaeda, but in time to avoid having them shot down or sparking a counterattack on India. On Nawaz Sharif's trip to the US to end the standoff with India over Kargil: Prime Minister Nawaz Sharif of Pakistan called and asked if he could come to Washington on July 4 to discuss the dangerous standoff with India that had begun several weeks earlier when Pakistani forces under the command of General Pervez Musharraf crossed the Line of Control, which had been the recognised and generally observed boundary between India and Pakistan in Kashmir since 1972. So help me God" The President and Commander-in-Chief has blatantly violated all tenets of domestic and international law. So that making an oath to "obey the orders of the President" is tantamount to violating rather than defending the US Constitution. According to Lawrence Mosqueda: "The Uniform Code of Military Justice (UCMJ) 809.ART.90 (20), makes it clear that military personnel need to obey the "lawful command of his superior officer," 891.ART.91 (2), the "lawful order of a warrant officer", 892.ART.92 (1) the "lawful general order", 892.ART.92 (2) "lawful order". In each case, military personnel have an obligation and a duty to only obey Lawful orders and indeed have an obligation to disobey Unlawful orders, including orders by the president that do not comply with the UCMJ. The moral and legal obligation is to the U.S. Constitution and not to those who would issue unlawful orders, especially if those orders are in direct violation of the Constitution and the UCMJ." This will not be an easy task. Committees at local levels must be set up across the United States, Canada, Britain, Italy, Japan and other countries, which have troops in Iraq and Afghanistan. These committees should provide protection, support and legal counsel to soldiers who refuse to fight and who face the possibility of prison sentences for desertion, as in the case of Sergeant Camilo Mejia, who was sentenced by a military court in May: "I sit here a free man... I will sit behind bars a free man because I did the right thing," said Mejia. When service men and women come home, we must ensure that they are not obliged to return to the war theater. We must engage a process which protects them from court-martial. We call upon veterans' associations and local communities to support this process. This movement needs to dismantle the disinformation campaign.

Judge Calabresi qualified his comments, adding: I am not suggesting for a moment that Bush is Hitler. I want to be clear on that, but it is a situation which is extremely unusual. The comments provoked a strong reaction this week among lawyers and judges. In a cover letter also released yesterday, Judge Walker said, I am pleased that Judge Calabresi has promptly recognized that his remarks could too easily be taken as partisan and hence were inappropriate. Partisan political comments by judges are a violation of the code of judicial ethics. The Who once sang about how the hypnotized never lie, but as we have seen, people hypnotized by television and deliberately enforced fear can certainly support a war, and a President, which are fundamentally at odds with basic American decency. In fact, people hypnotized by television and deliberately enforced fear will feed themselves into the meat grinder with "God Bless America" on their lips. Michael Moore's film will snap that hypnosis, but good. Those Americans who believed what their President told them because they saw it on the TV will, after less than two hours in their local theater, look at both their television and their President with doubt and loathing when they walk from the darkness into the bright light of day. There are millions of Americans who believed what they were told - about 9/11, about Iraq, about George W. Bush himself - who will come into that bright light with the realization that they have been lied to. Speaking personally, none of the data in this film surprised me. Having spent every day of the last three years working to expose as many Americans as possible to the truth of the man they call President, Mr. Moore was unlikely to explode any shells across my bow. The connections between Bush, the Saudis, the Carlyle Group and the 9/11 attacks were there. The connections between Cheney and Halliburton were there. The connections between Enron, Unocal, natural gas pipelines, the war in Afghanistan and a little-known country called Turkmenistan were there. I enjoyed the fact that Moore showed off unredacted copies of Bush's military service record, allowing us to see the parts of those documents which had been blacked out. I found no fact, no assertion in this film to question or doubt. I have done my homework, and as was made painfully clear, Michael Moore did his. Most Americans don't know about this stuff, and seeing it fully documented and meticulously researched on the big screen will be, to say the least, revelatory. Yes, Virginia, there are billions of dollars to be made off this Iraq war for Bush's friends. The second door on the left is the recruiting office. Sign on the line that is dotted, and be the first kid on your block to die for the benefit of Carlyle's stock options. Be sure to save your pennies beforehand, however, because the Army will dock your pay for the days you are dead. It's policy, you see. Mr. Moore put two daggers into me with this film, the first of which had to do with American soldiers. Trooper after trooper spoke frankly for Moore's camera, condemning both the war and the people who thrust them into it. Several scenes graphically explained what happens to a soldier's body when it is caught in an explosion. The result is ruinous, and the cries of the wounded and the dying will ring in my ears forever. The most wrenching scenes in the film center around a woman named Lila, who loves her

But it is also clear that the commission did nothing when a Justice Department official, in commission testimony last week, brazenly covered up the embarrassing relationship of the FBI to a senior al Qaeda operative, Ali Mohamed. By telling the Royal Canadian Mounted Police (RCMP) to release Mohamed in 1993, the FBI may have contributed to the bombing of the U.S. Embassy in Kenya five years later.The official testifying was Patrick J. Fitzgerald, U.S. Attorney for Northern Illinois, who prosecuted two terrorism cases involving Mohamed. As Fitzgerald told the commission, Ali Mohamed was an important al Qaeda agent who "trained most of al Qaeda's top leadership," including "persons who would later carry out the 1993 World Trade Center bombing."As for Ali Mohamed's long-known relationship to the FBI, Fitzgerald said only that, "From 1994 until his arrest in 1998, he lived as an American citizen in California, applying for jobs as an FBI translator and working as a security guard for a defense contractor."Whatever the exact relationship of Mohamed to the FBI, it is clear from the public record that it was much more intimate than simply sending in job applications. Three years ago, Larry C. Johnson, a former State Department and CIA official, faulted the FBI publicly for using Mohamed as an informant, when it should have recognized that the man was a high-ranking terrorist plotting against the United States. In Johnson's words, ""It's possible that the FBI thought they had control of him and were trying to use him, but what's clear is that they did not have control." (San Francisco Chronicle, 11/04/01)Ali Mohamed faced trial in New York in 2000 for his role in the 1998 Nairobi Embassy bombing. He pleaded guilty to a reduced charge of conspiracy and avoided a jury trial. While pleading guilty, Mohamed admitted he had trained some of the persons in New York who had been responsible for the 1993 World Trade Center bombing.In Mohamed's plea-bargain testimony, as summarized on a U.S. State Department Web site, he revealed that in late 1994 the FBI ordered him to fly from Kenya to New York, and he obeyed. "I received a call from an FBI agent who wanted to speak to me about the upcoming trial of United States v. Abdel Rahman (in connection with the 1993 WTC bombing). I flew back to the United States, spoke to the FBI, but didn't disclose everything that I knew."One year earlier, according to the Toronto Globe and Mail, Ali Mohamed had been picked up by the RCMP in Canada in the company of an al Qaeda terrorist. Mohamed immediately told the RCMP to make a phone call to his FBI handler. The call quickly secured his release.The Globe and Mail later concluded that Mohamed "was working with U.S. counter-terrorist agents, playing a double or triple game, when he was questioned in 1993." His companion, Essam Marzouk, is now serving 15 years of hard labor in Egypt after having been arrested in Azerbaijan, according to Canada's National Post newspaper. The presidency (20012005) in which stubborn men were undaunted by stubborn facts. Just when you thought it couldnt get any wider, the gap between the Bush White House and reality grew even larger last week as both the prez and veep took issue with the findings of the 9/11 Commission that there was no collaborative relationship between al Qaeda and Saddam Husseins Iraq. You can understand the sense of desperation inside the White House bunker as one after another raison dêtre for the Iraqi War has been shown to be a fraud. No weapons of mass destruction; no Iraqis hailing us as liberators (in a recent poll taken for our own Coalition Provisional Authority, just 2 percent of Iraqis, asked to label us as either occupiers or liberators, chose the latter). And now, from the bipartisan commission chaired by Tom Kean, the Republican former governor of New Jersey, the conclusion that there were no links between Osama and Saddam. The commissions staff report did detail some occasions on which al Qaeda agents asked Iraq for help. Alas for the administration, it also detailed the Iraqis refusal to offer any help. Lesser men might get second thoughts from such findings, but the thoughts of George W. Bush and Dick Cheney have long been unsullied by anything so petty as empirical data. The reason I keep insisting that there was a relationship between Iraq and Saddam and al Qaeda, Bush said, [is] because there was a relationship between Iraq and al Qaeda. Cheney complained that the commission just dwelled on the absence of Iraqi complicity in the attacks of 9/11 and did not address the broader question of a relationship between Iraq and al Qaeda in other areas. But when Kean, on the Sunday talk shows, asked Cheney to provide any additional information he had about such contacts, the White House replied that the administration had already provided the material that it had. Cheney is even unwilling to concede that 9/11 coordinator Mohammed Atta did not meet with an Iraqi agent in Prague in April 2001 a Czech intelligence report that the CIA had long dismissed. The commission documented that Attas cell-phone bills show he was in San Diego at the time, yet Cheney still contends that the existence of the Prague rendezvous has never been refuted. But then, this administration has been breathtakingly anti-empirical since the day it took office. Its failure to have an occupation policy for Iraq after Saddam was overthrown was a stunning triumph of will over information. Bush simply discarded the voluminous CIA, State Department and armed services reports on what Iraq would be like in the wake of Saddams overthrow and what it would take to provide the security needed to rebuild the country. Instead, he opted for the fantastical but pleasant assumption that all would be well once Saddam was driven from power. Such folly was based on the intelligence provided by Ahmad Chalabis apparatchiks, who planned to rule post-Saddam Iraq if only they could snooker us into going there. No government agency compiling actual data on Iraq believed Chalabi for a nanosecond, but data dont count for much in the Bush White House. In part, what we have here is a president who will never admit a mistake, and has either selected lieutenants of equivalent stubbornness or instilled that stubbornness in them. For these inscrutable Texans, saving face is everything. But in part, we also have a remarkable indifference to fact. And not just about Iraq. Certainly by design and possibly by belief, George W. In it, he recounted the story of the rising price of whale oil in the mid-19th century. The demand for whale oil as a means of lighting lamps was increasing, but the supply of whales was decreasing. There would soon be a whale oil crisis, some believed. Then an engineer discovered that black oil in the western part of Pennsylvania could be converted into a newly marketed fuel, kerosene. The rising price of whale oil had created an incentive to find an alternative. That alternative became the basis of the modern, energy-intensive economy. In 1973, there were price controls on oil and gasoline. Gramm argued that a similar situation in the 1850s would have reduced the incentive to find an alternative. It would also have created shortages of whale oil in the marketplace. As Gramm told a group of students in August of 1974, that article had made him famous. He had worked for years publishing unread academic articles in scholarly journals, yet that whale oil article had taken him less than a day to write. He admitted that this told something about his previous allocation of time. Four years later, Gramm was elected to Congress. Eight years later, he was elected to the U.S. Senate. His political career's skids were greased with whale oil. A SHORTAGE OF WHALES There is no doubt that the cost of locating and killing suitable whales was rising in the 1850s. An objective oil shortage was taking place. There was no way that homes in the world could continue to be lighted by lamps using whale oil. Coal oil was a promising alternative after 1856, but in 1859, Pennsylvania's petroleum oil appeared on the scene. There was no way that the rising price of whale oil would have led to a sufficient increase in the supply of whales. The primary economic function of price -- to allocate supplies -- was a demand-side phenomenon in the whale oil market. But the secondary function of price -- to encourage the development of alternatives -- led to the technological breakthrough on which modern society rests. The fact that there was a shortage of whales was not crucial for the future of the world economy, but this fact was not clear in 1855. What was clear was that there was a rising price for whale oil. The success of the free market in developing suitable alternatives has persuaded many economists that there are always alternatives at some price. This faith has been confirmed time after time. The success of the free market in developing alternatives prior to a major downturn, let alone a collapse, caused by the looming shortage has persuaded economists that the free market can solve all problems of supply and demand at some price. This raises three crucial questions: 1. How high will the price get? 2. What if politicians cap the legal price? 3. What if politicians outlaw the alternatives? A SHORTAGE OF PETROLEUM Every day, the world consumes about 80 million barrels of oil. This means that every 12 days, it consumes a billion barrels. The newspapers report that nearby towns warned the police that the robbery was about to happen, but never collect all of these warnings into one report to show the overwhelming evidence that the City's elite deliberately allowed the robbers to act unhindered. Despite these prior warnings, the police act surprised when notified it was underway. The commander of the nearest police station continues working at his desk despite the robbery across the street. The Mayor is holding a photo opportunity at a nearby elementary school, and continues reading to second graders even after his assistant whispers in his ear that bank robbers had just committed the largest mass murder in the city's history. The region's liberal, "alternative" newspaper that had previously published accurate reports about the Mayor's corruption scandals attacks independent journalists who dare to describe these anomalies. The police forces of the city and nearby cities were following the robbers before their assault on the bank, and the identity of the robbers (as declared by police spokespersons after the fact) is disputed by press accounts that several of the robbers have good alibis for being in other cities at the time. Porter Goss get the nod to be the new DCI (Director of Central Intelligence) at the CIA? Donors contributed to Majority Leader Tom DeLay's legal defense fund. Wedding guests gave presents when Majority Whip Roy Blunt married a lobbyist. And, strange as it may seem, a London casino provided a gift to the lawmaker in charge of House operations. At least, that's how Rep. Bob Ney listed his winnings from a card game in financial disclosure forms released Wednesday. The disclosures are made public each year to provide a financial portrait of each lawmaker. Generally, House members are less wealthy than senators, whose forms were released Monday. The top House member, Speaker Dennis Hastert, R-Ill., was among those without large assets in 2003. The former high school wrestling coach earned a $198,600 salary, but his income beyond that was not huge: a $28,567 pension from the state of Illinois and $5,000 to $15,000 from rental on a Washington townhouse. A mutual fund was valued between $50,000 and $100,000. Minority Leader Nancy Pelosi, D-Calif., did much better than Hastert financially -- thanks in large part to her husband, an investor. Wine played a major role in the couple's assets. A vineyard in St. Helena, Calif was valued between $5 million and $25 million. The sale of an 8-acre vineyard in Rutherford, Calif. brought revenue of between $1 million and $5 million. The longest-serving House member also did well, when his spouse's assets are counted. Rep. John Dingell, D-Mich., disclosed that his wife, Debbie, has General Motors stock options worth between $1 million and $5 million, and a company savings-stock purchase plan worth between $500,000 and $1 million. Mrs. Dingell is vice chairman of the General Motors Foundation. One lawmaker received money from a calamity rather than an investment. House Armed Services Committee Chairman Duncan Hunter, a California Republican, disclosed insurance benefits of $500,000 to $1 million after his home burned down in last year's Southern California wildfires. The disclosure forms do not show net worth, but provide outside sources of income beyond lawmaker salaries -- $154,700 for rank-and-file, more for leaders. Assets, liabilities and income are usually reported in broad dollar ranges. DeLay, a Texas Republican, attached to his disclosure form a list of contributors to his Legal Expense Trust that totaled $53,500 in 2003, including $41,500 from political action committees and corporations. Reliant Energy Inc. of Houston, International Integrated Industries of Las Vegas and R.J. Reynolds Tobacco of Winston-Salem, N.C., each donated $5,000. A political committee headed by Rep. Billy Tauzin, R-La., also contributed that amount. Tauzin formerly headed the Energy and Commerce Committee. There are more than 120 millionaires in the House, according to financial disclosure reports filed with the clerk's office, putting the percentage of millionaires in the lower body much higher than that found in American society as a whole. At least 28 percent of House members are millionaires, compared with 3.5 percent of American households, as estimated in The Millionaire Next Door by Thomas Stanley and William Danko. While the House is often thought of as the people's chamber, compared to the Senate, which Thomas Jefferson envisioned as a saucer to cool popular sentiment, the House has become more and more a place of the gentry. The salary of a rank-and-file lawmaker is $157,000, according to the House legislative resource center. Lawmakers report their assets and incomes in broad ranges, such as between $15, and $50,000 or between $1 million and $5 million. Because a survey of House financial disclosure reports by The Hill tabulated only the lower value of lawmakers' listed assets, it is possible that there are many more than 123 millionaires in the House. Also, lawmakers are not required to include the value of their primary residences among their reported assets. The Hill's analysis included financial disclosure reports made public yesterday, as well as local newspaper accounts from last year's reports on the personal assets of various state delegations. California was the state with the most millionaires - close to 20. In Congress, financial acumen - or luck - doesn't seem to translate into political success. A review of the newly released financial records of Republican and Democratic House leaders show that only one has listed assets definitely in excess of $1 million: House Minority Leader Nancy Pelosi (D-Calif.), who with her husband reported holdings worth at least $22.8 million. Pelosi's biggest holding was a $5 million to $25 million stake she holds jointly in a vineyard in St. Helena, Calif. House Speaker J. Dennis Hastert (R-Ill.) reported at least $98,000 in assets, but he also reported owing a mortgage worth between $50,000 and $100,000. President Richard Nixon, frustrated with the Vietnam War, orders tens of thousands of US and South Vietnamese troops to invade neutral Cambodia. He launches his new war--and widens his bombing campaign--without consulting an outraged Congress. Demonstrations engulf campuses and cities. Aides to National Security Adviser Henry Kissinger quit in protest. And at the Justice Department, an assistant attorney general named William Rehnquist, in charge of the Office of Legal Counsel, makes a case for the legality of Nixon's new war in a white paper, The President and the War Power. It is half a lifetime from that spring to this one, and half a world from Cambodia to Iraq. The historical chasm abruptly collapsed, though, with the release of the memo on torture written for the White House in August 2002 by Assistant Attorney General Jay Bybee, Rehnquist's latter-day successor at the Office of Legal Counsel. What do Nixon and Cambodia have to do with the beatings and rapes at Abu Ghraib? Ask Bybee, because it is his memo that makes the comparison with Cambodia and Rehnquist, a comparison that lays open the deeper motivations, goals and implications of the Bush Administration's interrogation policy. The Bybee memo attempts to erect a legal scaffolding for physical and psychological coercion of prisoners in the War on Terror. Coming from the Office of Legal Counsel, it holds the authority of a policy directive. The memo proposes so finessed and technical a reading of antibrutality laws that all manner of cruel, inhuman or degrading interrogation techniques--including beatings and sexual violations like those in Abu Ghraib--simply get reclassified as Not Torture. The memo's language so offends common sensibility that within a few days of its release, White House officials were disavowing its conclusions and selectively declassifying documents allegedly showing the President's commitment to humane treatment of prisoners. (How exculpatory is the Bush Administration's self-serving document dump? Not a single page is concerned with prisoners in Iraq. Not one sentence refers to the CIA, which according to Seymour Hersh first employed coercive interrogation in Afghanistan with the acquiescence of Defense Secretary Donald Rumsfeld. Indeed, the most substantial and authoritative Pentagon document declassified by the White House, the April 4, 2003, Working Group Report on Detainee Interrogations in the Global War on Terrorism, explicitly limits its scope to DOD personnel in DOD interrogation facilities. Contract interrogators and CIA operatives are nowhere covered; neither are prisoners held under the authority of foreign governments, paramilitary allies or US intelligence agencies.) Yet even while putting up a smokescreen of concern for humanitarian treatment of prisoners, the Administration made no attempt to distance itself from Bybee's most crucial theme: unreviewable presidential war powers. Additionally, the bill would grant the FBI greater power to secretly monitor non-citizens and would allow the use of secretly gathered evidence in immigration hearing without giving defendants the opportunity to legally challenge the information. The Anti-Terrorism Intelligence Tools Improvement Act of 2003 (HR 3179) was introduced in the House last September and is currently in the House Judiciary Committee. The bill's opponents fear that one of the bill's sponsors, Representative Porter Goss (R-FL), who also chairs the House Intelligence Committee will fold the provisions of HR 3179 into the annual intelligence authorization bill, making it difficult for lawmakers to oppose. The legislation calls for a one-year maximum jail sentence for anyone who knowingly violates the nondisclosure provision of the USA PATRIOT Act. Anyone who violates the rule with the intent to obstruct an investigation or judicial proceeding would get a maximum sentence of five years under the legislation. The bill also gives law enforcement the ability to enlist the judicial system's help in forcing people to comply with the National Security Letter information requests. There is no reason for this legislation, Chip Pitts, head of the Bill of Rights Defense Committee of Dallas and a former constitutional law professor told Wired News. Given the expanse of powers and secrecy already granted in the Patriot Act, and given the unclear security benefits and possible security detriments of that legislation, why do we need a further amendment of the law to grant more powers to the government? But proponents of the bill do see a need for the provisions of the HR 3179 because without it, they say, the nondisclosure provision on the Patriot Act lacks teeth. Right now you can't disclose if you receive a National Security Letter, spokesperson for the House Judiciary Committee Jeff Lungren told Wired News. But if you do disclose it, there is no penalty for that. There's [also] no stick to deal with a person that refuses to comply with a national security letter. Wired reports that proponents of the legislation accuse civil libertarians of overreacting to the legislation. They say the purpose of the bill is to plug a few gaps in the Patriot Act by providing for clear penalties in areas that were left ambiguous. But to Jim Dempsey, director of the Center for Democracy and Technology (CDT), those gaps are important because they give companies a limited ability to negotiate with authorities. Dempsey told Wired that if federal agents make a request that a company finds too broad, they can sometimes resist and force the FBI to narrow their search. Former high-ranking CIA officials say a corporate executive should be considered as departing Director George Tenet's successor. A seasoned business leader, even without a background in spying, could reorganize management and improve communication within the nation's spy structure, intelligence experts say. Large corporations and the nation's intelligence apparatus both are made up of smaller entities with varying missions that must fit under a unified umbrella. A chief executive officer's job -- like an intelligence director's -- is to keep them focused on the same goals and ensure they don't lapse into bad habits. The new intelligence chief is going to have to be somebody who can be a strong advocate for change and drive it and communicate it, said Kenneth Beeks, vice president for policy at Business Executives for National Security, a non-profit Washington group of corporate leaders analyzing defense issues. That's also what they always say about a CEO. Problems in U.S. intelligence include lack of creative thinking and unwillingness of the various agencies to talk to each other, the experts say. It would take a good manager about 15 minutes to realize this community isn't functioning in an optimal way, said John Gannon, former CIA deputy director and now staff director for the House Select Homeland Security Committee. The basic ways of developing and integrating and delivering (intelligence) are not that different from other products. Though he isn't specifically recommending former General Electric Co. Chairman and CEO Jack Welch for the job, Gannon and others said they favor somebody of that ilk -- somebody who's managed large enterprises. Getting a corporate type to restructure the intelligence community would be a good idea, former CIA Director Stansfield Turner agreed. You could also use an ambassador, a civil servant, a general -- basically, somebody to give a fresh look from outside without any encumbrance of loyalties to the CIA or anybody else. Turner and Gannon cited John McCone, a California business executive and Atomic Energy Commission chairman who was President John F. Kennedy's surprise choice in 1961 to head the CIA. McCone won praise for suggesting the Soviet Union was moving nuclear missiles into Cuba -- a development that led to the Cuban missile crisis. In interviews in 1987 and 1988 for the University of California-Berkeley's Institute of International Studies, McCone recalled that CIA officials initially questioned his arguments about the missiles. One thing about a professional intelligence analyst is that he deals with known facts in his analytical processes. He does not deal with intuition or judgment factors, McCone said, according to a transcript. But not being a professional intelligence officer, I was dealing with intuition and judgment, which you often use in business. Tenet is resigning July 11 as head of the CIA and manager of 14 other intelligence agencies. Critics in Congress and elsewhere say Tenet is at least partly responsible for the nation's failure to anticipate the Sept. 11 terrorist attacks or to determine the state of Iraq's weapons stockpiles. John McLaughlin, Tenet's deputy, will serve as acting director. Many observers predict a permanent replacement is unlikely until after the November election, and they say a new administrative position could be created with greater control over the spy agencies. At their 11th annual meeting in Geneva, 31 participants expressed their unanimous desire that four of them with particularly relevant mandates see the prisoners as soon as possible to check that international human rights standards are being upheld. The four experts recommended to make the visits were the Rapporteurs on the independence of judges and lawyers, on arbitrary detention, on the right of everyone to physical and mental health and on torture and other cruel, inhuman or degrading treatment or punishment. These four would also make themselves available to the authorities concerned for consultation and advice on all issues within their areas of competence, they said. In a separate statement, the human rights experts deplored targeted killings, demolition of Palestinian houses and other practices by Israeli authorities and denounced the practice of 'suicide bombings' carried out against the Israeli population.
